GLENCOE CITY COUNCIL MEETING MINUTES JUNE 20, 2016 7:00 P.M. Mayor Wilson called the regular meeting of the City Council to order at 7:00 p.m. Members present: Perschau, Ziemer, Dietz and Robeck. Absent: Member Schrupp. Also present: City Administrator Mark Larson, City Attorney Jody Winters, Finance Director Trippel, Police Chief Raiter, Fire Chief Grack, PWD’s Schreifels and Drew. PLEDGE OF ALLEGIANCE AND MOMENT OF SILENCE CONSENT AGENDA Motion and second to approve the consent agenda as presented by Members Robeck and Dietz. All members present voted in favor. A. OFFICER JOHNSON OATH OF OFFICE Police Chief Raiter administered the Law Enforcement Oath of Honor to Officer Patrick Johnson. B. THIRD READING OF SOLAR ORDINANCE NO.594  Councilor Ziemer entered the motion approving the third reading of Ordinance No. 594 regulating solar energy in the City of Glencoe. Councilor Perschau seconded the motion. Upon a roll call vote all members present voted in favor. Where upon said ordinance was adopted and approve and will be in effect upon its publication. C. VARIANCE PERMIT REQUEST OF 1415 PRYOR AVE N The Planning Commission recommended the approval of the request of property owner Nancy Arandia of 1415 Pryor Avenue North to place her fence on the rear property line. The property owner that shares that line agreed to the fence being placed on the property line. Motion by Councilor Robeck and second by Councilor Ziemer to approve the variance permit request for the fence to be placed on rear property line at 1415 Pryor Avenue North. All members present voted in favor. D. APPOINT PUBLIC WORKS DIRECTOR –STREETS/PARKS Three internal applications were received for the Public Works Director of Streets and Parks, Ryan Scheidt, Jerry Strobel and James Voigt. Interviews were conducted by City Administrator Mark Larson resulting in the recommendation of hiring James Voigt for the position. Discussion led to a motion approving the hiring of James Voigt as the Public Works Director to replace Mike Drew upon his retirement by Councilor Dietz with second by Councilor Ziemer. All members present voted in favor. E. JULY 5TH CITY COUNCIL MEETING Council members decided to have this meeting as scheduled as a majority will be in attendance the week of the 4th of July Holiday. F. RESOLUTION NO. (2016-19) APPOINTING ELECTION JUDGES AND DESIGNATING POLLING PLACE 2016 PRIMARY AND GENERAL ELECTIONS Councilor Robeck motioned approval of Resolution No. 2016-19 appointing elections judges and designating polling places for 2016 elections: RESOLUTION NO. Whereupon said resolution was adopted and approved. G. RESOLUTION NO. (2016-20) LEVY OF SPECIAL ASSESSMENT ON PROPERTY LOCATED AT 1329 13TH ST E The city has been authorized by a McLeod County Order filed on March 25th, 2016 to certify the costs for removing the hazardous residence and subsequent fees in the amount of $13,997.50 as a special assessment to 1329 13th Street East. Councilor Perschau introduced the following resolution: CITY OF GLENCOE RESOLUTION NO. (2016-20)  A RESOLUTION APPROVING THE LEVY OF SPECIAL ASSESSMENTS FOR ABATEMENT OF HAZARDOUS CONDITIONS AT THE RESIDENCE LOCATED AT 1329 13TH STREET EAST IN GLENCOE WHEREAS, on July 6, 2015, Glencoe City Council issued an Order for Repair concerning the residence located at 1329 13th Street East, Glencoe, Minnesota 55336 and legally described as Lot 1, Block 65 in the Town of Glencoe; WHEREAS, in the Order for Repair the Glencoe City Council found the residence to be hazardous for the following reasons: a) The roof was sagging and leaking. b) The electrical wiring was noncompliant. c) A relief valve was to be installed on the water heater. d) The plumbing was leaking. e) Faucets and valves needed to be repaired or replaced. f) Sewers/drains needed to be opened. g) The exterior windows needed to be repaired or replaced. h) Excess debris on secondary egress stairway and landing. i) Interior doors were broken or removed. j) Smoke detection devices were missing. k) Carbon monoxide detection devices were missing. l) Active pests in residence. m) Ceilings were structurally unsafe. n) Excess combustibles throughout the residence, odors permeated residence from garbage, sewage back up and contaminants. o) Entire bathroom was structurally unsound. p) Damaged walls and ceilings where plaster has been broken, missing or removed. WHEREAS, the property is owned by Delores A. Thurn who passed away on August 13, 2010; WHEREAS, Lloyd Thurn, Delores Thurn’s heir, was served personally with the Order for Repair on July 13, 2015. The Order for Repair was also posted on the property on July 13, 2015; WHEREAS, the Order for Repair required repairs to be completed within 30 days of the service of the Order or the City would be authorized to repair or raze the residence due to his hazardous condition. No repairs were completed on said property. WHEREAS, a Motion for Summary Enforcement of the Order for Repair was served on Lloyd Thurn on August 27, 2015 and the matter came before the Court on October 27, 2015. WHEREAS, in a McLeod County District Court Order filed November 17, 2015, the City of Glencoe was authorized to raze or repair the residence located at 1329 13th Street East and the costs of repairing, razing, correcting or removing the residence and fees was to be considered a lien against the real estate upon submission of affidavit and receipts. Said lien was to be collected as a special assessment pursuant to Minnesota Statute §463.21. WHEREAS, the costs of repair, statutory fees, filing fee, etc. was submitted by affidavit and filed with McLeod County Court Administration. A McLeod County Order filed March 25, 2016, authorized the City of Glencoe to certify the costs in the amount of $13,997.50 as a special assessment. NOW THEREFORE, be it resolved by the City Council of Glencoe, Minnesota as follows: The recitals set forth above are incorporated herein; The City Clerk shall transmit a certified duplicate of the following assessment to the McLeod County Auditor to be extended on the tax list of the County. Total: $13,997.50 Councilor Dietz seconded the motion. Upon a roll call vote all members present voted in favor. Whereupon said resolution was adopted and approved. ITEMS FOR DISCUSSION: A. LINCOLN PARK PROJECT UPDATE Final lift complete, will be spraying boulevard weeds and reseeding where needed. Tree planting will be done in the fall. B. ARMSTRONG AVENUE PROJECT UPDATE Turning sub-soil on 7th to dry – rains have caused delays C. STORM WATER Member Robeck brought before the council areas of concerns to him. ROUTINE BUSINESS: PROJECT UPDATES: PWD Drew – Oak Leaf Park flooding concerns addressed, grass clippings cleaned from catch basins ECONOMIC DEVELOPMENT: EDC will meet this week – Industrial Park lot potential sale discussion PUBLIC INPUT: Robeck- Fire Hall fence repairs question REPORTS: None CITY BILLS: Motion to approve payment of city bills by Member Perschau, second by member Ziemer.
