CITY OF GARDEN CITY ZONING BOARD OF APPEALS REGULAR MEETING February 28, 2024 The Zoning Board of Appeals of the City of Garden City met in a Regular Meeting on Wednesday, February 28, 2024, at 6:30 p.m., in the Council Chambers of the Civic Center, 6000 Middlebelt, Garden City, Michigan. ROLL CALL Present were Chairperson May, Commissioners Price, Richard , Hickman, and Bullock. Members absent: Commissioner s Martin, and Smith. Also present were McKenna Consultant Ortega , City Clerk Smith, and Deputy Clerk Goscicki APPROVAL OF AGENDA  24-02-001 Moved by Hickman ; Supported by Richard RESOLVED: To approve the meeting agenda as presented. AYES: Hickman, Richard, Bullock, Price, May ABSENT: Martin, Smith Motion Carries 5-0 Chairperson May announced it was time for public comment on non-agenda items.  There were no public comments APPROVAL OF MINUTES  24-02-002 Moved by Price; Supported by Hickman RESOLVED: To approve minutes of the regular meeting of June 28, 2023 as presented. AYES: Price, Hickman, Bullock, Richard, May ABSENT: Martin, Smith Motion Carries 5-0 BUSINESS ITEMS  30254 Ford Road – Consideration of a request for variance to allow a 22 foot setback from north property line for an 18 foot variance from the required 40 foot setback. A. Section 154.137(c). This section requires that minor auto repair buildings shall maintain a minimum setback of 40 feet on all sides that are adjacent t property that is zoned or used for residential purposes. The applicant is proposing a minor auto repair building to be 22 feet from the north property line which is adjacent to a residentially zoned and used lot. The applicant is requesting an 18-foot variance from this dimensional setback. DISCUSSION: McKenna Consultant Ortega gave overview of review letter dated February 20, 2024. Prior to board discussion, applicant provided Ortega and Board Members with a 2nd option City of Garden City ZBA Meeting Minutes February 28, 2024 Page 2 of 2 of the proposed site plan, which would meet all necessary variances and gave information on proposed use of building. The board as a whole began discussions of both options presented. Discussions included information relating to concerns with location of proposed building, turning radius of traffic both inbound and outbound, location of existing overhead wires and use of proposed building relating to practical difficulties. Chairperson May opened the public hearing for 30254 Ford Road at 6:47 pm  Brian Shockley, addressed concerns over proposed sites, including questioning the need to move the proposed building closer to the north property line, concerns about new lighting and additional noise volume and concerns regarding past and potential future issues regarding trash clean up and snow removal hazards.  Crystal Palko, addressed concerns regarding the lack of current property owner not disclosing site information. Hearing no further public comment the public hearing was closed at 7:08 pm  24-02-003 Moved by Richard ; Supported by Price RESOLVED: Motion to approve a 10 foot variance from the required 40 foot setback from the north property line creating a setback of 30 feet from the north property line based upon the finding of fact in McKenna letter dated February 20, 2024 and based upon the approval addressing practical difficulty providing substantial justice to both the applicant and adjacent properties. AYES: Richard, Price, Bullock, Hickman, May ABSENT: Martin, Smith Motion carries 5-0 OTHER BUSINESS  There was no other business.
