MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF TUESDAY FEBRUARY 02, 2021 AT 5:00 PM, MUNICIPAL CENTER I, ROOM 300 50 E CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Vice Mayor Yung Koprowski, Councilmembers Scott Anderson, Laurin Hendrix, Scott September, Kathy Tilque, and Aimee Yentes COUNCIL ABSENT: None STAFF PRESENT: Town Manager Patrick Banger, Town Clerk Chaveli Herrera, Deputy Clerk Judy Martinez, Town Attorney Christopher Payne AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 5:03 p.m. RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Councilmember Anderson, seconded by Vice Mayor Koprowski, to recess the Special Meeting and reconvene in Executive Session pursuant to: a) A.R.S. §§ 38-431.03(A)(3), (4) discussion or consultation for legal advice with the Town Attorney and to consider the Town’s position and instruct the Town Attorney concerning settlement of a contract dispute with Sierra Signs; and b) A.R.S. §§ 38-431.03(A)(3),(4) legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the Amended and Restated Cooley Center Development Agreement and a development agreement with Fred’s Place, LLC and Italow, LLC for land located near the northeast corner of Williams Field and Recker Roads; and c) A.R.S. §§ 38-431.03(A)(3),(4) legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the Epicenter Development Agreement for land located near Higley and Ray Roads. Motion carried 7-0. ADJOURN EXECUTIVE SESSION AND RECONVENE SPECIAL MEETING A MOTION was made by Councilmember September, seconded by Vice Mayor Koprowski, to adjourn the Executive Session and reconvene in Special Meeting.
