MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF MONDAY, AUGUST 5, 2024 AT 4:00 PM, MUNICIPAL BUILDING I, COMMUNITY ROOM 202, 50 E. CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Vice Mayor Scott Anderson, Councilmembers Chuck Bongiovanni, Bobbi Buchli, Yung Koprowski, Kathy Tilque and Jim Torgeson COUNCIL ABSENT: STAFF PRESENT: Town Manager Patrick Banger, Town Attorney Christopher Payne, Town Clerk Chaveli Herrera AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 4:03 p.m. ROLL CALL Town Clerk Herrera verified a quorum was present. RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Councilmember Torgeson, seconded by Councilmember Bongiovanni, to recess the Special Meeting and reconvene in Executive Session pursuant to: a) A.R.S. §§ 38-431.03(A)(3), (4), discussion or consultation for legal advice and to consider the Town’s position and instruct the Town’s attorneys concerning litigation involving Standard Construction Company, Inc.; 1 b) A.R.S. §§ 38-431.03(A)(3), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning legal aspects of access easement located on property near Page Avenue and Ash Street in the Heritage District and potential legal action; and c) A.R.S. § 38-431.03(A)(3), legal advice from the Town Attorney and discussion and consultation with the Town Attorney and Police Chief regarding legal aspects of investigations and communication protocols. Motion carried 7-0; Councilmember Koprowski was absent at time of vote, arriving at 4:04 p.m. ADJOURN EXECUTIVE SESSION AND RECONVENE SPECIAL MEETING A MOTION was made by Councilmember Buchli, seconded by Vice Mayor Anderson, to adjourn Executive Session and reconvene in Special Meeting.
