MINUTES OF THE GILBERT TOWN COUNCIL, IN SPECIAL MEETING OF MONDAY, NOVEMBER 18, 2024 AT 4:00 PM, MUNICIPAL BUILDING I, COMMUNITY ROOM 202, 50 E. CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Mayor Brigette Peterson, Vice Mayor Scott Anderson, Councilmembers Chuck Bongiovanni, Bobbi Buchli, Yung Koprowski, Kathy Tilque, and Jim Torgeson COUNCIL ABSENT: STAFF PRESENT: Town Manager Banger, Town Attorney Christopher Payne, Town Clerk Chaveli Herrera AGENDA ITEM CALL TO ORDER Mayor Peterson called the meeting to order at 4:00 p.m. ROLL CALL Town Clerk Herrera verified a quorum was present. RECESS SPECIAL MEETING AND RECONVENE IN EXECUTIVE SESSION A MOTION was made by Councilmember Buchli, seconded by Councilmember Bongiovanni, to recess the Special Meeting and reconvene in Executive Session pursuant to: a) A.R.S. §§ 38-431.03(A)(3), (4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the legal aspects of potential litigation involving an arbitration award relating to the purchase of land for Somerton Boulevard; b) A.R.S. §§ 38-431.03(A)(3), (4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the legal aspects of condemnation litigation entitled Maricopa County v. Butler, et. al, Maricopa County Superior Court Case No. CV2023-012613; 1 c) A.R.S. §§ 38-431.03(A)(3),(4), (7), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning the legal aspects of a development agreement related to the development of land near the northwest corner of Gilbert and Elliot Roads; and d) A.R.S. §§38-431.03(A)(3), legal advice from the Town Attorney and discussion and consultation with Town representatives concerning legal aspects of the membership of the redevelopment commission under Title 36, Chapter 12, Article 3. Motion carried 7-0. ADJOURN EXECUTIVE SESSION AND RECONVENE SPECIAL MEETING A MOTION was made by Councilmember Koprowski, seconded by Councilmember Tilque, to adjourn Executive Session and reconvene in Special Meeting. Motion carried 7-0.
