GRANDVIEW CITY COUNCIL REGULAR MEETING MINUTES DECEMBER 10, 2013 1. CALL TO ORDER Mayor Norm Childress called the regular meeting to order at 7:00 p.m. in the Council Chambers at City Hall. Present were: Mayor Childress and Councilmembers Mike Bren, Diana Jennings, Pam Horner, Bill Moore, Jesse Palacios, Javier Rodriguez and Joan Souders. Staff present were: City Administrator/Public Works Director Cus Arteaga, City Attorney Tony Menke and City Clerk Anita Palacios. Excused from the meeting were City Attorney Quinn Plant and City Treasurer Matt Cordray. 2. PLEDGE OF ALLEGIANCE Councilmember Horner led the pledge of allegiance. 3. PRESENTATIONS A. WWTP Groundwater Analysis Report Update City Engineer Ted Pooler with HLA presented an update on the Wastewater Treatment Plant (WWTP) AKART Engineering Report for Groundwater Quality Improvement, copy of which is attached hereto and incorporated herein by reference. 4. PUBLIC COMMENT – None 5. CONSENT AGENDA On motion by Councilmember Horner, second by Councilmember Souders, Council unanimously approved the Consent Agenda consisting of the following: A. Minutes of the November 26, 2013 special budget meeting B. Minutes of the November 26, 2013 regular meeting C. Payroll Electronic Fund Transfers (EFT) Nos. 5106 - 5113 in the amount of $102,766.70 D. Payroll Check Nos. 7126-7168 in the amount of $38,596.20 E. Payroll Direct Deposit 11/16/13 – 11/30/13 in the amount of $124,678.90 F. Claim Check Nos. 104824-104897 in the amount of $361,343.49 G. Resolution No. 2013-57 accepting the bid and authorizing the Grandview Herald as the Official City Newspaper for the year 2014 H. Resolution No. 2013-58 authorizing the Mayor to sign the 2014 Interlocal Corrections/Detention Agreement with Yakima County I. Ordinance No. 2013-27 adopting the City of Grandview 2014 Non-Union Salary Schedule to increase the minimum wage to $9.32 per hour on January 1, 2014 Regular Meeting Minutes December 10, 2013 Page 2 6. ACTIVE AGENDA A. Ordinance No. 2013-28 adopting the budget and confirming tax levies for revenue to carry on the government for the fiscal year ending December 31, 2014 On motion by Councilmember Moore, second by Councilmember Rodriguez, Council unanimously Ordinance No. 2013-28 adopting the budget and confirming tax levies for revenue to carry on the government for the fiscal year ending December 31, 2014. B. Closed Record Public Hearing Petition for Annexation & Rezone – Port of Grandview Annexation Mayor Childress opened the closed record public hearing to consider a petition for annexation and rezone submitted by the Port of Grandview by reading the public hearing procedure. There was no one in the audience who objected to his participation as Mayor or any of the Councilmembers’ participation in these proceedings. None of the Councilmembers had an interest in this issue nor did any stand to gain or lose any financial benefit as a result of the outcome of this hearing and all indicated they could hear and consider the issue in a fair and objective manner. The purpose of the hearing was for the Council to review the record and consider the pertinent facts relating to this issue. No new public testimony was allowed. City Clerk Palacios provided the following review of the record. The City received a Letter of Intent and Petition for Annexation and Rezone signed by the Port of Grandview requesting annexation of their property to the City of Grandview. The petitioner elected to request annexation under the 60% petition method of annexation. The 60% petition method required signatures by owners of not less than 60% of the assessed value of the total property proposed for annexation. The petition contained sufficient signatures. The proposed annexation included Parcel No. 230915-24001. The petitioner requested the area be annexed with an M-1 Light Industrial zoning. The parcel was included in the City’s Urban Growth Area and was currently designated industrial in the Future Land Use Designations. At the October 8, 2013 City Council meeting, Council accepted the proposed annexation, required the simultaneous adoption of zoning regulations consistent with the Urban Growth Area Future Land Use Designations—M-1 Light Industrial and required the assumption of all existing City indebtedness by the properties proposed to be annexed the same as all other property within the City in accordance with past practice, and agreed to have the annexation petition heard by a Hearing Examiner. On November 5, 2013, a public hearing was held before the Hearing Examiner to receive comments on the proposed annexation and rezone. A copy of the Hearing Examiner’s recommendation was attached hereto and incorporated herein as part of these minutes. Council requested no clarification of the record. On motion by Councilmember Horner, second by Councilmember Palacios Council unanimously accepted the Hearing Examiner’s conclusions and recommendation that the Port of Grandview Annexation Petition #02-13 with M-1 Light Industrial zoning of Parcel No. 230915-24001 be approved. C. Resolution No. 2013-59 authorizing the petition to annex property known as the Port of Grandview Annexation that is contiguous to the City of Grandview and providing for transmittal of said petition to the Yakima County Boundary Review Board for a 45-day review prior to taking final action On motion by Councilmember Horner, second by Councilmember Palacios, Council unanimously approved Resolution No. 2013-59 authorizing the petition to annex property known as the Port of Grandview Annexation that is contiguous to the City of Grandview and providing for transmittal of said petition to the Yakima County Boundary Review Board for a 45-day review prior to taking final action. 7. UNFINISHED AND NEW BUSINESS Mayor Pro Tem Appointment – Mayor Childress advised Council of his intention to appoint Councilmember Moore to fill the Mayor Pro Tem position effective January 1, 2014. On motion by Councilmember Jennings, second by Councilmember Souders, Council unanimously confirmed the Mayor’s appointment of Councilmember Moore as Mayor Pro Tem effective January 1, 2014. 8. CITY ADMINISTRATOR AND/OR STAFF REPORTS Aerated Lagoon Repairs – The repairs have been completed to the aerated lagoon. The total cost of repairs was approximately $123,000. A claim for damages was submitted to WCIA for consideration. 9. MAYOR & COUNCILMEMBER MEETING REPORTS Dog Park Committee Fundraiser – The Dog Park Committee would be hosting a “Santa Paws” fundraiser at Bleyhl Farm Service on December 14th from 2 to 4 p.m. Cocoa and Carols – The Chamber of Commerce would be hosting their annual Cocoa and Carols on December 13th at Stokely Square. YVCOG General Membership Meeting – The Yakima Valley Conference of Governments (YVCOG) General Membership meeting would be held on December 11th in Sunnyside. Wreaths Across America – The annual Wreaths Across America would take place on December 14th at the Grandview Cemetery starting at 9:00 a.m. Regular Meeting Minutes December 10, 2013 Page 4 10. EXECUTIVE SESSION – Union Negotiations Mayor Childress adjourned the meeting to an executive session at 7:50 p.m., for approximately 20 minutes to discuss union negotiations per RCW 42.30.140(4) with the aforementioned Mayor, Councilmembers, City Attorney, City Administrator and City Clerk present. The executive session was extended an additional 10 minutes at 8:10 p.m. The meeting resumed at 8:25 p.m., with the aforementioned Mayor, Council and staff present. No action was taken. 11.
