MINUTES OF MEETING OF DECEMBER 15, 2020
The Finance Committee meeting was called to order remotely by Council President Elizabeth
Kazinskas at 8:00 a.m. Finance Committee Members Councillors Ronald Cormier and James
Walsh were also present via Zoom.
President Kazinskas announced that pursuant to Governor Baker’s March 12, 2020 Order
Suspending Certain Provisions of the Open Meeting Law, G.L. c. 30A, §20, and the Governor’s
March 15, 2020 Order imposing strict limitation on the number of people that may gather in
one place, this meeting of the Finance Committee will be conducted via remote participation
on Zoom. The audio recording, transcript, or other comprehensive record of proceedings will
be posted on the City’s website as soon as possible after the meeting and the meeting is being
broadcast live on Gardner’s YouTube Channel.
Also participating remotely were Mayor Michael Nicholson; Human Resources Director Debra
Pond; Community Development and Planning Director Trevor Beauregard; and, City Clerk
Alan Agnelli.
1-1 Reading and Approval of Minutes of Prior Meetings.
On a motion by Councillor Ronald Cormier and seconded by Councillor James Walsh,
on call of the roll, it was voted to waive reading and to accept the Finance Committee
Meeting Minutes of December 1, 2020 and December 10, as printed.
2-2 An Order Appropriating $120,000.00 from Free Cash to Capital Project – Willow/Main
Street Property Account (Ref: 6-3 and 6-4).
Mayor Nicholson informed the Committee that the properties have been cited in the
City’s Urban Renewal Plan for over ten years and are part of the cleanup of the entrance
to Downtown and for improvements to the intersection of Main and Willow Streets.
He added that DHCD has added $80,000.00 toward the purchases.
Community Development and Planning Director Trevor Beauregard informed the
Committee that there is a conceptual layout of the roadway, including widening and
making the intersection safer.
Councillor Walsh questioned whether the purchase price for the properties makes
sense.
Mayor Nicholson stated that the price “is as low as we are going to get,” adding that the
price was negotiated from the original asking price of $400,000.00. On questioning, he
said that the current landlord will have to evict the tenants of the properties being
purchased by the City.
Mr. Beauregard informed the Committee that the assessed values of the parcels are
$218,500.00. The vacant Kraskouskas parcel is assessed at $42,700.00.
Councillor Walsh questioned whether the State has provided documentation
committing the $80,000.00 share.

Mr. Beauregard stated that the City is looking into repurposing the funding with the
Agency and is waiting for a response, adding that the City will obtain a written
commitment.
Councillor Cormier questioned whether a deadline to purchase the parcels has been
imposed.
The Mayor said that the Realtor requested a Letter of Intent just before the New Year,
as there are other potential buyers.
Councillor Cormier suggested that the Committee’s recommendation come with a
proviso that there is a written commitment from the State.
Councillor Walsh concurred, adding that if the City does not receive the written
commitment by Monday, then the Measure should be referred back to the Finance
Committee.
On a motion by Councillor Ronald Cormier and seconded by Councillor James Walsh,
on call of the roll, it was voted to recommend to the City Council that the following
Order ought to pass, provided that the City Council receives written documentation of
the Department of Housing and Community Development’s $80,000.00 commitment
for the acquisition of the property. If a commitment is not received by then, then the
Committee will recommend that the Measure be referred back to the Finance
Committee for further study and report:
AN ORDER APPROPRIATING FROM FREE CASH TO CAPITAL PROJECT -
WILLOW/MAIN STREET PROPERTY ACCOUNT.
ORDER: That there be and is hereby appropriated the sum of One Hundred Twenty
Thousand Dollars and No Cents ($120,000.00) from Free Cash to Capital Project –
Willow/Main Street Property Account.
3-1 A Measure Confirming the Mayor’s Appointment of Anthony Webb to the position of
Police Officer, Permanent.
Mayor Nicholson informed the Committee that Officer Webb has been serving in a
temporary capacity and has almost completed his ride-along field training.
Councillor Walsh questioned the complement of officers in the Department.
The Mayor said that there are two officers “in the queue” and ready to go to the Police
Academy and that there is one more open position.
On a motion by Councillor Ronald Cormier and seconded by Councillor James Walsh,
on call of the roll, it was voted to recommend that the City Council confirm the Mayor’s
Appointment of Anthony Webb to the position of Police Officer, Permanent.

3-2 City Clerk Search Process.
Prior to discussion, the Mayor removed himself from the meeting since he has
knowledge of the applicants for the position.
Opening the discussion, the Council President outlined the search process and the three
interviews that were conducted on the 10th. She said that it is the Committee’s intent
to place its recommendation on the December 21 City Council Calendar for the election
of the Clerk, effective January 5, 2021.
Councillor Walsh stated that he found the three applicants to be thoughtful,
informative, and with varying degrees of work experience and municipal experience.
Only one, he said, has experience in a City and with City Council responsibilities – Titi
Siriphan. Of Ms. Siriphan, Councillor Walsh said that he found her prior work in
Gardner to be thorough, that she was responsive and thoughtful, and is a known
quantity. She is knowledgeable about Gardner and City Council needs, having worked
for the Gardner and Leominster City Councils, he added.
Councillor Walsh moved to recommend Titi Siriphan to the Council for election to a
term of 3 years, effective January 5, 2021, the three year term required by the Charter.
Councillor Ronald Cormier seconded the motion.
On the motion, Councillor Cormier stated that he reviewed all 60 applications and
found that Ms. Siriphan “rose to the top on experience level.” He cited her experience
working with the Leominster and Gardner City Councils which made her a clear choice
for the position.
Council President Kazinskas concurred, noting her invaluable experience working for
the Cities of Gardner and Leominster Councils.
On the motion, on call of the roll, it was voted recommend Titi Siriphan to the City
Council for election to a term of three years, effective January 5, 2021, the three year
term required by the Charter.
4-1 An Ordinance to Amend the Code of the City of Gardner Chapter 632 “Watershed Lands”
to Change Section 3 –Sale of City Owned Watershed Land.
Mayor Nicholson informed the Committee that Attorney Deborah Phillips will
continue working to obtain the Title Search Report for the City Council and that she
advised that the Report should cure any Ordinance that was overlooked.
Councillor Walsh commented that this Ordinance amendment is only one of a number
of items on the subject that needs to be considered as a whole. He said that the original
items have been changed and that it is unclear which items that the City Council should
be considering and the order in which they need to be acted on. He cited new
documents that have been presented and that all should be treated together.

On a motion by Councillor James Walsh and seconded by Councillor Ronald Cormier,
on call of the roll, it was voted to place the following Ordinance on the December 21,
2020 City Council Calendar, at which time the sequence of order be clarified:
AN ORDINANCE TO AMEND THE CODE OF THE CITY OF GARDNER, CHAPTER
632 THEREOF, ENTITLED “WATERSHED LANDS” TO CHANGE SECTION 3: SALE
OF CITY-OWNED WATERSHED LAND
Be it ordained by the City Council of the City of Gardner as follows:
Section 1. Section 3 of Chapter 632, Watershed land, of the Code of the City of Gardner
is hereby amended by repealing Section 3: Sale of City-owned watershed land and
inserting in place thereof, the following:
§ 632-3: Sale of City-owned watershed land.
a. The City shall not hereinafter be authorized to sell or otherwise dispose of in
fee any City-owned watershed lands.
b. The following parcels shall be exempt from this section of the Code of the City
of Gardner, as recorded in the City of Gardner Assessor’s Map:
a. R27-2-7
b. R27-2-8B
c. R32-23-8A
Section 2. This ordinance shall become effective upon passage and publication as
required by law.
6-1 A Measure Authorizing a Grant of Easement to Massachusetts Electric Company for
property located at 288 Pearl Street (New Elementary School parcel).
The Mayor informed the Committee that the Easement is necessary in order to supply
electrical service to the new Elementary School.
Councillor Walsh questioned whether the Easement and location plan has been
reviewed by the City Engineer.
The Mayor responded, saying that the City Engineer approved the Plan.
On a motion by Councillor James Walsh and seconded by Councillor Ronald Cormier,
on call of the roll, it was voted to recommend that the City Council Authorize a Grant
of Easement to Massachusetts Electric Company for property located at 288 Pearl Street
(New Elementary School parcel).
6-2 A Measure Accepting a Parcel of Land at 32 Parker Street from the GRA.
Community Development and Planning Director Trevor Beauregard informed the
Committee that the parcel of land, the former Gardner Cinema/Orpheum Theater, is
included in the City’s Urban Renewal Plan. In 2015, he stated, the GRA and City
obtained the property through Eminent Domain and then constructed a “pocket park”
on the parcel and a new parking lot with 28 spaces. He said that the GRA is asking the

City to accept the park and the lot for use by its residents, adding that the GRA is
retaining the parking lot behind the other two adjacent buildings along Parker Street.
Councillor Walsh questioned whether the project was completed through a City and
GRA partnership.
Mr. Beauregard said that the Park’s design and construction was paid for through the
Community Development Block Grant Program.
On a motion by Councillor Ronald Cormier and seconded by Councillor James Walsh,
on call of the roll, it was voted to recommend that the City Council adopt the following
Measure:
AUTHORIZING THE CITY OF GARDNER TO PURCHASE 32 PARKER STREET
FROM THE GARDNER REDEVELOPMENT AUTHORITY
VOTE: To authorize the Mayor to buy 32 Parker Street, further identified on the City
of Gardner Assessor’s Map as MAP ID: M22-5-24, for $1, from the Gardner
Redevelopment Authority and upon such terms as the Mayor shall consider
proper in accordance with this Vote.
6-3 A Measure Authorizing the City to Purchase Property on Willow Street.
On a motion by Councillor James Walsh and seconded by Councillor Ronald Cormier,
on call of the roll, it was voted to recommend that the City Council adopt the following
Measure, provided that the City Council receives written documentation of the
Department of Housing and Community Development’s $80,000.00 commitment for
the acquisition of the property. If a commitment is not received by then, then the
Committee will recommend that the Measure be referred back to the Finance
Committee for further study and report.
AUTHORIZING THE CITY OF GARDNER TO
PURCHASE PROPERTY ON WILLOW STREET
VOTE: To authorize the Mayor to purchase a certain parcel on Willow Street further
identified on the City of Gardner Assessor’s Map as MAP ID: M22-15-47 for
$65,000, from the Jonkit Realty Trust and upon such terms as the Mayor shall
consider proper in accordance with this Vote.
6-4 A Measure Authorizing the City to Purchase 205-213 Main Street.
On a motion by Councillor James Walsh and seconded by Councillor Ronald Cormier,
on call of the roll, it was voted to recommend that the City Council adopt the following
Measure, provided that the City Council receives written documentation of the
Department of Housing and Community Development’s $80,000.00 commitment for
the acquisition of the property. If a commitment is not received by then, then the

the H. J. and J. L. Rome Realty Trust and upon such terms as the Mayor shall
consider proper in accordance with this Vote.

• Presently City of Leominster Assistant City Clerk and formerly City of Gardner
Assistant City Clerk.
What are the most important qualities to have as a City Clerk?
• Knowledge of elections, vitals, City Council duties. Prepared to respond to questions.
Currently works with Leominster City Council – rules and regulations, meeting
postings.
Tell us about how you organize, plan and prioritize your work.
• Utilize spreadsheets and post-it notes to establish priorities, create “priority workflow.”
Utilized training received in Gardner to apply in Leominster.
The City Clerk will need to know, in a short period of time, how the City of Gardner government
works. It is critical for you to understand how the rules of procedures work during government
meetings. Are you familiar with Roberts Rules of Order? If not, how would achieve familiarity
with the Roberts Rules of Order?
• Not very familiar with Robert’s Rules of Order – has been the City Clerk’s role.
Leominster uses Mason’s. Will have to read to be up-to-date.
Please tell us about your experience with elections, vital records, census and working for a
legislative body.
• 8½ years of experience in the City of Gardner and 2½ with the City of Leominster
handling City Council, elections, annual census, and vitals.
• Leominster maintains 15 polling precincts and 29,000 voters. Assists the City Clerk and
staff with various elements of elections preparation.

example of a particularly difficult situation and how you resolved it?
• Works with the public every day. Allow customers to vent their frustration and inform
them as to how to resolve the problem. Cited Birth Amendments as procedurally
cumbersome.
What is your experience with large scale meeting preparation, scheduling facilitating and
follow-up such as minutes and other forms of correspondence?
• City Council management is her focus in her current position. Procedures encompass
packet preparation, dissemination, post-meeting actions – Mayoral and Comptroller
approvals; hearings; and legal publications, etc. All correspondence copies to Assistant
Clerk by the City Clerk. Council meeting minutes are prepared by the Assistant Clerk.
What is your level of experience with Microsoft Office products and software systems such as
MUNIS, VIP and VRIS?
• Uses MS Office software products and Adobe. Families with VIPS for Vitals and VRIS
for Elections and Registrations. Participates in Zoom managed conferences with State.
What is your experience with supervising and mentoring employees? Please discuss how you
establish working relationships with staff and how you would address performance issues should
they arise?
• As Assistant City Clerk in Gardner, she trained two office clerks in vitals management
systems. Used the skills she obtained in Gardner to improve workflow and processing;
integrating new software in Leominster. Assisted with training election officers.
The work of the City Council is public record. As such, how will you keep yourself and the City
Council organized and in compliance with applicable laws as you facilitate meetings with all
councilors and subcommittees.
• Verify work and consult with Council President and City Solicitor with questions.
Have you ever been responsible for developing and managing a budget? If yes, how large of a
budget?
• No budget preparation but works with the City Clerk to develop budgets. Would seek
assistance in developing budgets.
Are you available to attend night meetings?
• Flexible in ability to attend all meetings as she does now in Leominster.
(a) If offered this job, how long will it take you to make a decision? (b) What type of notice
would you provide your current employer?
• Would require one day to decide, but most likely would accept as she would like to
better her position.
• At least 2 weeks notice to current employer and could then start right away.
• If “elected” on December 21, could give notice right away.

• Presently Town Clerk for 3 years and served as Assistant Town Clerk for 4 years in
Lancaster. There would be a “transitional curve” to City Clerk – challenging but not
difficult.
What are the most important qualities to have as a City Clerk?
• Dealing with the public on a personal basis.
• Treating residents as you want to be treated- respond quickly.
Tell us about how you organize, plan and prioritize your work.
• Prioritize work by scheduled due dates/deadlines. Prove your work. The job is cyclical.
The City Clerk will need to know, in a short period of time, how the City of Gardner government
works. It is critical for you to understand how the rules of procedures work during government
meetings. Are you familiar with Roberts Rules of Order? If not, how would achieve familiarity
with the Roberts Rules of Order?
• Uses Roberts Rules in Lancaster – Town Meetings and Select Board meetings. Used
Roberts as Recording Secretary for the Fitchburg School Committee meetings.
Please tell us about your experience with elections, vital records, census and working for a
legislative body.
• Administered 4 elections this year and 3 before that. Comfortable with relationship
with Secretary of State’s office. Town has 2 precincts.
• Works with Vitals; Street Listing (Census); and legislative functions (Select Board).
Please tell us about your experience working with the public. Can you provide us with an
example of a particularly difficult situation and how you resolved it?
• COVID has made it difficult to work directly with the public, but services were still
provided. The Annual Town Meeting was held outdoor at the Bolton Fairgrounds.
What is your experience with large scale meeting preparation, scheduling facilitating and
follow-up such as minutes and other forms of correspondence?
• Annual Town Meeting was an enormous planning event with coordination among
many Town department. Records the meeting and certifies all votes.

• First experience for training was for the new Assistant Town Clerk. Make certain that
you Assistant is prepared.
• Bets response is to listen to your employee.
The work of the City Council is public record. As such, how will you keep yourself and the City
Council organized and in compliance with applicable laws as you facilitate meetings with all
councilors and subcommittees.
• Make sure that Agendas and Minutes are complete and prepared on-time.
• Serves as Lancaster’s Public Records Officer – seeks to respond in fewer than 10 days.
• Seek methods to improve organization such as automation.
Have you ever been responsible for developing and managing a budget? If yes, how large of a
budget?
• Her office is provided with a budget and she has to work with it.
• In addition to Clerk and Elections, she also manages the Dog Officer budget.

• Has flexibility and schedule is “wide open.”

• Half hour to decide with 2 weeks notice to current employer. Her Assistant is ready to
become the Town Clerk. January 5th assumption of duties would work.

Program Calendar tasks.

• Rutland Assistant Town Clerk from 2018 to present. Assumed Town Clerk’s role in
absence of the Town Clerk.
What are the most important qualities to have as a City Clerk?
• Organizational skills, efficiency, excellent customer service.
• Maintaining documents and record-keeping.
Tell us about how you organize, plan and prioritize your work.
• Maintaining calendars for work, post-its.
• Takes pride in her organizational skills.
The City Clerk will need to know, in a short period of time, how the City of Gardner government
works. It is critical for you to understand how the rules of procedures work during government
meetings. Are you familiar with Roberts Rules of Order? If not, how would achieve familiarity
with the Roberts Rules of Order?
• Not familiar with Roberts Rules. The Town uses “Town Meeting Time.”
Please tell us about your experience with elections, vital records, census and working for a
legislative body.
• Managed her first State Election this year. Rutland has 3 precincts.
• Over 4,000 voters voted by mail or in-person.
• Familiar with annual census, vitals software, and VRIS.
Please tell us about your experience working with the public. Can you provide us with an
example of a particularly difficult situation and how you resolved it?
• Dealing with a customer without oil while at Peterson Oil – listened to the customer’s
concern and assisted -- received a thank you card for her efforts.

• Transcribed minutes of the Board of Assessors meetings and currently for Town
Meetings.
What is your level of experience with Microsoft Office products and software systems such as
MUNIS, VIP and VRIS?
• Currently uses VRIS and VIP (Gateway). Not familiar with Munis – Town uses
Vadar/Vision.

What is your experience with supervising and mentoring employees? Please discuss how you
establish working relationships with staff and how you would address performance issues should
they arise?
• As Customer Service Manager at the oil company, she supervised 8 customer service
representatives.
• Need to be a good teacher.
The work of the City Council is public record. As such, how will you keep yourself and the City
Council organized and in compliance with applicable laws as you facilitate meetings with all
councilors and subcommittees.
• Follow-up, update calendar, and maintain information.
Have you ever been responsible for developing and managing a budget? If yes, how large of a
budget?
• Works with the Town Clerk to manage the Budget. Has not prepared a budget on her
own.
Are you available to attend night meetings?
• Very flexible with the Council’s schedule. Very self-motivated.

• Will be able to start at the beginning of the year if decision is made on December 21.
