CITY COUNCIL MEETING DECEMBER 12, 2022 The Greenville City Council convened in the Council Chamber of City Hall on Monday, December 12, 2022, at 5:30 p.m. for a regular Council meeting. Mayor Dexter McLendon called the meeting to order. City Clerk – Treasurer Dee Blackmon call the roll and recorded the following members present: Mayor McLendon, Councilmembers Bryan Reynolds, Ed Sims, Joseph West, Jae’Ques Brown, and Boris Thigpen. Mayor McLendon led those attending in the Pledge of Allegiance to the American Flag. Jae’Ques Brown delivered the invocation. APPROVAL OF MINUTES: Mayor McLendon advised each councilmember had received for review a copy of the proposed minutes for the Regular Council Meeting held on November 28, 2022. He asked if there were any additions, deletions or amendments to the minutes as presented. Councilmember West moved to dispense with the reading of the minutes and approve the minutes for November 28, 2022, as drafted . Councilmember Brown seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. PROCLAMATIONS and PRESENTATIONS : NEW BUSINESS: ORDINANCE 2022-03. AN ORDINANCE AUTHORIZING THE OPERATION OF MEDICAL CANNABIS DISPENSING SITES. Councilmember Sims moved that all rules governing the Council which might, unless suspended, prevent the passage and adoption of Ordinance 2022-0 3 at this meeting, be suspended for the purpose of permitting the said ordinance be finally passed and adopted at this meeting. Councilmember West seconded the motion. Mayor McLendon called for a roll call vote to suspend the rules: Mayor McLendon Aye Councilmember Reynolds Aye Councilmember Sims Aye Councilmember West Aye Councilmember Brown Aye Councilmember Thigpen Aye Mayor McLendon declared the motion to suspend the rules passed . Mayor McLendon introduced Ordinance 2022-03 regarding the Medical Cannabis Dispensing Sites within the Corporate Limits of the City of Greenville. Dispensing sites require opt-in. A dispensing site may not operate in the unincorporated area or a county or in a municipality that has not adopted a resolution or ordinance authorizing the operation of dispensing sites under §20-2A-51, Code of Alabama 1975 (as amended). This ordinance must be approved by December 31, 2022. This approval only means that the city is willing to be a possible site within the state. No more than five (5) companies will be selected for an integrated license, which means from seed to sale, in the State of Alabama. No more than twelve (12) cultivator licenses, four (4) processor and dispensary licenses will be awarded in the entire state. This ordinance only means that the city will be open for business if an approved company selects us. The rules and regulations that the city will require will be determined at a later date. Mayor McLendon asked if that was correct and Attorney Brandon Simmons stated yes. Councilmember West asked Police Chief Justin Lovvorn how this would affect the police department? Chief Lovvorn stated it is unavoidable, but it will not be anything the officers can’t handle. Councilmember Thigpen asked is it the same as a doctor giving an opioid prescription? Chief Lovvorn stated yes it is the same. For a doctor to prescribe medical cannabis will be a much stricter process than opioid prescriptions. Councilmember Reynolds stated it isn’t available to smoke, it will be available in these forms; tablets, capsules, tinctures, gels, oils, and creams for topical use, suppositories, transdermal patches, nebulizers, liquids or oils for use in an inhaler. Mayor McLendon asked if there were any more questions or comments. Hearing none Mayor McLendon called for the pleasure of the council. Councilmember West moved to place Ordinance 2022-0 3 into final passage. Councilmember Reynolds seconded the motion. RESOLUTION 2022-75. A RESOLUTION AUTHORIZING THE DECLARATION OF CERTAIN PERSONAL PROPERTY OWNED BY THE CITY AS SURPLUS AND CONTRIBUTION OF SAME. Mayor McLendon stated that the Police Department has a 2011 Ford Crown Vic, and the Fire Department has a 1995 Cargo Trailer and a 1991 Pierce Pumper Ladder Truck that is no longer needed for municipal use and the city wishes to declare it surplus. Resolution 2022-75 would declare them surplus city property and authorize the transfer of the 2011 Crown Vic Vehicle to Lowndes County Coroner, the 1995 Cargo Trailer to the Butler County Forestry Planning Commission, and the 1991 Pierce Pumper Ladder Truck to the Town of Georgiana, all “as is” and at no charge. Mayor McLendon stated the Town of Georgiana Mayor is planning on declaring their Ladder Truck surplus after getting ours and donating it to the Town of Mckenzie. Mayor McLendon asked if anyone else has questions or comments. Hearing none, Councilmember Brown moved to adopt Resolution 2022-75 authorizing the declaration of certain personal property owned by the city as surplus and contribution of same to the Lowndes County Coroner, Butler County Forestry Planning Commission and Town of Georgiana. Councilmember Sims seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the council. RESOLUTION 2022-76. A RESOLUTION APPROVING TRANSFER (NEW OWNER) OF ABC LICENSE TO 3S SOUTHERN SPIRITS AND BREW LLC d/b/a 3S SOUTHERN SPIRITS AND BREW FOR LOUNGE RETAIL LIQUOR – CLASS II (PACKAGE) (#011). Mayor McLendon explained Resolution 2022-76, 3S Southern Spirits and Brew LLC d/b/a 3S Southern Spirits and Brew located at 81 Jameson Lane has applied for a Lounge Retail Liquor – Class II (Package) (#011). Mayor McLendon asked if anyone else has questions or comments. Hearing none, Councilmember West moved to adopt Resolution 2022-76, approving an ABC License for the 3S Southern Spirits and Brew. Councilmember Thigpen seconded the motion. Mayor McLendon announced the motion carried with a unanimous vote of the Council. APPROVAL OF EXPENDITURES: Mayor McLendon explained the following expenditures and asked City Clerk – Treasurer to further explain Harris Local Government, which she stated it is the accounting software for the City Clerk’s office and requires a yearly maintenance contract in order to receive updates. Mayor McLendon asked if anyone has questions or comments. Hearing none, Councilmember Thigpen made a motion to approve the following expenditures: JDM SERVICES - $7,086.92 (BUDGETED ITEM) RESTORATION & REPAIRS TO PIONEER CEMETERY HARRIS LOCAL GOVERNMENT - $22,064.22 (BUDGETED ITEM) ACCOUNTING SOFTWARE MAINTENANCE FROM 12-1-22 THROUGH 11-30-23 CIVIC PLUS - $4,688.38 (BUDGETED ITEM) WEBSITE HOSTING ANNUAL FEE Councilmember Brown seconded the motion. Mayor McLendon announced the motion passed with unanimous vote of the Council.
