MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF TUESDAY, SEPTEMBER 6, 2022 AT 5:15 PM, GILBERT PUBLIC SAFETY TRAINING FACILITY, ECHO ROOM 108, 6860 SOUTH POWER ROAD, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Vice Mayor Aimee Yentes (attended virtually), Councilmembers Scott Anderson, Laurin Hendrix, Yung Koprowski, Scott September (attended virtually), and Kathy Tilque COUNCIL ABSENT: None. STAFF PRESENT: Town Manager Patrick Banger, Town Clerk Chaveli Herrera, and Town Attorney Christopher Payne AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 5:17 p.m. RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Councilmember Tilque, seconded by Anderson, to recess Special Meeting and reconvene in Executive Session pursuant to: a) A.R.S. §§ 38-431.03(A)(3),(4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the acquisition of property near 148th St and Ocotillo Rd. in support of the WA8010 well site project and shortage planning; and b) A.R.S. §§ 38-431.03(A)(3),(4), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the status of the broadband fiber to the premises request for proposals and recommendations, contract negotiations with third parties for access to Town-owned rights-of-way for the construction and maintenance of privately owned fiber and conduit facilities, and construction standards for fiber installations in order to minimize risk to the Town; and 1 c) A.R.S. §§ 38-431.03(A)(3),(4),(7) legal advice from the Town Attorney and discussion and consultation with designated Town representatives concerning negotiations for the lease of real property for the development of amenities on an approximately five-acre parcel at Gilbert Regional Park (solicitation no. 322000337); and Item was not discussed. d) A.R.S. §§ 38-431.03(A)(3), (4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning alternatives for the design and construction and associated acquisition impacts for PR0620 (Western Powerline Trail alignment near Greenfield Rd) and legal issues concerning current access and liability for this portion of the Western Powerline Trail; and e) A.R.S. §§ 38-431.03(A)(3), (4), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the Amended and Restated Cooley Center Development Agreement and a proposed rail ordinance. Motion carried 5-0, with Councilmembers Koprowski and Hendrix absent for the vote. ADJOURN EXECUTIVE SESSION AND RECONVENE SPECIAL MEETING A MOTION was made by Councilmember Tilque, seconded by Councilmember September, to adjourn Executive Session and reconvene Special Meeting. Motion carried 7-0.
