Call to Order by Mayor Westcamp at 6:30 p.m. Staff Present: Marsha Hall - Administrator, Kevin Shannon - Law Director, Jeff Green - Director of Finance, Ralph Portier - Chief of Police Guests Present: The Guest Book is on file with the Clerk of Council. II. Moment of Silence The Mayor asked everyone to join him in a moment of silence. III. Pledge of Allegiance Chief Portier led the Pledge of Allegiance. IV. Roll Call Council Member Rarey arrived at 6:30 p.m. Present: 6 - Council Member Cleary, Council Member Dildine, Council Member Drury, Council Member Hilbert, Council Member Rarey, and Council Member Stoots V. Approval of Minutes - August 12, 2013 Approved as submitted. #079-2013 8-12-13 Minutes Attachments: 8-12-13 Council Meeting (final).pdf VI. Business of Guests A. Groveport Road Mrs. Blankenship of 6080 Old Groveport Rd addressed Council regarding the condition of Old Groveport Road (photos and map attached). If maintenance is not done now it will only be more City of Groveport Page 1 City Council Meeting Minutes - Final August 26, 2013 costly to maintain later. The corporation line runs down the center of the road part Obetz and part Groveport. She expressed her concerns of the safety of driving on this road. Mayor Westcamp referred the matter to Administrator Marsha Hall. B. Crosswalks James H. Chilton of 4918 Founders Dr. expressed concerns with students at the high school. He inquired if the speed limit on SR317 could be reduced during school start and end times. Law Director Shannon responded that it is a jurisdictional matter with ODOT as to the speed limit and they would have to confer with ODOT to inquiry about looking into the matter. Mr. Chilton asked about a crosswalk, Public Works Superintendent Moore stated that crosswalks are not permitted on state routes with no pedestrian or bicycle traffic. Council Member Hilbert commented it was a school zone and Chief Portier stated it is not a designated school zone due to its location on a state highway. Mr. Chilton asked about the possibility of putting in sidewalks, Ms. Hall advised that Groveport Corporation limits go to south of Williams Rd. and while a sidewalk could be built in front of the high school it would go to nowhere. She explained the process of starting such a project and stated it would not be easily accomplished. The City will do anything temporarily too ease the situation but the City cannot make permanent changes on SR317 without ODOT approval. Executive Session Law Director Shannon requested Council consider going into executive session pursuant to O.R.C. Section 121.22(G)2, to consider the purchase of property for public purposes and also conferences with the attorney under O.R.C. Section 121.22(G)3 for the public body concerning disputes involving the public body that are subject of pending or imminent court action to include Council, the Mayor, Chief Portier, Administrator Hall, Public Works Superintendent Moore and himself. A motion was made by Council Member Cleary, seconded by Council Member Dildine at 6:39 p.m. to go into Executive Session according to the Law Director's request to include the Mayor, Council, Administrator, Law Director, Chief of Police and the Public Works Superintendent. C. 1st Readings ORD. 13-037 AN ORDINANCE ACCEPTING THE FINAL PLAT FOR THE GROVEPORT SENIOR VILLAGE (PARCEL NO. 185-002762) Sponsors: Hilbert City of Groveport Page 3 City Council Meeting Minutes - Final August 26, 2013 Attachments: ORD. 13-037 EXHIBIT.pdf Todd Valentine ltr to Council.pdf Todd Valentine of LW Associates Inc. updated Council on the Groveport Senior Village Project. Building permits will be submitted this week and drawings from the engineer will be acquired this week or early next week. Construction will contingently start in October 2013. If Council will consider approval of the plat as an emergency it will speed up the start date of the project to October rather than November. Council Member Cleary inquired about the need for a traffic study. Mr. Valentine stated according to Franklin County a study was not necessary. Law Director Shannon advised Council first they needed a recommendation from Planning & Zoning. Contingent on the recommendations of the Planning & Zoning Commission, Council would have the second reading at the next Council meeting where they could suspend the rules as to the three readings and the effective date would be 30 days, putting the start of the project in the second week of October. In regards to emergency legislation, Ohio courts reference what constitutes an emergency measure and Council will need to determine if this legislation falls within those stipulations. This Ordinance was referred to the Planning & Zoning Commission. ORD. 13-038 AN ORDINANCE AUTHORIZING THE CITY ADMINISTRATOR TO PREPARE AND SUBMIT AN APPLICATION TO PARTICIPATE IN THE OHIO PUBLIC WORKS COMMISSION STATE CAPITAL IMPROVEMENT AND/OR LOCAL T R A N S P O RTAT I O N IMPROVEMENT PROGRAM(S) AND TO EXECUTE CONTRACTS AS THE WEST BIXBY ROAD PAVEMENT REHABILITATION (PHASE 1) PROJECT AND THE DECLARATION OF AN EMERGENCY Sponsors: Cleary Law Director Shannon requested Council to consider making a motion to suspend the rules as to the three readings and the effective date. A motion was made by Council Member Hilbert, seconded by Council Member Cleary, to suspend the Rules of Council as to the three readings requirement and the effective date of the legislation.
