CITY OF GREEN RIVER CITY COUNCIL PROCEEDINGS AUGUST 18, 2015 The Governing Body of the City of Green River met in regular session at 7 pm in the City Hall Council Chambers. Mayor Pete Rust called the meeting to order. The following Council Members were present: Gary Killpack, Mark Peterson, Ted Barney, Allan Wilson, Brett Stokes, and Lisa Maes. The following were present representing the City: City Administrator Reed Clevenger, Director of Public Works Mike Nelson, City Engineer/Utility Manager Mark Westenskow, Director of Finance Chris Meats, Director of Community Development Laura Profaizer, Chief of Police Chris Steffen, Fire Chief/Emergency Services Mike Kennedy, Parks and Recreation Director Brad Raney, and Acting City Attorney Tammy Harris. APPROVAL OF THE AGENDA Council Member Wilson moved to amend the agenda by adding an Executive Session on Personnel. Council Member Killpack seconded. Motion carried. (6-0) Council Member Killpack moved to approve the agenda as amended. Council Member Wilson seconded. Motion carried. (6-0) PRESENTATIONS Rock Springs Business & Economic Development Alliance Rock Springs Business and Economic Development Alliance Chairman Gary Watkins and Business Development Manager Kayla McDonald gave a brief update on the Rock Springs Business and Economic Development Alliance. Council Member Maes entered meeting at this time. Climb Wyoming Climb Wyoming, Director of Operations Donna Nelson, gave a brief update on Climb Wyoming. CITIZEN REQUESTS AND OTHER COMMUNICATIONS Resident Terrell Lance said on the evening of August 15, 2015 while he was out of town on vacation there was an anonymous barking dog complaint made on his dog. A Green River Police Officer went onto his property, in his backyard, and followed the dog to the back door where there is a dog door. He placed a cooler and a barbeque in front of the door blocking it so the dog could not get back out and never called anyone or let anyone know. The animals remained in his home for over 30 hours before he returned. The dogs have destroyed his carpet and some of the furniture. He would like to know who gave the Police Department the right to violate his civil rights and how a public nuisance complaint can justify them endangering and being cruel to animals. He has spoken to Chief Steffen, Chris Meats, and the City Administrator about this and they have been wonderful about following up with him but he doesn’t think it justifies what the officer did. The Mayor said staff is currently working on this and during the process some of his questions will be answered. BOARD AND COMMITTEE APPOINTMENTS Planning & Zoning Commission Council Member Killpack moved to confirm the Mayor’s appointment of Scott Travis to the Planning & Zoning Commission, commencing August 2015 and terminating August 2018. Council Member Stoked seconded. Motion carried. (7-0) The Tree Board City Council Proceedings August 18, 2015 Page 1 of 4 Council Member Stokes moved to confirm the Mayor’s appointment of JoAnn Wyant to a three year term on the Tree Board commencing August 2015 and terminating in August 2018. Council Member Wilson seconded. Motion carried. (7-0) RESOLUTIONS Increase in General Fund for Animal Control R15-58: A resolution of the governing body of the City of Green River, Wyoming, to approve an increase in the General Fund for the Animal Control Budget in the amount of $500. Council Member Wilson moved to approve a Budget Resolution allowing $500 to be moved from a restricted donation account to the Animal Control program 260-Admin. Council Member Maes seconded. Motion carried. (7-0) Increase in General Fund for Spaceport Day Event R15-59: A resolution of the Governing Body of the City of Green River, Wyoming, to approve an increase in the General Fund for the Spaceport Days Event in the amount of $5,000 Council Member Peterson moved to approve an increase in the General Fund for the Spaceport Day Event in the amount of $5,000. Council Member Stokes seconded. Council Member Killpack said he wants to make it clear the city is not putting money towards the airport. The funds are from the state. He asked how much the event cost and who has the invoices that need to be paid. Mr. Meats said currently the invoices are sitting at $2,500 to $3,000. Most invoices are being held by Holden Wright and himself and some have been paid by credit card. The funds came from grant funds that were approved on June 16, 2015 and there was no way they could pay these invoices in June to come out of the 2015 budget so the funds approved last fiscal year will be moved to this fiscal year and then paid. Council Member Killpack asked what will happen with any extra monies after the invoices are paid. Mr. Meats said there are two options: one is to return the money to the Aeronautics Division and the second is to keep the remaining funds and use them for next year’s event. The grant was only for promotional items and cannot be used for anything else. Council Member Killpack asked what would happen if the total cost of the event is higher than the funds that were approved. Mr. Meats said staff is very aware of the budget set forth on this event and have been monitoring it to make sure they do not go over the amount. Council Member Wilson asked how much staff time the city had to payout for the event. Mr. Meats said that would be a better question for Mr. Wright. Mr. Clevenger said Mr. Wright was told that staff could not help with the event so he had to depend on volunteers. Council Member Wilson clarified that no city funds were used for this event. Mayor Rust said there were no city funds or staff used for this event. Council has said unanimously, they are against city funds being used for the Spaceport but they do believe in providing the opportunity to the group to do whatever they can themselves. (7-0) City Council Proceedings August 18, 2015 Page 2 of 4 COUNCIL ACTION ITEMS UPRR GRANT Council Member Barney moved to authorize the Parks & Recreation Department to submit and if awarded, receive an $11,000 grant with the Union Pacific Railroad. Council Member Maes seconded. Motion carried. (7-0) CONSENT AGENDA Council Member Killpack moved to approve the following consent agenda items. Council Member Wilson seconded. Motion carried. (7-0) • Agreement with Wyoming Public Media for Art on the Green Advertising in the amount of $505 • Horse corral lease with Scott Francis for corrals #105 and #106 • Landfill removal requests by Jen Holden for a yellow plastic slide, Crystal Walker for a ladder, shovel, chicken wire, blind, metal decorative circle and a gutter, and Paul Wright for a tractor tire • Minutes for: August 4, 2015 Council • Payment of Bills: Prepaid Invoices = $266,745.65 Outstanding Invoices = $876,250.17 Payroll Expenditures = $352,872.94 Pre-authorization Payments = $1,070,000.00 CITY ADMINISTRATOR’S REPORT Mr. Clevenger reminded everyone that school is starting tomorrow and school zones will be in effect. River Festival was a great event and he saw a lot of cars from out of state. On August 26, 2015 he will be attending the FEMA Workshop along with Chief Steffen. CITY ATTORNEY’S REPORT Ms. Harris had nothing to report. MAYOR AND COUNCIL REPORTS Council Members Stokes said the River Festival and Art on the Green were fantastic. Council Member Killpack thanked Mr. Clevenger for sending the updates to the council and he agreed that the River Festival was a great event. The marathon was great and is getting better and better every year. He thanked everyone that organized it and helped during the event. Council Member Maes said agreed with Council Member Killpack. Council Member Barney said the River Festival went great and everyone he spoke to enjoyed it as well. Council Member Peterson sent his condolences to Mr. West on his loss. Council Member Wilson reminded everyone on school zones and buses. The Brownsfield Workshop was well rounded and had a great response. The River Festival and Art on the Green were great events. He suggested having a city liaison on the Planning & Zoning Commission so the city is aware of what is going on. Council Members agreed and he suggested having the appointment on the next council meeting. He thanked staff for keeping them aware of the tree issues in town and what is being done to take care of them. He would like to see a map of the areas that are affected and he would like it to be handled as quickly as possible. The Mayor said the River Festival and Art on the Green are his favorite events. He was able to give out the Mayor’s Choice award and he was very impressed with the artwork. The Miner’s Statue is amazing and will be a great addition to the Miner’s Park. October 30, 2015 is Mine Safety Day and they will be having many activities. He thanked Council Member Peterson for City Council Proceedings August 18, 2015 Page 3 of 4 judging the car show. There were 40 cars so it was a great event as well. He thanked everyone involved in the event.
