MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF TUESDAY, FEBRUARY 20, 2024 AT 4:45 PM, MUNICIPAL BUILDING I, COMMUNITY ROOM 202, 50 E. CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Vice Mayor Scott Anderson, Councilmembers Chuck Bongiovanni, Bobbi Buchli, Yung Koprowski, Kathy Tilque (participated virtually), and Jim Torgeson COUNCIL ABSENT: None STAFF PRESENT: Town Manager Patrick Banger, Town Clerk Chaveli Herrera, and Town Attorney Christopher Payne AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 5:04 p.m. ROLL CALL Town Clerk Herrera declared a quorum present. RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Councilmember Buchli, seconded by Councilmember Koprowski, to recess the Special Meeting and reconvene in Executive Session pursuant to: a) A.R.S. §§ 38-431.03(A)(3), (4), (7) legal advice from the Town Attorney and discussion and consultation with Town representatives concerning condemnation litigation entitled Maricopa County v. DeSantis Family Trust, et. al, Maricopa County Case No. CV2020-005178; 1 b) A.R.S. §§ 38-431.03(A)(3), (4), (7) legal advice from the Town Attorney and discussion and consultation with Town representatives concerning condemnation litigation entitled Town of Gilbert v. Caballero Apartments LLLP, et al, Maricopa County Case Nos. CV2019-055449 and CV2019-055450 – consolidated; and c) A.R.S. §§ 38-431.03(A)(3), (4), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning legal aspects of a notice of claim filed by Richard and Tristan Kuehner. Motion carried 7-0. ADJOURN EXECUTIVE SESSION AND RECONVENE SPECIAL MEETING A MOTION was made by Councilmember Bongiovanni, seconded by Councilmember Buchli, to adjourn Executive Session and reconvene in Special Meeting. Motion carried 7-0.
