All members were present. Councilmember Tingle-Sames led the pledge after a moment of silence. 1. Minutes A motion was made by Councilmember Lusby and seconded by Councilmember Tackett to approve the minutes from the City Council meeting, November 14, 2022. The motion was unanimously approved. 2. Acknowledgement Receipt of Check Register Mayor Prather requested that council acknowledge receipt of the check register. Council members all acknowledged such receipt. 3. GMWSS First reading of amendment to Water and Sewer rate ordinance. A motion to postpone first reading of ordinance until the first City Council meeting in January 2023 was made by Councilmember Tingle-Sames and seconded by Councilmember Hambrick. A roll call vote resulted in a tie. Mayor Prather opted not to break the tie, causing the motion to fail. Councilmembers Hambrick, Lusby Mitchell, Tingle-Sames and Stone voting yes. 4. WHEREAS, the City of Georgetown owns property known as the Lanes Run Business Park, which is held for sale to persons and corporations for economic development purposes; and WHEREAS, Bastian Solutions, LLC of Indianapolis IN has offered to purchase 4.1 (+/-) acres of land at the Park (hereinafter “the Property”) for $25,000 per acre; and WHEREAS, the City is authorized to transfer land to the company for economic development purposes, pursuant to KRS 82.083(3)(b); and WHEREAS, the City, by and through its Georgetown Business Park Authority, has negotiated a contract for sale of the Property with the business; and WHEREAS, on October 31, 2022, the Georgetown Business Park Authority approved the sale of land to the company; NOW THEREFORE, be it resolved by the City of Georgetown that: The Council does hereby authorize the sale of 4.1 (+/-) acres of Property in the Lanes Run Business Park to Bastian Solutions, LLC of Indianapolis IN, and the Mayor is hereby authorized to execute the Real Estate Sales and Purchase Contract negotiated by the Georgetown Business Park Authority. As a result, we the undersigned council members, are requesting that your office audit the GMWSS. Our concerns revolve around a request from the GMWSS for a proposed 61% rate increase for the citizens of Scott County. The City has become aware of discrepancies of approximately $53 Million in the finances of the GMWSS due to errors in two projects pursuant to contracts awarded by the GMWSS board. The Board authorized a rate review study in 2019 to determine the need for bonding. It has now become clear that the company awarded that contract was grossly negligent in its calculations resulting in a $38 Million error. In addition, in 2020, the Board awarded a contract for the construction of a wastewater sewage plant. It has now become clear that there were gross engineering errors made, resulting in the need to remove part of what had already been constructed and to re-engineer the construction project, resulting in an error of $15 Million. These errors are the basis of the GMWSS Board requesting the extraordinary rate increase. As a result, the Georgetown City Council by resolution passed on December 12, 2022, has requested and authorized an audit of GMWSS by your office. (A copy of the resolution is attached thereto.) NOW, THEREFORE, BE IT RESOLVED, that the Georgetown City Council hereby immediately requests and authorizes an audit of the finances, policies, and procedures of the GMWSS by the State Auditor of Public Accounts. _______________________________ Tracie Hoffman, Georgetown City Clerk Resolution passed on December 12, 2022, by a vote of __ to ___ of the Georgetown City Council.  CITY OF GEORGETOWN RESOLUTION 2022-___ A RESOLUTION OF THE CITY OF GEORGETOWN SEEKING A SPECIAL EXAMINATION BY THE STATE AUDITOR OF SPECIFIC GMWSS ACTIVITIES WHEREAS, the City of Georgetown owns the Georgetown Municipal Water and Sewer Service (“GMWSS”); and, WHEREAS, over the last five years, GMWSS has endeavored to construct a project to expand sewer service capacity at Wastewater Treatment Plant #1 (“WWTP1”) through the procurement of professional design, construction, financing, and utility rate consultants (together, “the Project”); and, WHEREAS, in the course of the Project, the professional consultants hired by GMWSS made two significant errors, causing the project to incur significant delays and cost increases and rendering the water and sewer rate increases enacted by the GMWSS Board of Commissioners and the City Council in 2019 inadequate to support the intended long- term financing for the Project; and, WHEREAS, since the initial rate ordinance was enacted in 2019, the cost of goods and services has risen substantially, causing increases in Project change order costs, other planned capital construction costs, and general utility operating costs; and, WHEREAS, since the initial rate ordinance was enacted in 2019, interest rates have increased, significantly increasing the cost for GMWSS to borrow money; and, WHEREAS, these combined occurrences have caused the need for GMWSS and the City to enact additional, substantial rate increases in water and sewer rates over the course of the next five to six years; and, WHEREAS, these proposed substantial increases have raised concerns among the City Council members and customers of GMWSS, causing the same to desire an independent opinion regarding what happened, why, and how such issues can be avoided in the future; and, WHEREAS, the City Council believes a special examination by the State Auditor into the facts and circumstances of the Project will expressly serve this purpose and provide the transparency and accountability sought by all concerned; and, WHEREAS, the City Council does hereby officially and respectfully request such a Special Examination by the State Auditor; NOW THEREFORE, be it resolved by the City of Georgetown that: The Georgetown City Council does hereby request a Special Examination by the State Auditor into the facts and circumstances of the procurement, design, construction, financing, and utility rate calculations for the Wastewater Treatment Plant #1 Project.
