MINUTES OF THE GILBERT TOWN COUNCIL IN REGULAR MEETING OF THURSDAY, JANUARY 11, 2018 AT 6:30 PM, MUNICIPAL CENTER, COUNCIL CHAMBERS, 50 E CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Jenn Daniels, Vice Mayor Victor Petersen, Councilmembers Scott Anderson, Eddie Cook, Brigette Peterson, Jordan Ray and Jared Taylor COUNCIL ABSENT: None STAFF PRESENT: Town Manager Patrick Banger, Town Clerk Lisa Maxwell, Town Attorney Christopher Payne AGENDA ITEM CALL TO ORDER Mayor Jenn Daniels called the meeting to order at 6:32 p.m. PRESENTATION OF STUDENT CITIZEN OF THE MONTH AWARD Mayor Jenn Daniels and the Council presented Student Citizen of the Month Awards for December to: Boston Langston, Rory Houlihan, Zachary R. Pyeatt, Addisyn Skousen, Teighlor Eda, Ryan Lake, Brody Stojanowski, Christopher Szczepkowski, Anabelle Reynoso, Desean Middlebrook, Jennifer Jacobs, Emie Platt, Johnny Nguyen, Lyla Coons, Gabrielle Cardwell, Ethan Wright, Maximiliano Godoy, Lyla Moeller, Thomas Mangum, Deion Trotter, Reese Hursh, Brandon Dixon, Tegan Grenko, Emma Brown, Braeden Cookemboo, Carrigan Partridge, Sadie Stevens, Gabriel Hill, Sydney Braaten, Nicholas Magel, and Naia Stewart. INVOCATION AND PLEDGE OF ALLEGIANCE Councilmember Jordan Ray introduced the scouts in attendance who led the Pledge of Allegiance and introduced themselves. Bishop Sean Housley of Maplewood Ward gave the invocation. ROLL CALL Town Clerk Lisa Maxwell called roll and declared a quorum present. 1 PRESENTATIONS; PROCLAMATIONS 1. RECOGNITION - Recognition of Victor Petersen for his service as Vice Mayor for the Town of Gilbert. Mayor Jenn Daniels recognized Councilmember Victor Petersen for his service as Vice Mayor and presented him with a gift. 2. COUNCIL ADMINISTRATION - consider Nomination and Selection of Vice-Mayor. A MOTION was made by Vice Mayor Victor Petersen, seconded by Councilmember Jordan Ray, to nominate Councilmember Brigette Peterson to serve as Vice Mayor. Mayor Jenn Daniels called for a vote on the nomination of Councilmember Brigette Peterson as Vice Mayor. Motion carried 7-0. Mayor Jenn Daniels announced Councilmember Brigette Peterson would serve as Vice Mayor in 2018. 3. PROCLAMATION - Proclamation declaring the month of January as Speak Up, Stand Up, Save a Life Month. Councilmember Jared Taylor read a proclamation declaring January as Speak Up, Stand Up, Save a Life Month; and presented the proclamation to members of the local Speak Up, Stand Up, Save a Life Committee consisting of mothers from Gilbert and Chandler. 4. PRESENTATION - The Gilbert Parks and Recreation Foundation Board of Directors would like to present the Town of Gilbert with a check for $20,000 for the Parks and Recreation Department. Councilmember Eddie Cook and members of the Parks and Recreation Foundation Board of Directors and the Parks and Recreation Advisory Board presented a check for $20,000 to the Town of Gilbert Parks and Recreation Department. COMMUNICATIONS FROM CITIZENS Amy Lozano, Gilbert resident, said she has spoken with several members of Town staff about the Town’s noise ordinance. She referenced the exemption that allows golf courses to operate mowers at any time. She would like that exemption removed and reasonable hours be set for when they can use equipment. Joe Geusic, Gilbert resident, spoke about the recession and overcoming challenges. He stated the Town’s revenue and population have improved, but requested that the Council continues to push for educational funding and to not leave schools behind. 2 CONSENT CALENDAR A MOTION was made by Vice Mayor Brigette Peterson, seconded by Councilmember Jared Taylor, to approve Consent Items 6, 7, 8, 9, 10, and 11; and remove Consent Items 5 from the agenda. Motion carried 7-0. 5. INTERGOVERNMENTAL AGREEMENT – consider approval of Intergovernmental Agreement No. 2018-3001-0169 with Maricopa County, Housing Authority of Maricopa County, City of Phoenix, Phoenix Housing Authority, City of Mesa, Mesa Public Housing Authority, City of Glendale, Glendale Housing Authority, City of Tempe, Tempe Public Housing Authority, City of Chandler, Chandler Public Housing Authority, City of Scottsdale, Scottsdale Public Housing Authority, City of Peoria, City of Surprise, and City of Avondale with the Town of Gilbert's portion to be $3,750 for Assessment of Fair Housing Collaboration and authorize the Mayor to execute the required documents. This item was removed from the agenda. 6. CONTRACT – consider approval of: a) Professional Services Contract No. 2018-2106-0147 with Corona Environmental Consulting, LLC in an amount not to exceed $280,170 for the Water Quality Master Plan, Project No. WA136, and authorize the Mayor to execute the required documents; and b) a Contingency Transfer from the Water Fund in the amount of $310,170. This item was approved with the Consent Calendar vote. 7. CONTRACT – consider approval of Design Services (A/E) Contract No. 2018-2106-0021 with Hazen and Sawyer in an amount not to exceed $903,327 for the Candlewood Lift Station and Force Main, Project No. WW070, and authorize the Mayor to execute the required documents. This item was approved with the Consent Calendar vote. 8. CONTRACT/PURCHASE – consider approval of a) expenditures under Contract No. 2017-1105-0612 with CenturyLink in an amount not to exceed $74,500 for the upgrade of the 911 consoles and associated equipment in the Police Dispatch Center and authorize the Mayor to execute the required documents; b) the purchase of Recorder Enhancements for VoIP recording, computer and monitor in an amount not to exceed $14,000 from Goserco, Inc.; and c) a Contingency Transfer from the General Contingency Fund in the amount of $88,500. This item was approved with the Consent Calendar vote. 3 9. CONTRACT – consider approval of the guaranteed maximum price (GMP) Change Order No.1 to Construction Services Contract No. 2018-2106-0139 with PCL Construction, Inc. increasing the contract amount by $545,340 for the Reservoir, Pump Station and Well Conversion project, Project No. WA062, and authorize the Mayor to execute the required documents. This item was approved with the Consent Calendar vote. 10.CONTRACT – consider approval of Task Order No. 84 to Job Order Contract (JOC) Contract No. 2014-4106-0291 with Talis Corporation in an amount not to exceed $292,000 for reconstruction of deficient sidewalk, ramps, driveways and pedestrian push buttons at the intersection of Greenfield and Warner Roads and on Gilbert Road from Pecos Road to Warner Road, Project No. ST155, and authorize the Mayor to execute the required documents. This item was approved with the Consent Calendar vote. 11.MINUTES – consider approval of the minutes of Regular Meeting of December 7, 2017. This item was approved with the Consent Calendar vote. PUBLIC HEARING Mayor Jenn Daniels opened the public hearing for items 12 and 13. No one wished to speak and Mayor Jenn Daniels closed the public hearing. A MOTION was made by Councilmember Victor Petersen, seconded by Councilmember Scott Anderson, to approve public hearing items 12 and 13. Motion carried 7-0. 12.LIQUOR LICENSE – conduct hearing and consider approval of a Series 3 In-State Microbrewery Liquor License for Desert Monks Brewing Company located at 1094 South Gilbert Road, Suite 101. This item was approved with the Public Hearing Vote. 13.CODE OF GILBERT - conduct hearing and consider adoption of an Ordinance amending the Code of Gilbert, Arizona by amending Chapter 2 Administration, Article IV Procurement, Division 1 Generally, Section 336 Solicitation Transparency Policy; and Division 2 Purchasing, Section 356 Definitions and Section 360 Formal Purchase Procedures. This item was approved with the Public Hearing Vote. Ordinance No. 2639 was adopted. 14.CODE OF GILBERT -conduct hearing and consider adoption of an Ordinance amending the Code of Gilbert, Arizona by amending Chapter 15 Special Events, Article II Permits, Section 15-40 Prohibited Special Event Conduct; Revocation; Chapter 42 Offenses and Abatement of Public Nuisances, Article III Offenses Involving Public Peace and Order, Division 1 Generally, Sections 42-61 Noise, 42-62 Special Noise Sources, 42-63 4 Construction of Buildings and Projects, 42-64 Unnecessary Noise, 42-65 Penalties, and Chapter 62 Traffic and Vehicles, Article V Motorized Play Vehicles and Motorized Skateboards, Section 62-145 General Operating Restrictions Related to Noise Control Regulations. This Item was moved to the regular meeting of February 15, 2018. ADMINISTRATIVE ITEMS 15.BOARDS, COMMISSIONS, AND COMMITTEES - reports from Council Liaisons for the: a) Subcommittee on Board and Commission Application Screening, Interview, and Selection b) Other Council Subcommittees c) Ad Hoc d) Regional Meetings e) Industrial Development Authority f) Mayor’s Youth Advisory Committee g) Parks and Recreation Board h) Planning Commission i) Redevelopment Commission j) Town of Gilbert, AZ Public Facilities MPC k) Town of Gilbert, AZ Water Resources MPC l) Town of Gilbert, AZ Self-Insured Trust Fund for Health Benefits m) Utility Board Councilmember Jared Taylor spoke of the Public Facilities Municipal Property Corporation’s recent meeting and the many forthcoming projects that are planned. Councilmember Eddie Cook reported that at the recent Parks and Recreation Board meeting the attendance for the Riparian after Dark event in 2017 was calculated by the hour, versus day, due to the large attendance numbers. He reported that thousands of visitors attended each hour, acknowledging that the lights were done by only four staff members. He thanked the staff for a job well done. POLICY ITEMS None. FUTURE MEETINGS Requested Agenda Items and Projected Meeting Dates: March - May 2018 - Adjust Mayor and Council compensation to levels existing prior to the change to the Town Code that provided for automatic increases to the compensation for the Mayor and Council. Manager Patrick Banger shared some statistics on the Gilbert 311 App that was launched a year ago, stating there were 2,998 requests open and 2,903 requests closed. He thanked staff for embracing the program and for their efforts to implement it. Report from the COUNCIL on current events. None. Report from the MAYOR on current events. Mayor Jenn Daniels gave information on SkyBridge, a company which is building at Phoenix-Gateway Airport. The Town is a part-owner of the airport.
