MINUTES City of Geneva Council Meeting February 10, 2025 6:00 p.m. President John Barbo opened the Council meeting at 6:00 p.m. Roll Call: John Barbo, Robert Rosebrugh, James Baehr, William Baker, John Travis Absent: Jeffrey Griffiths, Dana Schenk Pledge of Allegiance to the flag was said and prayer was offered by Phyllis Dunlap, Clerk of Council. Motion was made by James Baehr to approve the minutes of the January 27, 2025, regular council meeting, seconded by William Baker. Roll call, 4 yeas, (Rosebrugh, Baehr, Baker, Travis), 1 abstention (Barbo). Motion duly passed. Presentations – Wastewater Department, Brandon Averill Presenting. Last year 354 million gallons flowed through the plant, 970 gallons per day. In 2023 403 million gallons flowed through the plant. There were no violations in 2024. There was one bypass event, a freak rain caused the creek to be higher. Superintendent Averill provided an update on equipment at the plant. Citizens: Jim Cowan 407 W. Main Street, Geneva Mr. Cowan previously came to council to voice his concerns regarding the air pollution caused by wood burner at 393 W. Main Street. Mr. Varckette and Noell Sivertsen have looked into it. It was discussed in the work session prior to the meeting. Mr. Pasqualone will be presenting for council’s review, legislation prohibiting outdoor wood burners which are meant for more space between dwellings. City Manager Report – None. Items for Consideration of Council Ordinance No. 3374 – Third Reading – An ordinance to Establish a Capital Projects Fund. Roll Call on passage, 5 yeas (Barbo, Rosebrugh, Baehr, Baker, Travis). Motion duly passed. Ordinance No. 3375 – Third Reading. An Ordinance Amending Chapter 881 of the Codified Ordinances of the City of Geneva to Add Section 881.013 (Allocation of Funds) of the Geneva Municipal Income Tax. 1 Roll call on passage, 5 yeas (Barbo, Rosebrugh, Baehr, Baker, Travis). Motion duly passed. Resolution No. 3620. A Resolution Authorizing the City Manager to Enter into an Agreement with the Board of County Commissioners for Non-Emergency and Emergency Shared Services, and declaring an emergency. Motion by James Baehr, seconded by John Travis that the rule of law requiring certain resolutions be read at three separate meetings be waived and suspended and Resolution No. 3620 be placed on final roll for passage. Roll call, 5 yeas, (Barbo, Rosebrugh, Baker, Baehr, Travis). Motion by James Baehr to declare and pass Resolution No. 3620 as an emergency measure, seconded by William Baker. Roll call, 5 yeas (Barbo, Rosebrugh, Baker, Baehr, Travis). Roll call on passage, 5 yeas (Barbo, Rosebrugh, Baehr, Baker, Travis). Resolution No. 3620 duly passed. 6:14 p.m. Councilman Jeffrey Griffiths arrived. Unfinished Business: It was noted that legislation may not solve Mr. Cowan’s problem. Mr. Cowan may want to call the Health Department. A Finance Committee meeting is scheduled for February 17, 2025 at 6:00 p.m. New Business: Conditional Use Permit – 140 North Broadway, Geneva, Ohio to use the back of the building to operate a bungee studio. Ms. Sivertsen noted that the conditional use approval is for the use only, any site work will come back to the Planning Commission. Payment of Bills – None. Committee Reports – None. Citizen – None. James Baehr made a motion to adjourn. John Travis seconded the motion.
