MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF MONDAY, DECEMBER 12, 2022 AT 5:30 PM, GILBERT PUBLIC SAFETY BUILDING – POLICE ADMINISTRATION TRAINING ROOM 6, 75 E CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Councilmembers Scott Anderson, Laurin Hendrix (attended virtually), Yung Koprowski, Scott September, and Kathy Tilque COUNCIL ABSENT: Vice Mayor Aimee Yentes STAFF PRESENT: Town Manager Patrick Banger, Assistant Town Manager Dawn Prince, Town Attorney Christopher Payne, Deputy Clerk Judy Martinez AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 5:54 p.m. ROLL CALL Deputy Clerk Martinez declared a quorum was present RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Councilmember Anderson, seconded by Councilmember Tilque, to recess the Special Meeting and reconvene in Executive Session pursuant to: a) A.R.S. §§ 38-431.03(A)(3),(4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning negotiations for a development and 1 disposition agreement for the sale and development of land near the northwest corner of Gilbert and Elliot Roads; b) A.R.S. §§ 38-431.03(A)(3),(4), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning negotiations for an intergovernmental agreement with Roosevelt Water Conservation District for the provision of water for domestic purposes; c) A.R.S. § 38-431.03(A)(3), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning scope of Town Council jurisdiction and authority for appeals of the Planning Commission design review and the Planning Commission’s design review approval of Woodspring Suites; and d) A.R.S. § 38-431.03(A)(3), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning legal aspects of both the Gilbert Land Development Code provisions regarding guest quarters, secondary dwelling units, and attachments and the issuance of building permit at 2711 E. Melrose St. e) A.R.S. §§ 38-431.03(A)(2),(3), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning negotiations for a development reimbursement agreement for the extension of Somerton Boulevard south of Williams Field Road and west of Recker Road. Motion carried 5-0; with Councilmember September absent during the vote. Councilmember September joined the meeting at 5:56 p.m. ADJOURN EXECUTIVE SESSION AND RECONVENE SPECIAL MEETING A MOTION was made by Councilmember Tilque, seconded by Councilmember Anderson, to adjourn Executive Session and reconvene Special Meeting.
