MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF MONDAY, FEBRUARY 5, 2024 AT 5:00 PM, MUNICIPAL BUILDING I, COMMUNITY ROOM 202, 50 E. CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Vice Mayor Scott Anderson, Councilmembers Chuck Bongiovanni, Bobbi Buchli, Yung Koprowski, Kathy Tilque, and Jim Torgeson COUNCIL ABSENT: None STAFF PRESENT: Town Manager Patrick Banger, Town Clerk Chaveli Herrera, and Town Attorney Christopher Payne AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 5:04 p.m. ROLL CALL Town Clerk Herrera declared a quorum present. RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Councilmember Koprowski, seconded by Councilmember Buchli, to recess the Special Meeting and reconvene in Executive Session pursuant to: a) A.R.S. §38-431.03(A)(3), legal advice from the Town Attorney and designees and discussion with Town representatives concerning an investigation into Town communications, political speech, and social media; 1 b) A.R.S. §38-431.03(A)(3), discussion or consultation for legal advice concerning litigation entitled Ryff et al v. Town of Gilbert (US District Court case) and Ryff v. Town of Gilbert (Maricopa County Superior Court case); c) A.R.S. §38-431.03(A)(3), legal advice from the Town Attorney and discussion and consultation with the Town Attorney and Town staff regarding notice of claims involving Gilbert Christian Schools; d) A.R.S. §38-431.03(A)(3), legal advice from the Town Attorney and discussion and consultation with the Town Attorney and Town staff regarding a request for annexation, minor general plan amendment, and rezoning for a parcel on the corner of Lindsay and Lexington Roads; and e) A.R.S. § 38-431.03(A)(3), (4), and (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning an agreement for contracted services at the Heritage Annex near Gilbert Road and Park Avenue. Motion carried 6-0, with Councilmember Torgeson arriving at after the vote at 5:05 p.m. ADJOURN EXECUTIVE SESSION AND RECONVENE SPECIAL MEETING A MOTION was made by Councilmember Buchli, seconded by Councilmember Koprowski, to adjourn Executive Session and reconvene in Special Meeting. Motion carried 7-0.
