ZONING BOARD OF APPEALS
REGULAR MEETING
June 26 , 2024
The Zoning Board of Appeals of the City of Garden City met in a Regular Meeting on
Wednesday, June 26, 2024, at 6:30 p.m., in the Council Chambers of the Civic Center,
6000 Middlebelt, Garden City, Michigan.

Present were Chairperson May, Commissioners Richard , Smith, Martin and Bullock
Members absent: Co mmission Hickman and Price
Also present were McKenna Consultant Ortega and Deputy Clerk Goscicki

APPROVAL OF MINUTES

RESOLVED: To approve the previous meeting minutes of April 22, 2024.

BUSINESS ITEMS
Northeast Corner of Arcola Ave and Cherry Hill Road – Consideration of a request for
one dimensional variances for the construction of a new apartment building on the
vacant lot.
A. A. Minimum Required Front Yard Setback. In the R-3 district, Appendix A, Schedule of
Regulations requires a 30 ft front yard setback from the west property line. The applicant
is proposing the building to be 15 ft from the lot line and is requesting a 15-foot variance
from the minimum required setback. Minimum Required Side Yard Setback. In the R-3
district, Appendix A, Schedule of Regulations requires a 20 ft side yard setback along the
east property line. The applicant is proposing the building to be 17 ft from the lot line and
is requesting a 3-foot variance from the minimum required setback.
DISCUSSION: McKenna Consultant Ortega gave overview of review letter dated June 17, 2024.
Prior to board discussion, Ortega addressed the variance standards for approval such as practical
difficulty, substantial justice and extraordinary circumstances. The board began discussions of
the information provided. Discussions were brief and included praise of the updates provided by
the architect for their changes made, to fit City standards.
Chairperson May opened the public hearing for Arcola/Cherry Hill at 6:47 pm
Beverly McCarson, questioned the location of the dumpster, entrance to the proposed
parking lot, and questioned why such an entrance would need to be located on Arcola,
rather than Cherry Hill.
Hearing no further public comment the public hearing was closed at 6:50 pm
24-06-012 Moved by Richard ; Supported by Martin
RESOLVED: Motion to approve or and grant Parcel #35-015-01-0051-001, located at the
northeast corner of Cherry Hill Road and Arcola Avenue, a fifteen (15) foot variance
from the City of Garden City Zoning Ordinance, Appendix A, Schedule of Regulations,
R-3 Multiple Family Residential minimum side yard setback standard. This variance is
granted upon the Zoning Board of Appeals having made the determination that the site
meets approval criteria of Section 154.453(A). Specifically, we find the following criteria
have been met: Practical Difficulty and Substantial Justice.
