GLENCOE CITY COUNCIL MEETING MINUTES OCTOBER 1, 2018 7:00 P.M. Mayor Wilson called the regular meeting of the city council to order at 7:00 p.m. Members present: Ziemer, Schrupp, Robeck, Neid and Alexander. Also present: City Administrator Mark Larson, City Attorney Ostlund, Finance Director Trippel, Police Chief Raiter, Fire Chief Scheidt, PWDs Schreifels and Voigt, and Police Captain Padilla. PLEDGE OF ALLEGIANCE AND MOMENT OF SILENCE CONSENT AGENDA Motion to approve the consent agenda with change to the minutes regarding acceptance of the bid of Revier Welding- remove the word “high”, entered by Ziemer, second by Neid. All voted in favor. A. Approve the minutes of the regular meeting of September 17, 2018. B. Approve the following building permits: 1. Glencoe Multi Family LLC, 2905 14th St E; Mechanical Permit 2. Administer Oath of Office: Mayor Wilson administered the Firefighter Oath to 2nd Lieutenant Robert Brinkmann. Mayor Wilson then administered the Law Enforcement Oath of Honor to Police Officer Taylor Schultz. PUBLIC HEARINGS: None Scheduled BIDS AND QUOTES: None Scheduled REQUESTS TO BE HEARD: A. MINNESOTA MUNICIPAL BEVERAGE ASSOCIATION RESOLUTION Councilor Neid entered the following resolution and moved for its adoption: RESOLUTION NO. 2018-27 A RESOLUTION OPPOSING THE SALE OF STRONG BEER, SPIRITS AND WINE IN GROCERY AND CONVENIENCE STORES  WHEREAS, the sale of strong beer, spirits, and wine has long been regulated to preserve public health and minimize public safety concerns; and WHEREAS, to promote public safety and public health, cities have an interest in preventing youth from obtaining alcohol; and WHEREAS, increased alcohol availability is associated with increased alcohol related problems in both youth and the general public; and WHEREAS, the public supports existing regulations controlling the sale of alcohol to minimize the risks associated with youth access to alcohol; and WHEREAS, allowing the sale of beer, spirits, and wine in grocery and convenience stores would increase the public health risk of youth access to alcohol; and WHEREAS, allowing the sale of beer, spirits, and wine in grocery and convenience stores would increase the public health risk of alcohol-related motor vehicle accidents among youth; and WHEREAS, the public health risks of increasing youth access to alcohol and increased alcohol-related motor vehicle accidents among youth caused by the sale of strong beer, spirits, and wine in grocery and convenience stores are preventable; and WHEREAS, the public health risks created by increasing youth access to alcohol and increase alcohol-related motor vehicle accidents among youth outweigh any convenience to the public of relaxing present regulations and allowing sale of strong beer, spirits, and wine in grocery and convenience stores. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Glencoe, Minnesota, hereby opposes the sale of strong beer, spirits, and wine in grocery and convenience stores. Councilor Robeck seconded. Upon a roll call vote all members voted in favor. Whereupon said resolution was adopted and approved. B. BUSINESS PROCLAMATION Mayor Wilson read the business proclamation declaring a Local Business Appreciation Day on October 11th. Dan Ehrke, Assistant City Administrator informed the council that moving forward this appreciation day will be held annually the 2nd Thursday of October. In addition to the proclamation there will be a ribbon cutting ceremony at 3:30 p.m. on October 11th for the Hennepin Avenue Project completion. C. ACCEPT RETIREMENT OF GARY REINITZ Gary Reinitz, Street/Parks maintenance operator has formally resigned his position effective November 30th, 2018. Councilor Ziemer motioned to accept his resignation. Councilor Robeck seconded. All members voted in favor. A thank you will be sent for his years of service. D. APPOINT WATER DEPARTMENT OPERATOR Public Works Director Schreifels brought before the council the Water Treatment Plant recommendation to hire Matt Stuewe to fill Corbin Baker’s position.  Councilor Alexander motioned to approve the hiring of Matt Stuewe as an operator at the Water Treatment Plant. Councilor Neid seconded. All members voted in favor. E. POINT SOURCE IMPLEMENTATION GRANT FUNDING City Administrator Mark Larson shared the announcement of the MPCA Priority Order that the City of Glencoe will receive a PSIG Grant of approximately $5,593,458 for the WWTP facility project. The final dollar amount will be determined when bids are opened in mid -October. Also noted, the City of Glencoe is to receive an appropriation of $3,000,000 in the 2018 Bonding Bill. The City is also eligible for the Green Project Reserve funding of up to $1,000,000 in PFA Loan forgiveness. The actual number to be determined upon bid opening. F. POLIFKA ANNEXATION City Attorney Mark Ostlund reviewed for the council the Polifka Annexation process. The original annexation included an incorrect legal description. To move the annexation forward in a timely matter it was decided to pursue the annexation through resolution with Glencoe Township and the City of Glencoe agreeing to all terms annexing the property into the city. Councilor Schrupp entered the following resolution and moved for its adoption: RESOLUTION NO. 2018-28 IN THE MATTER OF THE ORDERLY ANNEXATION BETWEEN THE CITY OF GLENCOE AND GLENCOE TOWNSHIP PURSUANT TO MINNESOTA STATUTES § 414.0325 WHEREAS, a request from all of the property owners of the area proposed for designation and immediate annexation was received. WHEREAS, the City of Glencoe and Glencoe Township jointly agree to designate and request the immediate annexation of the following described land located within Glencoe Township to the City of Glencoe, County of McLeod, Minnesota;\ See Exhibit “A” attached hereto and incorporated by reference. And WHEREAS, the City of Glencoe and Glencoe Township are in agreement as to the orderly annexation of the unincorporated land described; and WHEREAS, Minnesota Statutes § 414.0325 provides a procedure whereby the City of Glencoe and Glencoe Township may agree on a process of orderly annexation of a designated area; and WHEREAS, the City of Glencoe and Glencoe Township have agreed to all the terms and conditions for the annexation of the above-described lands; and the signatories hereto agree that no alteration of the designated area is appropriate and no consideration by the Chief Administrative Law Judge is necessary. The Chief Administrative Law Judge may review and comment, but shall within thirty (30) days, order the annexation in accordance with the terms of the resolution. NOW, THEREFORE, BE IT RESOLVED, jointly by the City Council of the City of Glencoe and the Township Board of Glencoe Township as follows:  1. Property. That the following described land is subject to orderly annexation pursuant to Minnesota Statutes § 414.0325, and that the parties hereto designate the area for orderly annexation; and agree that the land be immediately annexed: See Exhibit “A” attached hereto and incorporated 2. Acreage/Population/Usage. That the orderly annexation area consists of approximately 5 acres, the population in the area is 0, and the land use type is unimproved, vacant land. 3. Jurisdiction. That Glencoe Township and the City of Glencoe by submission of this joint resolution to the Municipal Boundary Adjustment Unit of the Office of Administrative Hearings, confers jurisdiction upon the Chief Administrative Law Judge so as to accomplish said orderly annexation in accordance with the terms of this resolution. 4. Municipal Reimbursement. Minnesota Statutes § 414.036. a. Reimbursement to Towns for lost taxes on annexed property. In the first year following the year in which the City of Glencoe could first levy on the annexed area, an amount equal to $10.14; and In the second and final year, an amount equal to $10.14, for a total of $30.42 b. Assessments and Debt. That pursuant to Minnesota Statutes § 414.036 with respect to any special assessment assigned by the Township to the annexed property and any portion of debt incurred by the Township prior to the annexation and attributable to the property to be annexed, but for which no special assessments are outstanding, for the area legally described (herein or attached exhibit) there are (1) no special assessments or debt; 6. Review and Comment. The City of Glencoe and Glencoe Township agree that upon receipt of this resolution, passed and adopted by each party, the Chief Administrative Law Judge may review and comment, but shall within thirty (30) days, order the annexation in accordance with the terms of the resolution. Councilor Robeck seconded. Upon a roll call vote all members voted in favor. Whereupon said resolution was adopted and approved. ITEMS FOR DISCUSSION: A. CENTRAL STORM SEWER UPDATE 12th Street storm sewer close to completion, 13th Street utilities placed. Work is progressing and on schedule to wrap up for this construction season end of October. B. 14TH STREET EXTENSION UPDATE Storm sewer is complete. Street to be sub cut next. C. COALITION OF GREATER MN CITIES FALL CONFERENCE November 15 and 16 in Alexandria. Registration now open. ROUTINE BUSINESS: PROJECT UPDATES: 11th Street and Morningside Avenue water pipes being repaired in preparation of the 2019 Morningside Avenue Project. ECONOMIC DEVELOPMENT: The information on Facebook regarding Kwik Trip is incorrect. Kwik Trip will be built as agreed, by Harpel’s on 11th Street East. PUBLIC INPUT: There was none. REPORTS: All reports in the council packet. CITY BILLS: Motion to approve payment of the city bills entered by Member Ziemer and seconded by Member Neid. All members voted in favor. CLOSE MEETING TO DISCUSS REAL ESTATE PURCHASE AND SALE OF PROPERTY WITH MCLEOD COOP Motion to close the regular meeting of the Glencoe City Council entered by Member Schrupp with Member Alexander seconding. Members voting in favor Schrupp, Alexander, Ziemer and Neid. Robeck entered a no vote. Motion carried. Councilor Schrupp motioned to re-open the meeting with Councilor Neid seconding. All members voted in favor. Councilor Robeck entered the motion to accept the offer of McLeod Coop Power to purchase the 6.6 acre city lot in the East Industrial Park and 3.3 acres of land to be acquired from the Gruenhagen family for $211,000 ($66,000 for Gruenhagen Property) and to authorize City Attorney to draft a Purchase Agreement. Seconded by Councilor Schrupp. All members voted in favor. The motion carried. ADJOURN: Councilor Robeck motioned to adjourn. Councilor Schrupp seconded. All members voted in favor.
