MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF TUESDAY MARCH 30, 2021 AT 5:30 PM, MUNICIPAL CENTER I, ROOM 300 50 E CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Vice Mayor Yung Koprowski, Councilmembers Scott Anderson, Laurin Hendrix, Scott September, Kathy Tilque, and Aimee Yentes COUNCIL ABSENT: None STAFF PRESENT: Town Manager Patrick Banger, Town Clerk Chaveli Herrera, Town Attorney Christopher Payne, Town Engineer David Fabiano, Assistant Town Manager Mary Goodman, Assistant Town Manager Leah Hubbard-Rhineheimer, Assistant Town Manager Dawn Prince, Deputy Town Attorney John Baird, Assistant Town Attorney Amanda Jenkins, Assistant Town Attorney Alena Jorquez, Public Works Director Jessica Marlow, Project Supervisor Ryan Blair, Senior Project Manager Casey Ambrose. AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 5:32 p.m. RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Vice Mayor Koprowski, seconded by Councilmember September, to recess the Special Meeting and reconvene in Executive Session pursuant to: a) Pursuant to A.R.S. §§ 38-431.03(A)(3), (4), discussion or consultation for legal advice and to consider the Town’s position and instruct the Town’s attorneys concerning disposition of the existing construction contract with Standard Construction Company, Inc. for Town Capital Improvement Project ST0960 Recker Road - Ray Road to SR 202 Improvements; and b) Pursuant to A.R.S. §§ 38-431.03(A)(3), (4), discussion or consultation for legal advice and to consider the Town’s position and instruct the Town’s attorneys concerning litigation entitled Candler v. Gilbert, et. al, U.S. District Court Case No. 20-01947. Motion carried 7-0. ADJOURN EXECUTIVE SESSION AND RECONVENE SPECIAL MEETING 1 A MOTION was made by Councilmember Anderson, seconded by Councilmember Yentes, to adjourn the Executive Session and reconvene in Special Meeting. Motion carried 7-0.
