MINUTES City of Geneva Council Meeting June 13, 2022 6:00 p.m. Mr. Butera opened the Council Meeting at 6:00 p.m. Roll Call – Mario Butera, Robert Rosebrugh, Jeffrey Griffiths, James Baehr, John Barbo, and William Baker Absent – Philip Cordova Pledge of Allegiance to the Flag was said and prayer was offered by Pastor Harry Pishcura, New Life Assembly of God. Mr. Baehr noted a correction to the Safety Committee Meeting. Motion was made by James Baehr to approve the minutes of the May 23, 2022, seconded by Jeffrey Griffiths. Roll call, 6 yeas, (Butera, Rosebrugh, Griffiths, Baehr, Barbo, Baker). Motion duly passed. Presentation – Income Tax Department, Nadine Mooneyham Presenting House Bill 519 is moving through the Legislature. HB 519 has two components. The first is the issue of late filing. Currently the late filing fee is $25.00 per month. HB 519 would change that to a flat $25.00 once the filer has filed. The second is that anyone who has gotten an extension not receive letters. Neither is alarming. The last two years, the filing deadline has been extended. Looking at a more normal year, 2019, income tax received at this time of year, the City has received $491,550. In a normal year the City received $442,706. In May the City collected $201,877, in a normal year collections $201,634. The City is holding its own. Citizens: Mr. Butera read a Proclamation for “Connor Boland Day.” Items for Consideration of Council: Resolution No. 3538. A Resolution Authorizing the Acceptance of the Cost Proposal of Mannik Smith Group and Authorizing the City Manager to Enter Into an Agreement for Construction Services Associated with the U.S. Route 20 (West Main Street) Improvements, and declaring an emergency. Motion by William Baker, seconded by James Baehr that the rule of law requiring certain Resolutions be read at three separate meetings be waived and suspended and Resolution No. 3538 be placed on the final roll for passage. Roll call, 6 yeas (Butera, Rosebrugh, Griffiths, Baehr, Baker, Barbo). Motion by Jeffrey Griffiths to declare and pass Resolution No. 3538 as an emergency measure, seconded by William Baker. Roll call, 6 yeas (Butera, Rosebrugh, Griffiths, Baehr, Baker, Barbo). Roll call on passage, 6 yeas (Butera, Rosebrugh, Griffiths, Baehr, Baker, Barbo). Resolution No. 3538 duly passed. Resolution No. 3539. A Resolution Authorizing the City Manager to Execute a Contractual Agreement with the International Association of Fire Fighters Local #3695, and declaring an emergency. 1 Expanded language for non-discrimination is in the City’s Employee Handbook. The City follows the policy. Mr. Butera noted that on page 22, Section 1, Article 31, Section 1 HAS should be HAS. Motion by James Baehr, seconded by William Baker that the rule of law requiring certain Resolutions be read at three separate meetings be waived and suspended and Resolution No. 3539 be placed on the final roll for passage. City Manager Report: The City’s Consultant has submitted information on the Zoning Update, Phase II, and is proposing to meet with the Planning Commission. Following that, it will come to Council. Mr. Griffiths would encourage a stand-alone meeting with the Planning Commission based on the previous meeting held. Mr. Dunlap will be retiring. The City is narrowing down candidates to fill this position. There are three remaining union contracts. The language is being cleaned up. The City is very close to finalizing these contracts. The City has extended three conditional offers to Police Department candidates. Two from the civil service list. The third candidate is a lateral transfer. A fourth candidate is a part-time dispatcher. The City has extended three offers of employment to Fire Department candidates, two conditional and one full offer have been accepted. Candidates are going through the prescreening process. Equipment for streaming council meetings has risen in cost. Additionally supply is a problem. The City is also looking at determining pre and post meeting preparation. Infrastructure update: West Main continues to move. Acting on the Construction Management Contract helps the City move forward. The WPCLF loan application has been submitted to DEFA. South Beach Street and Nearing Circle should be complete. Mr. Butera commented that the contractor did a fantastic job. State Route 84 Waterline Replacement The waterline is fulling complete. They are testing the line. Begin connecting the line. Memorial Field Track is paved. Tennis courts have been fixed. Pavement has to set for 30 days before they can finish it. Striping areas of the parking lot is scheduled. Mr. Varckette will be out the week of June 20th. Back in the office on June 29th. 2 The City is following-up on storm water issues. Mr. Pasky, Superintendent Bittner, Mr. Varckette and another member of the Street Department reviewed maps and the site. Allow of water flows in this area as it has since the glacier. The City plans to have Mr. Pasky back at a later date. Unfinished Business: Mr. Baehr inquired regarding property maintenance. Mr. Pasqualone has prepare five complaints. There will be one additional complaint. The parties will be cited into court. The Court will issue a summons to appear. Pre-trials will be scheduled. It was noted that a for sale sign is up at the old bar on SR 534 and SR 84. Signage at Little People’s Park regarding the park closing at dusk was discussed. New Business: Mr. Rosebrugh inquired about the overgrown grass and bushes at the Key Bank Building. Payment of Bills – None. Committee Reports – None. Streets Committee met. Roads identified for Chip, Fog and Seal were discussed as well as sidewalks. Citizen: Mr. David Thomas, County Auditor The second half of property tax bills will be going out. If residents have any concerns, Mr. Thomas’ office would happy to answer any questions. John Barbo made a motion to adjourn.
