CITY OF GARDEN CITY REGULAR COUNCIL MEETING MINUTES November 3, 2025 The Mayor and Council of the City of Garden City met in Regular Session Monday , November 3, 2025 at 7:00 p.m. in the Council Chambers of the Civic Center, 6000 Middlebelt Road, Garden City, Michigan. AYES: Unanimous ABSENT: None Motion Passes 7-0 Mayor Jacobs announced it was time for public comment.  John Niemiec spoke regarding an issue with bad cement used on city projects and spoke of poor workmanship on projects on Deering and throughout city.  Moe Hacham, thanked Police Department for quick response time to break in and spoke of issues he has encountered with Ordinance and Code Enforcement staff regarding vacant property designation.  Mike Jones, spoke regarding upcoming Dueling Pianos fundraiser at Radcliff Center.  James Lenze provided information on how to purchase tickets for the Rotary Club Dueling Pianos fundraiser and presented a ticket to the event to Mayor Jacobs.  Kevin Hunt spoke regarding his request for information on Garden City Library’s plan to use library millage building fund funds.  Kim Marquette thanked the city for their support for the Fire Department pumpkin sale and food truck rally and gave information on upcoming concert performance and nativity exhibit at Straight Farmhouse. The City of Garden City will provide necessary auxiliary aids and services (such as signers and audio tapes) to individuals with disabilities attending meetings or hearings. A two-week notice is required. For assistance, please contact the Administration office at (734) 793-1660. Public Participation at Meetings. Members of the public shall speak only when recognized by the presiding officer. Members of the public shall be limited to speaking only during the “Public Comment – General” for issues not on the meeting agenda (limited to three (3) minutes) and following Council discussion on each agenda item Garden City Council Meeting Agenda November 3, 2025 Page 2 prior to a vote by the City Council on that item (limited to three (3) minutes). Each speaker shall observe the specified time limitation unless the rules are waived by a majority vote of the City Council. Due to an issue that may involve a large amount of public comment, by a majority vote of the City Council, the public comment time limit may be reduced to one (1) minute per member of the public. The presiding officer may also encourage groups to designate one or more individuals to speak on their behalf to avoid cumulative comments. Individuals may only speak one time per topic, including one time during public comment. Individuals may only comment during public comment and/or when a vote is being taken by the Council. Prior to addressing the City Council, members of the public shall register with the City Clerk on a form provided by the Clerk and shall identify themselves by name, street name, and city of residence at the podium prior to speaking. The City Clerk shall record in the meeting minutes the name, street name, city of residence, and/or organizational affiliation of persons addressing the City Council and the topic to which they speak. A person shall not be excluded from a meeting that is otherwise open to the public except for a breach of the peace actually committed at the meeting. Disorderly Conduct at Meetings Prohibited. The presiding officer may call to order any person who is breaching the peace or being disorderly by speaking without recognition, engaging in booing or catcalls, applauding, failing to be germane to the topic or issue being considered, speaking longer than the allotted time, threatening intent to commit an act of unlawful violence to a particular individual or group of individuals, excessive body odor, or engaging in other conduct which is determined by the presiding officer to be disruptive to the meeting. Any person so disrupting a lawful public meeting of the City Council may be removed or excluded from a meeting that is otherwise open to the public in accordance with the Michigan Open Meetings Act and shall be guilty of a misdemeanor pursuant to state statute, being MCL 750.170 et seq, and §131.03(B) of the City Code Of Ordinances. STATE OF MICHIGAN COUNTY OF WAYNE CITY OF GARDEN CITY City of Garden City Council Meeting Page 3 of 12 October 20, 2025 ORDINANCE NO: 25-008 ORDINANCE AN ORDINANCE OF THE CITY OF GARDEN CITY PROVIDING FOR AMENDMENTS TO BUSINESS REGULATIONS - CHAPTER 111 FOOD AND DRINK REGULATIONS; PROVIDING FOR REPEAL OR SEVERABILITY; AND PROVIDING FOR PUBLICATION AND EFFECTIVE DATE. THE CITY OF GARDEN CITY ORDAINS: THE FOLLOWING SECTIONS OF THE CITY OF GARDEN CITY CODE OF ORDINANCES BE AMENDED AS FOLLOWS TO READ: CHAPTER 111.079: MOBILE FOOD VENDING § 111.080 INTENT In the interest of permitting mobile food vendors in the City and also to provide a framework under which such businesses operate, this chapter is established. § 111.081 DEFINITIONS The following words and terms shall be defined for the purposes of this chapter. As used in this chapter, the following terms shall have the meaning indicated: MOBILE FOOD VENDING means vending, serving, of offering for sale food or beverages from a mobile food vending unit, along with ancillary sales of branded items consistent with the food or mobile food vendor, such as a tee shirt that bears the name of the company, restaurant or organization engaged in mobile food vending. MOBILE FOOD VENDING UNIT means a vehicle or trailer with a self-contained kitchen, equipped to create, prepare or package food for the purpose of vending, service or offering for sale that is licensed to operate on a highway. MOBILE FOOD VENDOR means any individual, company, restaurant or organization operating a mobile food vending unit. OPERATES means engaging in activities associated with the conduct of business, including setup and takedown and/or hours of operation and locations where the mobile food vending units are allowed to be open for business. CITY APPROVED COMMUNITY EVENT means an event that is approved or sponsored by the City through a Council Resolution, Special Event Permit, Rental Agreement or affiliation. The event would be community based, hosted by the city or a non-profit organization and proposed to attract more than a small gathering of related people. § 111.082 PERMIT REQUIRED (A) No mobile food vendor shall operate a mobile food vending unit without a permit issued by the City authorizing such operation. The City Clerk shall prescribe the form of available permits and the application for such permits. The City Council shall, by resolution, establish appropriate fees for the available permit. (B) All permits shall be prominently displayed on the mobile food vending unit. No vending through a mobile food vending unit of food or other human consumables shall be permitted unless it meets the definition of mobile food vending as defined by this chapter. (C) No permit shall be required for a mobile food vending unit which is operated in conjunction with any City approved community event but separate approval may be required from the hosting organization. The requirements of Chapter 111.086 shall still apply § 111.083 DURATION OF PERMIT; NONTRANSFERABILITY City of Garden City Council Meeting Page 4 of 12 October 20, 2025 Permits issued by the City Clerk shall be valid for one year from the date of issuance for the mobile food vending unit identified on the permit. Any permit issued under Chapter is not transferable. § 111.084 APPLICATION FOR PERMIT (A) Any mobile food vendor desiring to engage in mobile food vending in the City shall submit a completed application to the City Clerk for a permit undier this chapter. The submitted application must include all required information including: (1) The name of the business/mobile food vendor; the business/mobile food vendor registered business address, including county of location; (2) The name of the business/mobile food vendor owner; the owner’s address; (3) A copy of applicant’s ID (4) A copy of the food service license issued by the State of Michigan, Michigan Department of Agriculture and Rural Development, or successor agency; (5) Proof of an insurance policy in an amount not less than $100,000 for property damage and injuries, including injury resulting in death caused by the operation of the mobile food vending unit (6) A copy of vehicle registration and vehicle insurance (7) In addition to the application requirements under this subsection, each applicant must successfully pass an annual fire inspection to ensure they are in compliance with all relevant requirements of city fire code. (B) The applicant shall truthfully state, in full, all information requested on the application for a permit issued by the City Clerk’s Office. Additionally, the application shall provide all documentation, such as proof of insurance, as required by the chapter or by resolution of the City Council. The application for a permit shall be accompanied by a fee as identified in the City Fee Schedule and adopted by City Council. (C) Upon receipt of a completed application, the City Clerk shall forward a copy of the application to the Fire Marshall to schedule an inspection of the mobile food vending unit for compliance with the fire prevention code. (D) Filing an application for a food truck license shall constitute consent to inspection by the fire department for the purpose of ensuring compliance with the fire prevention code § 111.085 FEES (A) An annual permit fee in an amount established by adoption of Fee Schedule by the City Council, shall be required prior to the issuance of a mobile food vending permit. (B) An annual fire inspection fee in an amount as established by adoption of Fee Schedule by the City Council shall be required to be paid following the completion of annual fire inspection by Fire Marshall and prior to issuance of a mobile food vending permit. (C) The permit fee shall be non-refundable. § 111.086 REQUIREMENTS (A) Mobile food vending units may operate on private property on parcels zoned O-1, C-1, C-2, C-3, M-1, PD, CBD, VP, PR, HS if in compliance with the applicable provisions of the Zoning Ordinance. Sites in permitted district shall be permitted to have mobile food vending unit operating on site not more than 12 total days either consecutively or throughout the year in a calendar year. (B) Mobile food vendors shall not operate on city-owned property or on public streets or right-of-ways unless approval is obtained for street closure and except as such times and in such locations permitted by the City Council. When mobile food vendors are permitted to operate on public streets, no food service shall be allowed on the driving lane side of the mobile food vending unit. (C) No food shall be sold, prepared or displayed outside of the mobile food vending unit while on the location noted on the permit. (D) Mobile food vendors shall provide appropriate waste and recycling receptacles at the site of the unit and remove all litter, debris and other wastes attributable to the mobile food vendor or customers on a daily basis. Spills of food or food by-products shall be cleaned up by the vendor, and no dumping of gray water on the ground or streets. (E) Mobile food vendors shall not use any flashing, blinking or strobe lights, or similar effects to draw attention to the mobile food vending unit: all exterior lights over 60 watts shall contain opaque hood shields to direct the illumination downward. City of Garden City Council Meeting Page 5 of 12 October 20, 2025 (F) Mobile food vendors shall not use loud music, amplification devices, video/LED screens or any other audible methods to gain attention which causes a disruption or safety hazard as determined by the City. (G) There shall be no signage used by mobile food vendors except for what is on the mobile vending unit itself and one 2 x 3 foot weighted A-frame sign not placed in the right-of-way. (H) When operating the mobile food vendor shall not place personal property outside of the unit including but not limited to dining furniture, fixtures and equipment. (I) No mobile food vendor or unit shall utilize any electricity or power without the prior written authorization of the power customer; no power cable shall or similar device shall be extended across any street, sidewalk or parking lot except in a safe manner as approved by the Building Official. (J) No mobile food vendor or unit shall utilize any power from utility poles or directly from the power company. (K) Mobile food vendors shall comply with all applicable City, County and State laws, regulations and ordinances, including those regulating noise, signage and loitering. (L) Mobile food vendors must submit written permission from the property owner to the City Clerk’s Office before beginning operations at a site. Upon approval, the City Clerk’s Office shall issue a license identifying the dates the mobile food vendor is allowed to operate. This license must be clearly displayed on the mobile food unit to allow the City to verify compliance. (M) Only one mobile food vendor shall operate per zoning lot at any one time unless permitted by City. (N) The location of the mobile food vendor on the lot shall not create any unsafe access to the business or vendor. No mobile food vendor shall conduct business in such a way as would increase traffic congestion or delay, constitute a hazard to life or property, interfere with an abutting property owner, or obstruct access to emergency vehicles. (O) Mobile food vendors must comply with the site frequency limit established in section 111.086 (A) This pertains to all lots or parcels with shared usage such as strip malls. Site frequency is exempt for grand opening events at new businesses. Site frequency limit shall apply to 12 days total per calendar year, not 12 days per mobile food vendor. (P) Mobile food vendors shall operate between the hours of 6:00 a.m. and 10:00 p.m. The vehicle must leave the lot and no overnight parking of the vehicle is permitted. (Q) Mobile food vendors shall include in the application a copy of the local health department permit for safe food handling and any other permit provided by the health department and the State of Michigan. Mobile food vendors must provide to the City a EIN tax number from the State. (R) Mobile food vendors shall include a sketch of the proposed location of the unit on the property. (S) Mobile food vendors shall not represent the granting of a permit under this chapter as an endorsement of the City. (T) Prior to approval, the property owner or lessee must be in compliance with the City Code of Ordinances including outstanding ordinance enforcement actions such as pavement condition, overgrown grass and weeds, open storage, etc., any open permits, unpaid taxes or water bills. (U) Installation of a grease interceptor, or other alternative treatment technology, is required, and is subject to all applicable requirements under the law, including but not limited to the Michigan Plumbing Code and applicable plumbing and sanitation requirements found in the City’s Code of Ordinances. Disposal of waste grease into city storm or sanitary sewer is prohibited per section 51.017. (V) All generators or auxiliary power unites used in connection with a licensed mobile food vending unit shall be operated and maintained at a level that does not exceed sixty (60) decibels (dBA), as measured at or beyond the nearest residential property line (W) Mobile food vendors shall not be permitted to operate within 100 feet of the front door of a brick and mortar restaurant establishment. § 111.087 REVOCATION OF PERMIT The City Clerk shall revoke the permit of any mobile food vendor engaged in mobile food vending who ceases to meet any requirement of this chapter or violates federal, state, county or local law, ordinance or regulation; makes a false statement on the permit application; or conducts activity in a manner that is adverse to the protection of the public health, safety and welfare. Any revocation shall have immediate effect and remain in effect unless and until reversed by the City Clerk. § 111.081 PENALTY City of Garden City Council Meeting Page 6 of 12 October 20, 2025 Any person who violates this chapter shall be responsible for a municipal civil infraction subject to a fine not to exceed $500.00. Each day that a violation continues shall be a separate violation. SECTION II. SEVERABILITY If any clause, sentence, section, paragraph or part of this Ordinance, or the application thereof to any person, firm, corporation, legal entity or circumstances, shall be for any reason adjudged by a court of competent jurisdiction to be unconstitutional or invalid, said judgment shall not affect, impair or invalid the remainder of this Ordinance. It is hereby declared to the legislative intent of this body that the Ordinance is severable, and that the Ordinance would have been adopted had such invalid or unconstitutional provision not have been included in this Ordinance. SECTION III. REPEAL. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed only to the extent necessary to give this Ordinance full force and effect. SECTION IV. SAVINGS CLAUSE. All rights and duties which have matured, penalties which have been incurred, proceedings which have begun and prosecution for violations of law occurring before the effective date of this Ordinance are not affected or abated by this Ordinance. SECTION V. PUBLICATION. The Clerk for the City of Garden City shall cause this Ordinance to be published in the manner required by law. SECTION VI. EFFECTIVE DATE. AUTHORIZATION OF COUNCIL TO CONVEY PROPERTY Garden City having considered a neighborhood stabilization program, having exercised its rights under MCL 211.78(M) in connection with the purchase of certain tax foreclosed parcels located within the city limits, in furtherance of the objective of neighborhood stabilization to restore blighted buildings and forestall future blight, the City Council of the City of Garden City is hereby authorized: To convey or authorize the conveyance of the following parcels of real property it has acquired pursuant to its right of refusal under MCL 211.78(M), and to do so in accordance with existing contract with HP Snap, executed on or about June 13, 2022, copies of which are available through the Clerk for the City of Garden City, 6000 Middlebelt Road, Garden City, Michigan 48135, during regular business hours: 35-012-01-1675-001 – 2061 Inkster $15,638.36 SECTION II. SEVERABILITY. If any clause, sentence, section, paragraph or part of this Ordinance, or the application thereof to any person, firm, corporation, legal entity or circumstances, shall be for any reason adjudged by a court of competent jurisdiction to be unconstitutional or invalid, said judgment shall not affect, impair or invalid the remainder of this Ordinance. It is hereby declared to the legislative intent of this body that the Ordinance is severable, and that the Ordinance would have been adopted had such invalid or unconstitutional provision not have been included in this Ordinance. SECTION III. REPEAL. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed only to the extent necessary to give this Ordinance full force and effect. SECTION IV. SAVINGS CLAUSE. All rights and duties which have matured, penalties which have been incurred, proceedings which have begun and prosecution for violations of law occurring before the effective date of this Ordinance are not affected or abated by this Ordinance. SECTION V. PUBLICATION. The Clerk for the City of Garden City shall cause this Ordinance to be published in the manner required by law. SECTION VI. EFFECTIVE DATE. The program offers affordable dance instruction and a high-quality annual recital for students ranging from age 3 through adult, from beginner to advanced levels. Classes are offered in Ballet, Tap, Jazz, Lyrical, Contemporary, Musical Theater, and Pointe. Most classes meet once per week in 10-week sessions, and the program operates three sessions per year from September through June. This year, Dance Express is offering 52 classes with over 300 students enrolled. Each class selects unique costumes, and on average we order between 500 and 600 costumes each year. Dance Express has maintained a long-standing purchasing arrangement with Weissman Costumes for over 20 years. This is a sole-source purchase due to program-specific needs. Weissman is the only vendor that provides costume sizing that appropriately accommodates the range of body types in our student group. Costume selections also vary based on each class routine and theme, resulting in smaller quantities of many different styles. On average, we intend to order approximately 528 costumes in total, with no more than 14 of any single costume style. This purchase is a pass-through cost within the program. Families have already received order forms and have been paying for their costumes based on the catalog pricing provided by Weissman. Before finalizing the purchase, staff will reconcile all payments received with the estimate and order details from Weissman to ensure accuracy. Due to the short turnaround time needed to finalize costume selections and confirm sizes with teachers and parents, we will not have the final order total or estimate available before the agenda is published. Once the order is placed, the process of receiving the invoice, issuing payment through Accounts Payable, and submitting the check to the vendor all occurs within approximately one week. This expedited timeline is necessary to ensure costumes arrive in time for fittings and any needed adjustments before the recitals in June. This is why no estimate is attached, and we are requesting authorization to sign up to $30,000, with the understanding this is a pass-through cost to the families. Radcliff Room Rentals The Parks Commission recommends updating the Radcliff Center room rental rates to a three-tier pricing structure for weekday rentals: $30/hour, $40/hour, and $80/hour. Additional pricing adjustments would apply for non-residents, Saturday rentals, and after-hours use. This tiered model provides a consistent and easy-to-understand structure for both staff and residents while offering more rental options within similar price ranges. It also improves scheduling flexibility and availability throughout the facility. • Tier 1 ($30/hour) – Patio, Courtyard, and Game Room • Tier 2 ($40/hour) – Classrooms, Lounge, Heritage Room, Movie Theatre, and Card Room • Tier 3 ($80/hour) – Gymnasium, E-Sports Room, and Spaceport The Computer Lab has been removed from the rental list since it is no longer available in the building. Two new parking lot rental options are also recommended. The first is a Parking Lot Rental (per square foot, per month) intended for utility companies needing temporary staging space while working in Garden City or Westland. The second is a South Parking Lot Rental for single-event use, responding to requests for outdoor craft fairs, flea markets, and similar activities. Memberships Several adjustments and additions are recommended for Fitness Room memberships. With the recent Wayne County APRA Grant, the former Senior Fitness Room has been expanded into a full fitness space for all ages, now featuring free weights, a Smith machine, and additional equipment in a larger space. As a result, the department has seen growing interest from adults and teens wishing to use the facility. Adult drop-in passes have already been successful, and the proposed membership structure formalizes resident and non- resident membership options for both adults and teens. The Parks & Recreation Commission believes these rates are fair and reasonable based on the facilities offered and that they remain comparable to pricing at other recreation centers in the surrounding area.
