GRANDVIEW CITY COUNCIL REGULAR MEETING MINUTES JUNE 14, 2022 1. CALL TO ORDER Mayor Gloria Mendoza called the regular meeting to order at 7:00 p.m. in the Council Chambers at City Hall. The meeting was held in person and was also available via teleconference. Present in person: Mayor Mendoza and Councilmembers David Diaz, Jessie Espinoza, Bill Moore (Mayor Pro Tem), Robert Ozuna, Javier Rodriguez and Joan Souders Present via teleconference: None Absent: Councilmember Mike Everett On motion by Councilmember Moore, second by Councilmember Souders, Council excused Councilmember Everett from the meeting. PLEDGE OF ALLEGIANCE Mayor Mendoza led the pledge of allegiance. 3. APPROVE AGENDA On motion by Councilmember Moore, second by Councilmember Rodriguez, Council approved the June 14, 2022 regular meeting agenda. PRESENTATIONS Grandview-Sunnyside Pathway – Ed Werkhoven with the Lower Yakima Valley Trails and Recreation Pathway Association solicited support for the re-pavement of the Grandview- Sunnyside pathway. He explained that the Grandview to Sunnyside pathway was paved over 30 years ago and was showing its age in cracks and end-of-life asphalt. The Pathway Association was a non-profit organization and would be making application to Yakima County for a grant of 2022 American Rescue Plan Funds. The grant would cover the entire re-pavement of the Grandview-Sunnyside pathway and parking areas. A commitment of funds from the cities of Sunnyside and Grandview would aid to procure this grant by demonstrating cost-sharing support. He requested a $50,000 commitment from the City of Grandview. On motion by Councilmember Moore, second by Councilmember Diaz, Council committed $50,000 of the City’s future ARPA funds to the Grandview-Sunnyside pathway re-pavement project. 5. PUBLIC COMMENT Vintage Tractor Exhibition – Ray Vining, Grandview Museum Board Member, explained that the Grandview Museum would be hosting a Vintage Tractor Exhibition on June 25 and 26, 2022 from 9 a.m. to 5 p.m. at the Museum parking lot. Johnny Prieto, 1214 Katy Court, Grandview, Washington, former employee of the Public Works Department, complained that during his employment with the City he was apparently bullied and harassed by management in the Public Works Department. 6. CONSENT AGENDA On motion by Councilmember Moore, second by Councilmember Souders, Council approved the Consent Agenda consisting of the following: A. Minutes of the May 24, 2022 Committee-of-the-Whole meeting B. Minutes of the May 24, 2022 Council meeting C. Payroll Check Nos. 12741-12769 in the amount of $30,176.95 D. Payroll Electronic Fund Transfers (EFT) Nos. 60802-60812 in the amount of $115,149.43 E. Payroll Direct Deposit 5/16/22-5/31/22 in the amount of $146,810.76 F. ACTIVE AGENDA A. Closed Record Public Hearing – Darren Still dba Statewide Development LLC., and Karissa Carpenter Bradshaw Annexation & Rezone, 3160 and 3130 Olmstead Road, Grandview, Yakima County, Washington Present on behalf of the applicant was Darren Still dba Statewide Development LLC. Mayor Mendoza opened the closed record public hearing to consider an Annexation and Rezone submitted by Darren Still dba Statewide Development LLC., and Karissa Carpenter Bradshaw for Parcel Nos. 230924-12004 and 230924-12008 located at 3160 and 3130 Olmstead Road, Grandview, Yakima County, Washington, by reading the public hearing procedure. There was no one in the audience who objected to her participation as Mayor or any of the Councilmembers’ participation in these proceedings. None of the Councilmembers had an interest in this issue nor did any stand to gain or lose any financial benefit as a result of the outcome of this hearing and all indicated they could hear and consider the issue in a fair and objective manner. The purpose of the hearing was for the Council to review the record and consider the pertinent facts relating to this issue. No new public testimony was allowed. City Administrator Arteaga provided the following review of the record:  The City received a Letter of Intent and Petition for Annexation and Rezone signed by Darren Still dba Statewide Development LLC., and Karissa Carpenter Bradshaw to annex Parcel Nos. 230924-12004 and 230924-12008 located at 3160 and 3130 Olmstead Road, Grandview, Washington, consisting of 3.3 acres to the City of Grandview. The petitioners elected to request annexation under the 60% petition method of annexation. The 60% petition method requires signatures by owners of not less than 60% of the assessed value of the total property proposed for annexation. The petition contained sufficient signatures of the assessed value.  The petitioners requested the parcels be annexed with a C-2 General Business zoning designation as identified on the City’s Future Land Use map. The parcels were included in the City’s designated Urban Growth Area as commercial.  At the March 8, 2022 City Council meeting, Council approved Resolution No. 2022-08 accepting a request from Statewide Development LLC and Karissa Carpenter Bradshaw for annexation of Parcel Nos. 230924-12004 and 230924-12008 located at 3160 and 3130 Olmstead Road, Grandview, Yakima County, Washington and directed staff to present the Petition for Annexation to the Hearing Examiner for a public hearing.  On April 27, 2022, a public hearing was held before the Hearing Examiner to receive comments on the proposed annexation and rezone. A copy of the Hearing Examiner’s Recommendation was presented.  Staff recommended Council accept the Hearing Examiner’s conclusions and recommendation that the Petition for Annexation of Parcel No. 230924-12004 at 3160 Olmstead Road and Parcel No. 230924-12008 at 3130 Olmstead Road, together with the Olmstead Road and I-82 rights-of-way adjacent to said parcels be approved with C-2 General Business District zoning subject to the assumption of an appropriate share of all existing City indebtedness by the annexed area. Regular Meeting Minutes June 14, 2022 Page 4  Staff further recommended Council approve Resolution No. 2022-26 authorizing the petition to annex properties known as the Darren Still dba Statewide Development LLC., and Karissa Carpenter Bradshaw that is contiguous to the City of Grandview and providing for transmittal of said petition to the Yakima County Boundary Review Board for a 45-day review prior to taking final action. Discussion took place. The public hearing was declared closed. On motion by Councilmember Ozuna, second by Councilmember Moore, Council accepted the Hearing Examiner’s conclusions and recommendation that the Petition for Annexation of Parcel No. 230924-12004 at 3160 Olmstead Road and Parcel No. 230924-12008 at 3130 Olmstead Road, together with the Olmstead Road and I-82 rights-of-way adjacent to said parcels be approved with C-2 General Business District zoning subject to the assumption of an appropriate share of all existing City indebtedness by the annexed area.
