NOTICE OF PUBLIC MEETING BY THE ZONING BOARD OF APPEALS
Pursuant to the provisions of General Municipal Law and Chapter 200 of the Code of the Incorporated
Village of Garden City, New York notice is hereby given that the Board of Appeals of said Village will
meet in the Village Hall at 351 Stewart Avenue, Garden City, New York on Tuesday, August 4, 2026 , at
6:30 p.m., to take action on the following matters:
1. APPLICATION & APPEAL OF MICHAEL & KATHRYN RAFFERTY, in accordance
with the provisions of Village Code Section 200-16.A(9).d, and a variance from section 200-
45.H, for permission to apply for permits, to construct and maintain an 8’ x 8’ in-ground spa w/
automatic cover, enclosed by 6’ fence, in the rear yard of the premises known as 64 SECOND
STREET (Map of Garden City Central, Block 28, Lot 5, R-20 district), the granting or which
would:
A. cause a permanently installed pool or spa to be as close as 5.0’ to a primary structure
where 15.0’ is required.

2. APPEAL OF TAYLOR MIZZI & NICHOLAS HOGG for a variance of the provisions of
Village Code Sections 200-52 to allow the issue of a permit for the installation of approximately
14.0’ of a 4.0’ high wood driveway gate in the side yard of the dwelling, known as 93 BROOK
STREET (Map of Garden City East, Block 112, Lots 10, R-12 district) the granting of which
would:
A. reduce the required 60.0’ accessory structure setback, to not less than 56.7’.

3. APPEAL OF JOHN & ALLISON RUSTEN in accordance with the procedures of Village code
section § 200-85 for a one year time extension of previously granted (June 17, 2025) variances of
of sections 200-31 & 200-46 of the Village Code, to allow for the issue of a permit to erect an
153 sq. ft. one story addition in the Clinch Avenue front, and 146 sq. ft. & 114 sq. ft. one story
additions in the Jackson Street front, of the corner premises known as 84 CLINCH AVENUE

A. reduce the 30.0’ front setback from Clinch Avenue, to not less than 25.90’ ~

A. reduce the rear yard setback of 25.0’ to not less than 17.84’.

6. APPEAL OF KEITH & COURTNEY BUTLER for a variance from provisions of Sections

City Central, Block 90, Lot 6, R-12 district), the granting of which would:
A. exceed the allowable building area of 20.0 % or 2,408 sq. ft., by 363 sq. ft. (2,771 sq.
ft. or 23.05 %), of which 1.53% is unenclosed or open space. ~
B. reduced the 35.0’ aggregate of side yards to not less than 34.75’, where 35.0’ is
