MINUTES OF THE GILBERT COUNCIL SUBCOMMITTEE ON LAND DEVELOPMENT CODE,
JANUARY 21, 2020, AT 7:00 A.M., ROOM 100, 90 EAST CIVIC CENTER DRIVE, GILBERT,
ARIZONA
COUNCIL PRESENT: Chair Brigette Peterson and Councilmember Jordan Ray

CALL TO ORDER
Chair Peterson called the meeting to order at 7:04 a.m.
AGENDA ITEMS
1. Approval of the minutes of the January 7, 2020 meeting.
A MOTION was made by Councilmember Ray, seconded by Chair Peterson, to approve
the minutes of the January 7, 2020 meeting. Motion carried 2-0.
2. Review of previous discussions.
None.
3. Review and Discussion of Land Development Code Division 2, Article 2.9.
CIVIC AND INSTITUTIONAL:
Health Care Facilities – Health Care Facilities, Hospitals: Senior Planner Temes said she is
seeing mini hospitals and they are operating under the same use regulations as regular
hospitals. Parking for these facilities is based on the number of overnight beds. If this
building were ever to convert to another use there would not be enough parking for
that building. Currently these facilities are all located in Regional Commercial (RC).
Health Care Facilities – Health Care Facilities, Urgent Care Facilities: Senior Planner
Temes said she would like to change this from requiring a Use Permit (UP) in the
Heritage Village Center (HVC) to being permitted. She would also like to make this
permitted in the Gateway Village Center (GVC). She is going to like the UP requirement
in the Neighborhood Office (NO) category.
Health Care Facilities – Health Care Facilities, Medical Offices and Clinics: Senior Planner
Temes is going to change this to permitted in the HVC and GVC.
Health Care Facilities – Nursing Homes: Senior Planner Temes questioned why these
required a UP in the Shopping Center (SC) area. She is going to change this to permitted.
Transportation – Airfield, Private: Senior Planner Temes said the UP requirement will
remain in residential neighborhoods (SF-43 and SF-35).
Transportation - Heliport/Helipad: There was about a group of property owners who
would like to have a helipad on their property. They are surrounded by a subdivision.
Councilmember Ray said if they do not break noise ordinances and the neighbors sign
off they it should not be a problem. Senior Planner Temes will leave this with a UP
requirement. Assistant Town Attorney Davidson suggested stricter notice restrictions to
a larger than normal area.
Transportation – Park and Ride Lot: Senior Planner Temes noted there are only a few
lots that are truly park and ride lots. Generally parking is restricted to only 24 hours at a
lot. She is going to add this as a permitted use in HVC and GVC.
Transportation - Parking Garages: Senior Planner Temes is going to remove the UP
restriction. Most builders have a parking garage as past of the bigger concept of their
project.
Transportation - Transportation Passenger Terminals: Senior Planner Temes is going to
change these to permitted in GVC, HVC and Gateway Business Center (GBC).
Utility – Satellite Earth Station, Large Scale: Senior Planner Temes said it would be fine
for dish companies to operate in a Business Park (BP) and she will change it to a
permitted use.
Utility – Wireless Communication Facilities: This will be updated at a later time.
COMMERCIAL:
Commercial Services – Automated Teller Machine (ATM), Remote: These are usually
located at a bank but there are some ATMs located in a parking lot in Chandler. Senior
Planner Temes said she has not had a lot of questions about these. Principal Planner
Lorbeer said a UP or Administrative Use Permit (AUP) may not be necessary. Senior
Planner Temes said these ATMs are located in highly visible, well-lit areas with parking
nearby. The areas that currently require an AUP will be changed to permitted.
Commercial Services – Banquet Facility: Senior Planner Temes said staff would like to
remove this use from residential areas, whether it is located near an arterial street or
not. More commercial areas are more appropriate locations, but not Neighborhood
Commercial (NC). In the HVC or GVC these could be allowed but not on the first floor.
There was a discussion about the Elegant Barn that led to talk about providing shuttle
service to events where there is not enough parking.
Commercial Services – Eating and Drinking Establishments, Bars/Night Club/
Lounges/Dance Halls: Senior Planner Temes noted some neighbors do not want these
facilities in RC areas. Planning Manage Cuatro suggested looking at the size of the
establishment instead.
Commercial Services – Eating and Drinking Establishments, Brewery, Distillery or
Winery: Senior Planner Temes is going to change the UP requirement to permitted in
BP.
Commercial Services – Restaurants: Senior Planner Temes said Spectrum wanted a
coffee shop nearby but they could not have a sign on the main road and the coffee shop
could not face the main road. A restaurant would have a hard time attracting enough
customers to stay in business. She is going to change this to permitted in BP and Light
Industrial (LI). Drive-throughs will not be allowed.
Commercial Services – Funeral and Undertaking: Senior Planner Temes is going to leave
the UP requirement in the HVC.
Commercial Services – Storage, Personal Property, Indoor: Senior Planner Temes is
going to change the UP requirement to permitted. Chair Peterson noted there are a lot
of these facilities. Senior Planner Temes suggested restricting these facilities in RC areas.
Chair Peterson said there is not as much traffic in those areas and this needs further
research.
Commercial Services – Storage, Personal Property, Outdoor: Senior Planner Temes is
going to removing the permitted status from General Industrial (GI).
Commercial Services – Tattoo/Piercing Studio: Senior Planner Temes is going to change
this to allow tattoo parlors in GVC with a UP.
Commercial Services – Vehicle and Equipment Sales, Leasing and Services, Car Wash,
Automated or Self Service: Senior Planner Temes is going to remove the permitted
status from NC.
Commercial Services – Vehicle and Equipment Sales, Leasing and Services, Commercial
Vehicle/Equipment Sales and Rental; New and Used: Principal Planner Lorbeer said this
category covers large equipment such as back hoes and big trucks. It will remain
permitted in LI and GI. Chair Peterson suggested leaving the UP requirement in the
other districts where it is already required.
Commercial Services – Vehicle and Equipment Sales, Leasing and Services, Motor
Vehicle Sales; New and Used: Senior Planner Temes explained the ten percent of
allowed area for sales and leasing was not enough for businesses with internet sales.
They requested 25 to -30 percent.
Commercial Services – Vehicle and Equipment Sales, Leasing and Services, Vehicle
Services, Heavy: Senior Planner Temes said this category covers businesses doing work
such as replacing transmissions and painting vehicles. These are not appropriate
activities in RC. She is going to leave the UP requirement in GC.
Commercial Services – Vehicle and Equipment Sales, Leasing and Services, Vehicle
Services, Light: Senior Planner Temes are appropriate for BP and she is going to remove
the UP requirement.
Entertainment – Carnival, Small-Scale: Senior Planner Temes is going to add these are
Temporary Uses (T) in HVC and GVC.
Entertainment – Entertainment and Recreation, Indoor: Senior Planner Temes
mentioned a UP is required for a small bowling alley in the HVC and GVC. She is going to
remove the UP requirement.
Entertainment – Entertainment and Recreation, Outdoor: Senior Planner Temes is going
to divide this category into Large-Scale and Small-Scale.
Entertainment – Teen Nightclub: This would not be appropriate in HVC, GVC, NC or
Community Commercial (CC).
Office – Call Center: Senior Planner Temes said these facilities require a large amount of
parking. She asked if this was an appropriate use in commercial areas. She is going to
remove it from RC and keep the UP requirement in the other districts.
Office – Government Offices and Facilities, Large: Senior Planner Temes said large
facilities should not be in the GVC. She also questioned the requirement they only be
placed above the first floor. She is removing this as a permitted use in GVC.
Office – Offices, General – In HVC and GVC a UP is required for offices on the ground
floor. She questioned this restriction and she will change this to a permitted use in HVC
and GVC.
The next meeting will be on February 5, 2020 at 7:00 a.m. in Municipal Center II, Room
100.
