CITY OF GARDEN CITY ZONING BOARD OF APPEALS August 28 , 2019 The Zoning Board of Appeals of the City of Garden City met in Regular Meeting on Wednesday, August 28, 2019, at 6:30 p.m., in the Council Chambers of the Civic Center, 6000 Middlebelt, Garden City, Michigan. ROLL CALL Present were Chairperson May, Commissioners Price, Mason, King & Richard Absent were Commissioners Suuppi and Hamilton. Also present were McKenna Consultant Mario Ortega, Councilmember Mark Jacobs and Minutes Clerk Bryan Smith. PUBLIC HEARINGS The Public Hearing for 29317 Ford Road was called to order at 6:31 by Chairperson May. The Chair announced it was time for the Public Hearing on the Zoning Ordinance Variance request for 2 9317 Ford Road.  There were no public comments The Chair announced the Public Hearing for 29317 Ford Road closed at 6: 32 p.m. The Public Hearing for 29600 Ford Road was called to order at 6:32 by Chairperson May. The Chair announced it was time for the Public Hearing on the Zoning Ordinance Variance requests for 29 600 Ford Road.  Troy Gagnier, Garden City, stated his property faces the proposed building location and was concerned about height of building.  Jeff Sullivan, Garden City, inquired about planed retention pond at site. Hearing no further comments the Chair closed the Public Hearing for 29600 Ford Road closed at 6:35 p.m. The Chair announced it was time for public comments for items not on the agenda. AYES: Unanimous ABSENT: Suuppi, Hamilton NEW BUSINESS 29317 Ford Road, Zoning Ordinance variance re: Sections 154.606(G)(7)(e). DISCUSSION: Mckenna Consultant Ortega gave overview of variance request for applicant at 29317 Ford Road and provided information regarding applicant’s request to table action on item until after September 9, 2019 City Council meeting.  19-08-004 Moved by King; Supported by Mason RESOLVED: To table action regarding the Zoning Ordinance Variance for 29317 Ford Rd. based upon applicant’s request. AYES: Unanimous ABSENT: Suuppi, Hamilton 29600 Ford Road, Zoning Ordinance variance re: Sections 154.354(A)(1) – Setback requirements, 154.354(B) – Off-street parking and loading, Section 154.355(B) – Building height, and Section 154.355(F) – Building materials. DISCUSSION: Mckenna Consultant Ortega gave overview of the variances requested by applicant for 29600 Ford Road and presented a summary of findings listed in the Mckenna letter dated August 22, 2019 recommending that the ZBA grant the variances as requested. Board as a whole discussed how applicant has been willing to revise plans to comply with city recommendations. Applicant answered commissioner questions relating to site design, building design and building material.  19-08-005 Moved by King; Supported by Price RESOLVED: To approve variance request for 29600 Ford Road as it relates to Section 154.354(A)(1) – Setback requirements to allow applicant to have a 338 foot front yard setback from Ford Road and to have a 59 foot front yard setback from Beechwood Avenue based upon the findings of fact identified in Mckenna letter dated August 22, 2019. AYES: Unanimous ABSENT: Suuppi, Hamilton  19-08-007 Moved by Richard; Supported by Price RESOLVED: To approve variance request for 29600 Ford Road as it relates to Section 154.355(B) – Building height to allow applicant to construct building to a maximum height of 38 feet 5 inches based upon the findings of fact identified in Mckenna letter dated August 22, 2019. AYES: Unanimous ABSENT: Suuppi, Hamilton  19-08-008 Moved by Price; Supported by King RESOLVED: To approve variance request for 29600 Ford Road as it relates to Section 154.355(F) – Building materials to allow applicant to use painted concrete panels and the use of thin brick on vertical columns instead of the 75% brick stated in city zoning code based upon the findings of fact identified in Mckenna letter dated August 22, 2019. AYES: Unanimous ABSENT: Suuppi, Hamilton OTHER BUSINESS Mckenna Consultant Ortega gave the board information regarding possible September ZBA meeting to address additional variance request for the property at 29600 Ford Road .
