MINUTES OF THE GILBERT COUNCIL SUBCOMMITTEE ON LAND DEVELOPMENT CODE, DECEMBER 18, 2019, AT 7:00 A.M., ROOM 100, 90 EAST CIVIC CENTER DRIVE, GILBERT, ARIZONA COUNCIL PRESENT: Chair Brigette Peterson, Vice Mayor Eddie Cook and Councilmember Jordan Ray COUNCIL ABSENT: None STAFF PRESENT: Town Clerk Lisa Maxwell, Development Services Director Kyle Mieras, Planning Manager Eva Cutro, Principal Planner Lorbeer, Senior Planner Amy Temes, Assistant Town Attorney Nancy Davidson, Inspections Supervisor Lorrie DeOrio, and Development Services Engineer Tom Condit CALL TO ORDER Chair Peterson called the meeting to order at 7:01 a.m. AGENDA ITEMS 1. Approval of the minutes of the December 5, 2019 meeting. A MOTION was made by Vice Mayor Cook, seconded by Chair Peterson, to approve the minutes of the December 5, 2019 meeting. Motion carried 2-0 with Councilmember Ray not present for the vote. 2. Review of previous discussions. None. 3. Review and Discussion of Land Development Code Division 2, Article 2.9. None. 4. Review and Discussion of Land Development Code Glossary of Terms (Appendix K). Overflight Areas: Senior Planner Temes is going to change the definition to “ Land area that may be impacted by air traffic.” Add Overnight Accommodations: Senior Planner Temes is going to add this section with the definition “rooms used for sleeping.” The definition of overnight accommodations used to have a statement about needing a closet but that is not true anymore. Chair Peterson questioned when this item was being added. Senior Planner Temes replied is it needed when describing what is habitable. Parking, Required: Senior Planner Temes is going to change the definition to read “The minimum number of parking spaces required on-site to accommodate the land used as determined by the ratio provided in the parking table.” Residential Housing Types – Single Family Dwelling: Senior Planner Temes said she is thinking of removing Attached Single Family Dwelling since it is defined somewhere else. Chair Peterson asked if it would make more sense for all the housing types to be in one section. Senior Planner Temes will look at how the different definitions are grouped and put all housing types here. Residential Housing Types – Secondary Dwelling Unit: Senior Planner Temes is going to change Secondary Dwelling Unit to Accessory Dwelling Unit. Residential Housing Types - Single Family Dwelling Unit: Senior Planner Temes is going to change the definition form “1 building on 1 lot or parcel” to “a principal dwelling unit on a single lot.” Inspections Supervisor DeOrrio stated “primary” would be better than “principal.” Residential Housing Types – Studio Dwelling Unit: Senior Planner Temes is going to remove this item because it is not addressed anywhere in the code except maybe in the parking section. She will check and see. Setback: Senior Planner Temes will cross reference this section back to the section on yards so it will be consistent. She will clean the section up and bring back new language. Sign Related Terms: Senior Planner Temes will take the comments from the previous discussion on the section on signs and incorporate them here. Sign Types – Projecting Roof Sign: Senior Planner Temes is going to remove this as it is the same as Roof Signs. She will simplify this section. Sign Types – Restaurant: Senior Planner Temes will add this item and have it reference back to eating and drinking establishments. Councilmember Ray joined the meeting. Stacking spaces: Senior Planner Temes is going to remove “Each stacking space is 20 feet in length and does not include the space of the vehicle at the initial order point.” She will add a reference to the proper chapter. Street Types – Intersection: Vice Mayor Cook asked where intersections are defined. Senior Planner Temes replied in the engineering standards. Vice Mayor Cook asked about streets that do not necessary intersect but that make a 90 degree turn. Chair Peterson noted they may have two different street names. Senior Planner Temes will add a definition. Structure: Senior Planner Temes is working with Building Supervisor Larry Taylor on a definition. It is basically anything constructed or permanently attached to the ground or a foundation. Structure, Attached: Senior Planner Temes said this is not defined and it needs to be added. It is where two structures share a common wall or roof. It does not include landscaping walls but does include a garage or breezeway. There has been a lot of discussion in the past about what is attached and what is not attached. Garage connected by breezeway. Vice Mayor Cook asked if adding that a wall was load bearing would be sufficient. Planning Manager Cutro said changing to “Building, Attached” would be better than “Structure, Attached.” There was discussion about setbacks and erected structures where the impact is the same whether it is anchored or not. Senior Planner Temes will rework this section. Minor Land Divisions: This needs to match the Municipal Code and Senior Planner Temes will add a cross reference to the Code. Transient Merchant: This applies to food trucks, people selling goods at the farmer’s market, people selling goods on street corners on private. There was discussion about whether it should be included in the Land Development Code (LDC) with a reference to the Municipal Code. It was decided it is not needed in the LDC since it is not referenced anywhere in that document. Use, Incidental: Senior Planner Temes said she would like to change this to “Use, Accessory.” Principal Planner Lorbeer noted a LDC table uses the term “incidental.” Senior Planner Temes said the Planner’s Dictionary uses both interchangeably and accessory is the more modern term. She will research this further. Vehicle Related Terms – Abandoned Vehicle: Inspections Supervisor DeOrio explained an abandoned vehicle on a public right of way is jurisdiction of the Police Department. If the abandoned vehicle is on private property falls under Code Compliance jurisdiction. Vehicle Related Terms – Inoperable Vehicle: This is a vehicle that is incapable of being lawfully driven. Chair Peterson mentioned neighbors not liking where a car was being parked and they reported it. Senior Planner Temes stated if it was all in the Municipal Code she could just add a reference here. Vehicle Related Terms – Commercial Vehicle: Assistant Town Attorney Davidson said there have been issues with vehicles related to businesses. What about a company truck that is like a billboard for the company. More clarity is needed. Inspections Supervisor DeOrio said State law required commercial vehicles to be registered to a business. People do drive company vehicles between their home and work. They need to have a commercial vehicle in their driveway. Inspections Supervisor DeOrio said only one vehicle can be parked on a site. There was discussion about business vehicles and home businesses. Assistant Town Attorney Davidson said with new business models it would be better to leave the regulations in the Municipal Code so it can be changed more quickly if needed. Wall: Senior Planner Temes said there are a lot of discussions about walls and there needs to be a definition added here. Assistant Town Attorney Davidson said double walls needs to be addressed. Senior Planner Temes would also add definitions of perimeter and structure walls. Water Feature: Senior Planner Temes said this is not discussed much but it needs to be added. Development Services Director Mieras suggested working with Water Conservation on this section. Chair Peterson noted this could also be considered art. Senior Planner Temes will talk with Conservation Coordinator Heather Turrentine. The next meeting will be on January 7, 2020 at 7:00 a.m. in Municipal Center II, Room 236.
