MINUTES-REGULAR MEETING CITY OF GODDARD 118 NORTH MAIN, GODDARD, KS MONDAY, APRIL 4, 2022 The Goddard City Council met in a Regular Session at Goddard City Hall on Monday, March 21, 2022. Mayor Larkin called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance and the Invocation. Council members present were Larry Zimmerman, Sarah Leland, Brent Traylor, and Michael Proctor. Also present were, Brian Silcott, City Administrator; Lorie DeVaney, Assistant City Clerk; Lance Beagley Police Chief; Brooke Brandenburg, Public Works Director; Matt Lawn, Finance Director; Harlan Foraker, City Engineer and Ryan Peck, City Attorney. CITIZEN COMMENTS None APPROVAL OF THE CONSENT AGENDA MOTION: Councilmember Traylor moved to approve the Consent Agenda as presented. Councilmember Leland seconded the motion. The motion carried unanimously. CONSIDER AMENDED PURCHASE AGREEMENT WITH UNEEDA STORAGE Brian Silcott, City Administrator presented an amended real estate purchase contract between the City of Goddard, Kansas and Uneeda Storage, LLC. The amendment extends the inspection period to July 1, 2022, and the buyer is providing an additional $5,000 earnest deposit that will become part of the final purchase price set forth in Section 4 of the Agreement. The amendment in Section 8 is entirely deleted and replace with the general condition that the buyer may construct either a self-storage or multi-family residential units within 24 months of the effective date of the agreement. Should the seller not approve of the Buyer’s development plan the agreement is terminated and the entire earnest money deposit is returned to the Buyer. MOTION: Councilmember Proctor moved to authorizer the Mayor to sign the amended purchase agreement with Uneeda Storage, LLC, as presented. Councilmember Leland seconded the motion. The motion carried unanimously. TRAILS END PHASE 1 ENGINEERING SERVICES AGREEMENT Brian Silcott presented a proposed agreement between the City and Garver, LLC. which provides for the design of bond financed improvements consisting of paving, storm sewer, water system, and storm water system improvements. Staff recommends using Garver LLC. as this firm provided the preliminary engineering services for the platting of the Trails End subdivision, can expedite plan preparation, and is the Developer’s preferred engineer. As the improvement authorization and issuance resolutions are forthcoming staff recommends approving the agreement pending issuance of the temporary notes. 1 City Council Minutes April 4, 2022 MOTION: Councilmember Proctor moved to authorize the Mayor to enter into a engineering services agreement with Garver, LLC, for the design of bond financed improvements consisting of paving, storm sewer, water system, and storm water system improvements. Councilmember Traylor seconded the motion. The motion carried unanimously. CONSIDER 2022-01 GENERAL OBLIGATION TEMPORARY NOTES FOR WATER AND STREET IMPROVEMENTS FOR CLOVER LEAF FARMS ADDITION PHASE 3 Brian Silcott presented a resolution authorizing the offering for sale of General Obligation Temporary Notes, Series 2022-01 to fulfill the directive of Resolutions 22-04 authorizing street and sidewalk improvements and 22-05 authorizing water line improvements for Clover Leaf Farms Addition Phase 3. MOTION: Councilmember Traylor moved to adopt the proposed resolution as presented. Councilmember Zimmerman seconded the motion. The motion carried unanimously. Resolution 22-07 CITY ADMINISTRATOR’S REPORT Brian Silcott reviewed the City Administrator’s report dated April 4, 2022. Silcott provided updates on the STAR Bond Site and on all current residential housing developments currently under construction including Arbor Creek, Clover Leaf, and Rustic Creek. Silcott thanked the Lions Club for hosting the Lions Club Car Show which drew in approximately 1000 people for the event. Silcott added that the Goddard Police Department was available as well for car seat safety inspections. EXECUTIVE SESSION MOTION: Councilmember Zimmerman moved to recess into executive session to discuss a performance matter involving a city employee pursuant to the non-elected personnel matters exception, K.S.A. 75-4319(b)(1), the City Council will reconvene the open meeting in the City Council Chamber at 7:55 p.m. The motion was seconded by Councilmember Leland. The motion passed unanimously. The City Council recessed into executive session at 7:25 p.m. and reconvened at 7:55 p.m. Mayor Larkin announced there was no binding action taken in executive session. GOVERNING BODY COMMENTS Councilmember Proctor stated he is excited about the new developments in the community. Councilmember Traylor asked if the pothole on Main Street has been repaired. Brandenburg confirmed that the pothole was repaired directly after the incident on Main Street and added that it should have been repaired prior to the incident. 2 City Council Minutes April 4, 2022 ADJOURNMENT MOTION: Councilmember Leland moved to adjourn the regular meeting.
