MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF TUESDAY, FEBRUARY 22, 2022 AT 5:15 PM, GILBERT PUBLIC SAFETY TRAINING FACILITY, ECHO ROOM 108, 6860 SOUTH POWER ROAD, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Vice Mayor Aimee Yentes, Councilmembers Scott Anderson, Laurin Hendrix, Yung Koprowski, Scott September, and Kathy Tilque COUNCIL ABSENT: None STAFF PRESENT: Town Manager Patrick Banger, Town Clerk Chaveli Herrera, Town Attorney Christopher Payne AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 5:19 p.m. RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Councilmember September, seconded by Councilmember Tilque to recess Special Meeting and reconvene in Executive Session pursuant to: a) A.R.S. §§ 38-431.03(A)(3),(4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the purchase of land near the northwest corner of Pecos Road and 164th Street; and b) A.R.S. § 38-431.03(A)(3), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning authority, risk, and liability for issuance of permits and other approvals in areas with known ground fissures, including impacts on a project near San Tan Boulevard and 172nd Street; and c) A.R.S. §§ 38-431.03(A)(3), (4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning legal aspects of right-of-way acquisition process and concerning alternatives for the design and construction of WW1060 (Western Canal Sewer Rehabilitation Project between Lindsay and Gilbert Roads) and PR0620 (Western Powerline Trail near Greenfield Rd). Item C is no longer scheduled for discussion. d) A.R.S. §§ 38-431.03(A)(3), (4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the easement and land acquisition process for 1 the Tankersley Area 5 water line replacement project near the northwest corner of Greenfield and Ocotillo Roads. Motion carried 7-0. ADJOURN EXECUTIVE SESSION AND RECONVENE SPECIAL MEETING A MOTION was made by Councilmember Tilque, seconded by Councilmember September to adjourn Executive Session and reconvene Special Meeting.
