AGENDA ITEM RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION Pursuant to: A) A.R.S. §38-431.03(A)(3), (4) & (7) for discussion and consultation with designated Town representative and legal advice with Town Attorney on potential lease of real property at the regional park at Chandler Heights Basin; B) A.R.S. §38-431.03(A)(3)(4)&(7) for discussion and consultation for legal advice with the Town Attorney and designated Town representative regarding proposed second amendment of Development Agreement between Town of Gilbert and MD Heritage LLC for the sale of Town owned land in the Heritage District located at the southeast corner of Vaughn Avenue and Ash Street; C) A.R.S. §38-431.03(A)(3)(4)&(7) for discussion and consultation for legal advice with the Town Attorney and designated Town representative regarding proposed second amendment of Development Agreement between Town of Gilbert and MD Heritage LLC for the sale of Town owned land in the Heritage District located on Gilbert Road, south of Vaughn Avenue, parcel No. 302-16-053; and D) A.R.S. §38-431.03(A)(3)&(4) for discussion for legal advice with Town Attorney regarding contemplated or recently initiated litigation with: a) Clearwater Pipelines, LLC and All American Home Plumbing, LLC for damage to water transmission line on April 1, 2015 on Higley Road north of Warner Road; b) Lizette Moreno and Angela Moreno, for vehicle damage to Neely Lift Station on August 11, 2015; c) Vi Thi Tuong Nguyen and/or Ajax Hoang for vehicle damage to traffic control cabinet at northeast corner of Williams Field Road and Parkcrest Street; d) Daniel Sopena for vehicle damage to signal pole at north east corner of Val Vista Drive and Queen Creek Road. If you permit your child to participate in the Council Meeting, a recording will be made.
