This agenda is duly posted outside City Hall and on the City of Greenfield web site  RESOLUTION GSA NO. 2022-09 A RESOLUTION OF THE ARROYO SECO GROUNDWATER SUSTAINABILITY AGENCY AUTHORIZING THE CONTINUED USE OF REMOTE TELECONFERENCING PROVISIONS (AB 361) WHEREAS, the Governing Board of the Arroyo Seco Groundwater Sustainability Agency (“Governing Board”) is committed to open and transparent government, and full compliance with the Ralph M. Brown Act (“Brown Act”); and WHEREAS, the Brown Act generally requires that a public agency take certain actions in order to use teleconferencing to attend a public meeting virtually; and WHEREAS, the Governing Board recognizes that a local emergency persists due to the worldwide COVID-19 pandemic; and WHEREAS, the California Legislature has recognized the ongoing state of emergency due to the COVID-19 pandemic and has responded by creating an additional means for public meetings to be held via teleconference (inclusive of internet-based virtual meetings); and WHEREAS, on September 16, 2021, the California legislature passed Assembly Bill (“AB”) 361, which amends Government Code, section 54953 and permits a local agency to use teleconferencing to conduct its meetings in any of the following circumstances: (A) the legislative body holds a meeting during a proclaimed state of emergency, and state or local officials have imposed or recommended measures to promote social distancing; (B) the legislative body holds a meeting during a proclaimed state of emergency for the purpose of determining, by majority vote, whether as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees; or (C) the legislative body holds a meeting during a proclaimed state of emergency and has determined, by majority vote, pursuant to subparagraph (B), that, as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees; and WHEREAS, in order for the Governing Board to use teleconferencing as allowed by AB 361 after October 1, 2021, it must first adopt findings in a resolution, allowing the Governing Board to conduct teleconferenced meetings for a period of thirty (30) days; and WHEREAS, Governor Gavin Newsom declared a state of emergency for the State of California due to the COVID-19 pandemic in his order entitled “Proclamation of a State of Emergency,” signed March 4, 2020; and WHEREAS, the Governing Board previously adopted Resolution Number 2021-01 on October 26, 2021, finding that the requisite conditions exist to conduct remote teleconference meetings in accordance with Government Code section 54953(e); and WHEREAS, the Governing Board is conducting its meetings through the use of telephonic and internet-based services so that members of the public may observe and participate in meetings and offer public comment; and {SR649035}  WHEREAS, as a condition of the continued use of the provisions found in Government Code section 54953(e), the Governing Board must reconsider the circumstances of the state of emergency and find that either it continues to directly impact the ability of the members to meet safely in person, and/or state or local officials continue to impose or recommend measures to promote social distancing; and WHEREAS, the County of Monterey continues to require and/or recommend certain social distancing requirements of people within Monterey County, as described in detail in the “Recommendation Regarding Social Distancing Including Remote Meetings of Legislative Bodies,” issued by the Monterey County Health Department on September 22, 2021; and NOW THEREFORE, BE IT RESOLVED, that the recitals set forth above are true and correct and fully incorporated into this Resolution by reference. AGENCY BUSINESS RECEIVE ARROYO SECO GROUNDWATER SUSTAINABILITY AGENCY GENERAL MANAGER’S STATUS REPORT General Manager Weeks gave a report on the Implementation Committee meeting for the forebay. He stated that the Committee discussed the selection of a member from the Implementation Committee to the newly appointed Advisory Committee for the Salinas Valley Basin GSA and stated that Jerry Lohr was selected to represent the Forebay. He stated that he would be representing the Arroyo Seco GSA. He also discussed the Advisory Committee’s roles and responsibilities. He discussed the two wells and their locations that the Committee would like to have; one along the Arroyo Seco River and the other close to the Salinas River in the north section closer to the east side. Board Member Wood asked about the cost of the monitoring well and who would be paying for it. General Manager Weeks stated that it would depend on where it was located and stated that anything that happened in our area could be submitted to the Salinas Valley Basin GSA for reimbursement; however, the Agency would be seeking grant funds. He stated that the monitoring wells could be up to $50,000. Vice Chair Griva gave an example of the costs of drilling a well. Chair Thorp stated that it would be ideal to use an existing well. July 26, 2022 GSA Minutes Page 2 General Manager Weeks stated that the Committee also discussed the management actions and projects and adoption of a policy that would protect the unregulated nature of the Arroyo Seco River as well as discussion of the Salinas River maintenance program. General Manager Weeks stated that the Salinas Valley Basin GSA was developing their own integrated implementation plan and stated that as soon as it was ready, he would run it through the Arroyo Seco GSA Advisory Committee and Board. AGENCY BUSINESS RECEIVE ARROYO SECO GROUNDWATER SUSTAINABILITY AGENCY GENERAL MANAGER’S STATUS REPORT General Manager Weeks stated that the Salinas Valley Basin GSA Advisory Committee had its first meeting last week and he reported on that meeting. He stated that they did review the integration implementation plan. He stated that the Plan was reliant on the Salinas Valley Integrated Groundwater Model and that model as been shown to not be as accurate as the Board would like. There was discussion regarding the accuracy of the report and the Advisory Committee voted not to support the plan go before the Board of Directors. He stated that Salinas Valley Basin GSA would be discussing this item on their September agenda. There was additional discussion regarding the model. He also stated that he was still gathering information on the Arroyo Seco River watershed protection policy in keeping it unregulated. He also that the Governor of California had put in the executive order that mandated that the GSAs were now in the loop for approving all new wells. He stated that the Salinas Valley GSA had already taken action on this item and stated the only boundary for the Arroyo Seco GSA was the City of Greenfield. He stated that he and Donna Meyers needed to speak about the authority which this Board had vested in the Arroyo Seco Management area and their comfort level to delegate that authority to the Arroyo Seco GSA. He stated that it was not called out in the implementation and would be taking it to the Advisory Committee in September. He also gave an update on the meetings in September – September 21, 2022 Special Advisory Committee and September 22, 2022 a Coordination meeting. August 23, 2022 GSA Minutes Page 2 Tom Virsik stated he was surprised at the Advisory Committee’s action. He stated that the representatives from the north were less interested in the model and more in the comparisons of all the GSPs. He stated that he was surprised because the model had not changed and it was interesting that the Advisory Committee would vote that way. Nancy Isakson, Salinas Valley Water Coalition, stated that she had a different take on the meeting. She stated that the concern was the data. She stated that there was some benefits to the comparison of all the GSPs together; however, they were not one basin and it was important to make sure the data was accurate and more information. She also agreed that the Arroyo Seco GSA should consider using the well form adopted by the Salinas Valley Basin GSA. ADJOURNMENT Meeting adjourned at 4:26 p.m. __________________________ Chair of the Board ___________________________ City Clerk of the City of Greenfield  City of Greenfield Arroyo Seco Groundwater Sustainability Agency MEMORANDUM: September 23, 2022 AGENDA DATE: September 26, 2022 TO: Board Members FROM: Curtis Weeks, General Manager TITLE: CONSIDER ADOPTION OF A RESOLUTION CREATING A PROCEDURE TO COMPLYWITH THE GROUNDWATER WELL VERIFICATION REQUIREMENTS IN GOVERNOR NEWSOM’S EXECUTIVE ORDER N-7- 22. BACKGROUND On March 28, 2022, Governor Newsom issued Executive Order N-7-22 addressing continuing drought conditions in California. Paragraph 9 of the Executive Order creates a role for groundwater sustainability agencies (“GSAs”) in the groundwater well permitting process, a role of which GSAs have heretofore not played. Paragraph 9 (a) provides, in relevant part, that a well permitting agency shall not “[a]pprove a permit for a new groundwater well or for alteration of an existing well in a basin subject to the Sustainable Groundwater Management Act and classified as medium- or high-priority without first obtaining written verification from a Groundwater Sustainability Agency managing the basin or area of the basin where the well in proposed to be located that groundwater extraction by the proposed well would not be inconsistent with any sustainable groundwater management program established in any applicable Groundwater Sustainability Plan adopted by the Groundwater Sustainability Agency and would not decrease the likelihood of achieving a sustainability goal for the basin covered by such a plan.” The Executive Order provides that paragraph 9 does not apply to “permits for wells that will provide less than two acre-feet per year of groundwater for individual domestic users, or that will exclusively provide groundwater to public water supply systems as defined in section 116275 of the Health and Safety Code,” the latter being a system with 15 or more service connections or that regularly serves at least 25 individuals daily at least 60 days out of the year. The Arroyo Seco Cone Management Area managed by the ASGSA is designated as a medium priority basin and as required by the Sustainable Groundwater Management Act (“SGMA”), the ASGSA has adopted the Forebay Subbasin Groundwater Sustainability Plan (“GSP”). The Forebay Subbasin GSP describes sustainable management criteria and sets forth a menu of management actions and projects that can be implemented to achieve sustainability by2042 as required by SGMA and maintain it thereafter. All these elements, along with required GSP annual reports and updates, constitute the “sustainability program” for each subbasin as mentioned in the Executive Order. In Monterey County, the County of Monterey, Environmental Health Bureau (“EHB”), is the primary well permitting agency, and the Monterey County Water Resources Agency provides some support to the County in that regard. DISCUSSION: It is recommended the Board adopt an appropriate procedure and provide direction to the Staff on how to handle referrals of well applications from well permitting agencies. Staff has the necessary qualifications, in consultation with appropriate technical experts and Agency Counsel, to review and respond to the well permitting agency with respect the Executive Order. The proposed resolution therefore delegates to staff the obligation to respond. The ASGSA Advisory Committee has recommended that the Board adopt the enclosed resolution and verification form. As mentioned, the resolution delegates to staff the duty to respond to a referral from a well permitting agency. The resolution proposes to adopt a template that has been developed with input from agricultural stakeholders and the Monterey County Environmental Health Bureau and is Attachment 2 to the resolution. The response from the ASGSA is either, in the words of the Executive Order, that extractions will not be inconsistent with the sustainability program in the subbasin’s GSP and will not otherwise decrease the likelihood of achieving sustainability in the subbasin, or that extractions would be inconsistent or decrease the likelihood of achieving sustainability. Finally, because the ASGSA is uniquely qualified to comment on the likelihood of a well causing subsidence, the template has a place for the ASGSA to indicate whether it won’t. Consideration of a referral from a well-permitting agency will require some staff time, and maybe consultant time. The draft resolution charges staff to develop an appropriate fee, to be charged directly to the applicant or through the well permitting agency, to recover the costs of the review and response. It is proposed that the ASGSA will recharge the same amount for verification as does the SVBGSA. RECOMMENDATION: 1. Staff recommends the ASGSA Board adoption the Resolution to Comply with Governor’s Well Permitting Verification Process and provide staff direction to use the attached Verification Form.
