MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF TUESDAY, OCTOBER 19, 2021 AT 5:30 PM, GILBERT PUBLIC SAFETY TRAINING FACILITY, ECHO ROOM 108, 6860 S. POWER ROAD, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Vice Mayor Yung Koprowski, Councilmembers Scott Anderson, Laurin Hendrix, Scott September, Kathy Tilque, and Aimee Yentes COUNCIL ABSENT: None STAFF PRESENT: Town Manager Patrick Banger, Town Clerk Chaveli Herrera, Town Attorney Christopher Payne AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 5:38 p.m. RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Councilmember September, seconded by Councilmember Anderson, to recess the Special Meeting and reconvene in Executive Session pursuant to: a) A.R.S. § 38-431.03(A)(3), discussion or consultation for legal advice with the Town Attorney regarding procedures relating to the Town Council Code of Ethics; and b) A.R.S. §§ 38-431.03(A)(3), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning special event permits and traffic control for holiday lighting events, including on Comstock Drive in Morrison Ranch; and c) A.R.S. §§ 38-431.03(A)(3), (4), and (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the development agreement for the sale of land near the southwest corner of Gilbert and Juniper Roads; and d) Pursuant to A.R.S. § 38-431.03(A)(3), (4), and (7), discussion or consultation for legal advice with the Town Attorney and representatives and to consider the Town’s position and instruct the Town Attorney concerning alternatives for the design and construction and associated acquisition impacts for WW1060 - Western Canal Sewer Rehabilitation Project (western canal between Lindsay and Gilbert Roads); and e) A.R.S. §§ 38-431.03(A)(3), (4), discussion or consultation for legal advice with the Town Attorney and to consider the Town’s position and instruct the Town Attorney regarding the One Arizona Distribution of Opioid Settlement Funds Agreement; and f) A.R.S. §§ 38-431.03(A)(3), (4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning settlement discussions for the acquisition of property along the 164th Street alignment, north of Pecos Road, for WA1180, Tankersley 1 Waterline Replacement Project. 1 Motion carried 7-0.
