MINUTES OF THE GILBERT TOWN COUNCIL, IN REGULAR MEETING OF THURSDAY, APRIL
04, 2019 AT 6:30 PM, MUNICIPAL CENTER, COUNCIL CHAMBERS, 50 E CIVIC CENTER

CALL TO ORDER
Mayor Daniels called the meeting to order at 6:31 p.m.
INVOCATION AND PLEDGE OF ALLEGIANCE
Councilmember Anderson introduced a student in attendance who led the Pledge of
Allegiance. Council Ray gave the invocation.
ROLL CALL
Town Clerk Maxwell called roll and declared a quorum present.
PRESENTATIONS; PROCLAMATIONS
1. PROCLAMATION - Proclamations that were issued and not presented during a Council
Meeting are as followed; Proclamation declaring April 2019 as Fair Housing Month.
2. PROCLAMATION - Proclamation declaring the week of April 8-12, 2019 as Week of the
Young Child.
Councilmember Yentes read a proclamation declaring the week of April 8-12, 2019 as
Week of the Young Child, and presented the proclamation to Marjeneh Gilpatrick, Vice
Chair of First Things First - Southeast Maricopa Region.
2A. PROCLAMATION - Proclamation declaring April 14-20, 2019 as Gilbert Water
Professionals Appreciation Week.
Vice Mayor Cook read a proclamation declaring April 14-20, 2019 as Gilbert Water
Professionals Appreciation Week, and presented the proclamation to Jessica Marlow,

Public Works Director; Joe Smith, Water Distribution Superintendent; Heather Turrentine,
Water Resources Coordinator; Patti Jordan, Waste Water Recharge and Reuse; Kurtis
McDavid, Water Production Superintendent; Eric Braun, Water Resources Manager; Mark
Horn, Wastewater Manager; and Andrew Jackson, Water Manager.
COMMUNICATIONS FROM CITIZENS
Paul Rodriguez, Gilbert resident, thanked the Mayor, Vice Mayor and the Councilmembers
helping to resolve the homeless cat situation in Gilbert. He said it is important to leave
kittens alone as there is a chance the mother cat is nearby and she will tend to the kittens.
CONSENT CALENDAR
A MOTION was made by Vice Mayor Cook, seconded by Councilmember Peterson, to
approve Consent Items 3, 4, 5, and 6. Motion carried 7-0.
3. CONTRACT – consider approval of renewal of Contract No. 319000560 with A-O
Painting in an amount not to exceed $250,000 for painting needs at remote well sites and
both water treatment plants and authorize the Mayor to execute the required documents.
This item was approved with the Consent Calendar vote.
4. HUMAN RESOURCES – consider approval Medical and Dental Plan premium rates, and
suggested plan design changes for Fiscal Year 2019-2020.
This item was approved with the Consent Calendar vote.
5. FINAL PLAT PR0310 - consider approval of the final plat for the Minor Subdivision –
Gilbert Regional Park located at the southwest corner of Higley and Queen Creek Roads.
This item was approved with the Consent Calendar vote.
6. MINUTES – consider approval of the minutes of Regular meetings of March 7, 2019
and March 21, 2019 and the Special meeting of March 21, 2019.
This item was approved with the Consent Calendar vote.
PUBLIC HEARING
Mayor Jenn Daniels opened the public hearing for Items 7 and 8. No one wished to speak
and Mayor Jenn Daniels closed the public hearing.
A MOTION was made by Vice Mayor Cook, seconded by Councilmember Ray, to approve
public hearing Items 7 and 8. Motion carried 7-0.
7. CODE OF GILBERT - conduct hearing and consider adoption of an Ordinance amending

the Code of Gilbert, Arizona, by amending Chapter 42 Offenses and Abatement of Public
Nuisances, Article II Offenses Involving Property Rights, Section 42-33 Discharge of Water
into Town Drainage Basins related to discharge of pool water into Town-owned drainage
basins.
This item was approved with the Public Hearing Vote. Ordinance No. 2706 was adopted.
8. CODE OF GILBERT - conduct hearing and consider adoption of an Ordinance amending
the Code of Gilbert, Arizona, by amending Chapter 10 Buildings and Construction
Regulations, Article IX Utility Extensions and Connections, Division 3 Sewer, Section 10-
312 Connection Required, Expenses, Abatement of Cesspools related to septic systems.
This item was approved with the Public Hearing Vote. Ordinance No. 2707 was adopted.

Report from the COUNCIL on current events.
Councilmember Peterson reported the Global Village Festival will be this Saturday at the
Municipal Center.
Vice Mayor Cook said the Winged Hope will be having their 5K this Saturday at Freestone
Park.
Councilmember Peterson noted AZCEND will be having their annual Walk in the Park at
Discover Park this Saturday.

Mayor Daniels reminded everyone that Kindness Week will start on April 22, 2019.

The invocation may be offered by a person of any religion, faith, belief or non-belief, as
well as Councilmembers. A list of volunteers is maintained by the Town Clerk and
interested persons should contact the Clerk for further information.
Mayor invites all scouts present to the front of the Council Chambers.

COMMUNICATIONS FROM CITIZENS
At this time, members of the public may comment on matters within the jurisdiction of
the Town but not on the agenda. The Council’s response is limited to responding to
criticism, asking staff to review a matter commented upon, or asking that a matter be
put on a future agenda.
CONSENT CALENDAR
All items listed below are considered consent calendar items and may be approved by a
single motion unless removed at the request of Council for further discussion/action.
Other items on the agenda may be added to the consent calendar and approved under a
single motion.

PUBLIC HEARING
Items will be heard at one Public Hearing; at which time anyone wishing to comment on
a Public Hearing Item may do so. Comments will be heard from those in support of or in
opposition to an item. Hearings are noticed for 6:30 p.m.
In order to comment on a Public Hearing Item, you must fill out a public comment form,
indicating the Item Number on which you wish to be heard. Once the hearing is closed,
there will be no further public comment unless requested by a member of the Council.
After the Public Hearing, the Council may act on all items not requiring additional staff,
public, or Councilmember comment with a single vote.

NOTICE TO PARENTS: Parents and legal guardians have the right to consent before the
Town of Gilbert makes a video or voice recording of a minor child. A.R.S. 1-602.A.9. Gilbert
Council Meetings are recorded and maybe viewed on Channel 11 and the Gilbert website.
If you permit your child to participate in the Council Meeting, a recording will be made. If
your child is seated in the audience your child may be recorded, but you may request that
your child be seated in a designated area to avoid recording. Please submit your request to
the Town Clerk.
