Borough of Greenville Council Minutes 04.13.10 MINUTES OF A REGULAR MEETING OF THE BOROUGH OF GREENVILLE COUNCIL HELD IN COUNCIL CHAMBERS Tuesday, April 13, 2010 at 6:30pm 1. Call to Order Council President Shipley called the meeting to order at 6:33pm. 2. Invocation: Pastor Tom Ciccarella, New Beginnings Christian Church Pledge of Allegiance 3. Roll Call: Brian W. Public Comments/Public Participation Ron Bulboff, 116 Shenango Street, reports his neighboring property still has code violations and asked if anything was being done. Mayor Candela replied the matter has been referred to the local district magistrate, a hearing was held about one week ago and the property owner has been given thirty days to comply. Joseph Brown, 120 Shenango Street, complained of dogs running loose. Mr. Brown was advised to contact the police department. 1 Borough of Greenville Council Minutes 04.13.10 Monica Kelley & Karen Girosk, participants in Greenville Area Ladies Softball (GALS), commented the group does not want to move from the Sports Complex to Cooper field. Mike McCormick, Men’s Softball, inquired about using GALSA/Borough equipment to maintain playing fields. The group wanted to know who they should report to. Council President Shipley called on Mr. Graubard. Mr. Graubard responded the borough is grateful for the dedicated volunteers that prepare and maintain fields. The borough has a limited maintenance budget for repairs and there are liability issues with persons other than borough employees using equipment. Borough employees receive training on all mowers. The borough can send an employee as needed to assist in field preparation. Mr. McCormick said an equipment meeting was held with all volunteers. Mr. Graubard regrets missing that meeting, reiterated the borough’s position and said going forward he is very willing to work together. Becky McFadden, 204 Lynwood Drive, reported many years ago when the Sports Complex was built the players labored on the fields and still maintains them today. Linda Zuschlag, 21 Lancaster Avenue, is an employee of Kids Korner located in the Recreation Center. She asked if the YMCA comes in, will the daycare be able to remain on the premises. Council President Shipley assured her there will be no change. Joe Ribley, 140 Main Street, suggested Mr. Graubard choose two people from each group to be trained to operate equipment at the Sports Complex. Kate Yasgur, 193 Clinton Street, congratulated the borough on providing information on current issues to the public. She commended council on the recent settlement on litigation regarding the Waste Management contract. Randy Ferguson, 218 Vernon Road, requested council table discussion on signing an agreement with YMCA. He suggested more involvement by the public throughout the process instead of “pushing this thing through.” Mr. Ferguson asked the following questions: why the residents of Greenville have seen no survey; why has the public not seen a copy of the agreement; why is United Way funding GALSA through YMCA, which is premature. He requested council exercise due diligence. 5. Approval of Minutes Motion by Councilor Urey, seconded by Councilor Peden, that the minutes of the March 9, 2010 meeting be approved as written. Motion carried. 6. Budget Report Motion by Councilor May, seconded by Councilor Auchter, to approve the budget report. Motion carried. 7. Motion carried. 8. Mayor’s items Mayor Candela called David W. Reimold into the well and administered the oath of office as a Greenville/West Salem police officer. 9. Council reports A. Treasurer’s report for March 2010 B. Police report for March 2010 C. Fire report for March 2010 D. Public Works report for March 2010 E. Code Officer report for March 2010 F. GALSA agenda for April 12, 2010 meeting Motion by Councilor Auchter, seconded by Councilor Urey, to accept the monthly reports as presented. Motion carried. 10. Reports from Council Committees Councilor Jones, representative to the Library & Strayhaven, attended their March meetings. Anthony D’Alfonso attended the Library board meeting and gave a brief report on the Canal Museum March meeting. Councilor May, representative to the Chamber of Commerce, reported he attended their April meeting. Councilor Auchter reported her attendance at GALSA’s meeting last evening. Several items are on tonight’s agenda regarding GALSA. Mayor Candela announced he will be unable to attend the Greenville Area Economic Development meeting and requested he be replaced. 3 Borough of Greenville Council Minutes 04.13.10 Councilor D’Alfonso, representative to the Railroad Park Board, announced their 25th Anniversary. The next meeting of the Greenville Water Authority Board is tomorrow and the public always welcome. Councilor Urey reported his attendance at last evening’s GALSA meeting. He also attended the Planning Commission meeting and they will begin discussion on several ACT 47 team recommendations. The Airport Commission will not meet in April. 11. Unfinished Business A. The Zoning Hearing Board has two openings to serve for a three (3) year term. B. Motion by Councilor Urey, seconded by Councilor Auchter, to appoint Scott J. Andrejchak as Borough Secretary effective April 15, 2010. Motion carried. C. Motion by Councilor Peden, seconded by Councilor Auchter, to appoint Scott J. Andrejchak as Open Records Officer effective April 15, 2010. Motion carried. D. Motion by Councilor Auchter, seconded by Councilor Peden, to appoint Scott J. Andrejchak as alternate representative to the Metropolitan Planning Organization (MPO). Motion carried. E. Motion by Councilor Urey, seconded by Councilor Peden, for a first and final reading of Ordinance 1490 on parking amendments. Motion carried. F. Motion by Councilor Auchter, seconded by Councilor Urey, to enact Ordinance 1490 on parking amendments. Motion carried. G. Motion by Councilor Auchter, seconded by Councilor Urey, to award the apparent low bid of $41.30/ton for sludge removal at the Waste Water Treatment Plant for a three year period, from May 1, 2010 through April 30, 2013, to Allied Waste Services of Youngstown, Ohio. Motion carried. H. There was discussion regarding a motion to authorize the council president to execute a management agreement with YMCA to provide executive director services for recreation in the Greenville area at no cost to the borough. Council consented to enter into an agreement, but want to see the document before approval. Councilors Auchter, Urey, Jones and Shipley instructed the solicitor on items for inclusion in the agreement. Motion by Councilor Peden, seconded by Councilor Urey, to table execution of a management agreement with YMCA until the solicitor’s copy of the agreement is reviewed by all council members. Motion carried, with Council President Shipley registering a dissenting vote. 12. New Business A. Motion by Councilor May, seconded by Councilor Jones, to forward Ordinance 1145, which establishes the structure of the GALSA Board, to the solicitor for revision for the purpose of creating a Greenville Area Recreation Commission. Motion carried. 4 Borough of Greenville Council Minutes 04.13.10 B. There was discussion on a motion to authorize borough council president to enter into an agreement with Greenville Area Ladies Softball (GALS) for one (1) year. The agreement was proposed in response to sharing fields with other groups. There was general agreement to instruct GALSA and GALS to work together to remedy the situation. There was no action taken on the motion. C. Council President Shipley announced Greenville Memorial Swimming Pool will not open in 2010. Councilor Urey reported after careful scrutiny of the facilities the GALSA board concluded the pool unsafe. Councilor Jones commented we are fortunate to close the pool now before someone is injured and the pool is past recommended service life. Council President Shipley suggested working toward opening a new facility. D. Motion by Councilor Urey, seconded by Councilor May, to accept the tax collector’s report of 204 additions to the Per Capita roll and 264 exonerations in the amount of $1,320.00 from the Greenville Tax office. Motion carried. E. Motion by Councilor Auchter, seconded by Councilor Urey, to accept the recommendation from Chief Stephens for the resignation of part time police officer Robert D. Muschick effective March 19, 2010. Motion carried. F. Motion by Councilor Jones, seconded by Councilor Auchter, to accept the recommendation from Chief Stephens for the resignation of Michael D. Black as parking enforcement attendant effective April 2, 2010. Motion carried. G. Motion by Councilor Urey, seconded by Councilor Auchter, to accept the recommendation from Chief Stephens to hire Amanda Hauser as part time parking enforcement attendant at $9.50/hour effective April 14, 2010. Councilor Jones called upon Chief Stephens about how many hours she will work. Chief Stephens replied, 25 hours a week, 5 hours a day. Motion carried. H. Motion by Councilor Auchter, seconded by Councilor Urey, to accept the recommendation from Chief Thompson for the resignation of Ken Taggart as part time fire fighter effective March 20, 2010. Motion carried. I. Motion by Councilor Urey, seconded by Councilor Auchter, to accept the resignation of fire fighter Rob Ensminger effective April 13, 2010. Motion carried. J. Motion by Councilor Urey, seconded by Councilor Auchter, to advertise bids for mowing of borough properties. Councilor Jones asked who is mowing temporarily as needed. Council President Shipley called on Mr. Graubard. He replied our parks employee, but Public Works employees may be called upon to mow if necessary. Motion carried. K. Motion by Councilor Urey, seconded by Councilor Auchter, to enter into a contract with Verizon Wireless for cellular telephones for borough employees. Councilor Jones verified the new contract was reduced by three cellular telephones. Motion carried. 5 Borough of Greenville Council Minutes 04.13.10 L. Motion by Councilor Urey, seconded by Councilor May, to request bids to sell the fire chief car. Motion carried. M. Motion by Councilor Urey, seconded by Councilor Auchter, to accept the recommendation from airport commission to forward final payment to Saeler Construction for the airport snow removal equipment building, total $36,495.50. Motion carried. N. Motion by Councilor Jones, seconded by Councilor Urey, to grant permission to First United Methodist Church for use of Central Park on Saturday evenings from June 13 through August 29 for music programs/worship services. Motion carried. O. Motion by Councilor Jones, seconded by Councilor Urey, to grant permission for a rally in Central Park on May 5th to Paul Huber, a candidate for Congress. Motion carried. P. Motion by Councilor Urey, seconded by Councilor Auchter, to accept the recommendation from Scott Graubard, Public Services Director, to hire Steven A. Miller as Waste Water Treatment Plant laborer at $11.71/hour. Motion carried. Q. Motion by Councilor Urey, seconded by Councilor Auchter, to disburse 2010 budgeted donation of $250 to Penn-Ohio Young Actor’s Playhouse. Motion carried. R. Council President Shipley announced the portion on Resolution 2010-06 regarding building inspection fees has been completely deleted. Motion by Councilor Urey, seconded by Councilor Peden, to adopt Resolution 2010-06 on amended building fees. Motion carried. 13. Council comments Councilor Jones displayed the new Farm Market sign that features different hours on Wednesdays, from 11-6. Councilor Jones suggested those wishing to make public comments be provided a sign in sheet that will be handed to council president at the beginning of the meeting, allowing visitors to comment during council consideration. Councilor May welcomed Officer Reimold and encouraged all to keep working on the recreation center issues. Councilor Urey commended staff for key decision making during the interim without a borough manager. Councilor Urey welcomed Mr. Andrejchak as new borough manager and Council President Shipley asked him to address council. Mr. Andrejchak is very excited to be coming to Greenville. He is establishing residency in the borough and thanked council and the community for their vote of confidence. Mr. Andrejchak will be getting up to speed on borough issues and noted the challenge will be discerning the nuances of issues. He will look into funding for the pool. Mr. Andrejchak concluded he will do the best he can. 6 Borough of Greenville Council Minutes 04.13.10 Council President Shipley commended Mrs. Little, Mrs. Vale and department heads for their support during the interim between borough managers. He also reminded residents of the U. S. Census, encouraging participation. Council President Shipley announced local taxes and forms are available on line at www.keystonecollects.com. Saturday, April 17th Thiel College’s new president, Dr. Troy vanAken, will be inaugurated. 14. Adjournment to Executive Session Having no other business before council, motion by Councilor Urey, seconded by Councilor Auchter, to adjourn the meeting at 8:27p. Motion carried.
