Call to Order by Mayor Westcamp at 5:30 p.m. Staff Present: Marsha Hall - Administrator, Kevin Shannon - Law Director, Jeff Green - Director of Finance, Ralph Portier - Chief of Police Guests Present: The Guest Book is on file with the Clerk of Council. II. Moment of Silence The Mayor asked everyone to join him in a moment of silence. III. Pledge of Allegiance Chief Portier led the Pledge of Allegiance. IV. Roll Call After Council came out of Executive Session and proceeded to address agenda items, Mr. Beidler was duly appointed by Council under "Other Business" on the agenda. Law Director Kevin Shannon swore in Mr. Beidler upon which he became a voting Member of Council. Present: 6 - Jim Beidler, Shawn M. Cleary, Edward Dildine, Jean Ann Hilbert, Becky Hutson, and Scott Lockett V. Executive Session Law Director Shannon advised a Council Member would like to make a motion to go into Executive Session pursuant to Ohio Revised Code Section 121.22(G)(1) To consider the appointment of a public official to include all members of Council. A motion was made by Council Member Dildine, seconded by Council Member Cleary, to go into Executive Session at 5:31 p.m. pursuant to Ohio Revised Code Section 121.22(G)(1) To consider the appointment of a public official to include all members of Council. Recess Law Director Shannon advised a Council Member would like to make a motion to modify the agenda to move the recess to a latter portion of the meeting. Council would like to move forward on the agenda until the recess for the public hearing. A motion was made by Council Member Dildine, seconded by Council Member Cleary, to modify the agenda to hold off on the recess at this time. A motion was made by Council Member Hilbert, seconded by Council Member Cleary, to adopt. The motion carried by the following vote: Yes: 5- Cleary, Dildine, Hilbert, Hutson and Lockett ORD. 17-011 AUTHORIZING THE ISSUANCE OF NOTES IN THE AMOUNT OF NOT TO EXCEED $1,600,000 IN ANTICIPATION OF THE ISSUANCE OF BONDS FOR THE PURPOSE OF (I) CONSTRUCTING, IMPROVING, FURNISHING, AND EQUIPPING A POLICE FACILITY, AND THE CITY'S CURRENT MUNICIPAL BUILDING, WITH RELATED SITE IMPROVEMENTS AND APPURTENANCES THERETO, (II) DESIGNING, ENGINEERING, AND CONSTRUCTING VARIOUS IMPROVEMENTS TO THE CITY'S MUNICIPAL GOLF COURSE, WITH RELATED SITE IMPROVEMENTS AND APPURTENANCES THERETO, AND RETIRING NOTES PREVIOUSLY ISSUED FOR SUCH PURPOSE; AND APPROVING RELATED MATTERS Sponsors: Dildine Administrator Marsha Hall explained this ordinance is not authorizing the City to borrow more money, it is the third year for the bonds that were issued for work that has already been completed. The City pays it down every year but it has to be rolled over annually. This is not borrowing new money. Clerk of Council Ross read by title Ordinance No.17-011. The motion carried by the following vote: Yes: 5- Cleary, Dildine, Hilbert, Hutson and Lockett ORD. 17-012 AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO ENTER City of Groveport Page 3 City Council Meeting Minutes March 27, 2017 INTO A LICENSING AGREEMENT WITH JOELLEN AND DAVID STEBELTON (THE STEBELTONS) Sponsors: Hilbert Council Member Hilbert asked for clarification on the time span of the licensing agreement. Mr. Shannon advised a licensing agreement is a temporary interest of land. There is no time span but if the City needs access to the property at any time, then the Stebeltons will have to remove the temporary structure. Council Members - Jean Ann Hilbert, Ed Dildine, Shawn Cleary, Becky Hutson and Scott Lockett Council Member Shawn Cleary reported Lawrence "Wally" Gillum, 92 years old, passed away this morning. Mr. Gillum was the Groveport Madison High School Band Director in the 1960s and 1970s. Council Member Hilbert thanked everyone for all the prayers for her husband, Larry, who successfully came through his recent heart valve replacement surgery. Council Member Cleary commented he received the Groveport Annual Report in the mail. All members of Council, the Mayor and Kevin Shannon praised Marsha Hall and Jeff Green for the new look to the annual report. This Annual Report has a lot of very useful information for any newcomers to Groveport. G. Clerk of Council - Ruthanne Sargus Ross Nothing to report. H. Standing Committees None. XII. Other Business A motion was made by Council Member Dildine, seconded by Council Member Cleary, to appoint Jim Beidler to fulfill the unexpired term of Ed Rarey. The motion carried by the following vote: City of Groveport Page 7 City Council Meeting Minutes March 27, 2017 Yes: 5- Cleary, Dildine, Hilbert, Hutson and Lockett Law Director Shannon administered the oath of office to Jim Beidler to fill the vacant council seat of the unexpired term of office of Ed Rarey. Mr. Beidler joined the meeting as a voting Member of Council. XIII. Recess Law Director Shannon requested Council to consider making a motion to recess at this time to hold the Public Hearing on the zoning matter. A motion was made by Council Member Hilbert, seconded by Council Member Cleary, to recess at this time 5:58 p.m. to hold the Public Hearing on the zoning matter. The motion carried by the following vote: Yes: 6- Beidler, Cleary, Dildine, Hilbert, Hutson and Lockett XIV. Reconvene Law Director Shannon requested Council to consider making a motion to reconvene the March 27, 2017 City Council meeting that was previously recessed. A motion was made by Council Member Cleary, seconded by Council Member Dildine, to reconvene the March 27, 2017 City Council meeting at 6:25 p.m. that was previously recessed. The motion carried by the following vote: Yes: 6- Beidler, Cleary, Dildine, Hilbert, Hutson and Lockett ORD. 17-008 AN ORDINANCE AUTHORIZING A MODIFICATION TO THE DEVELOPMENT PLAN FOR 3099 ROHR ROAD, PARCEL NUMBER 185-002965 Sponsors: Hilbert Attachments: ORD. 17-008 Exhibit A.pdf Law Director Shannon requested Council to consider making a motion to amend Ordinance No. 17-008, specifically in Section 1 by adding the following "provided the following conditions set forth by the Planning & Zoning Commission are satisfied: a. That the guard house position if at any time site traffic circulation deteriorates due to excessive queuing of vehicles controlled by the guard house and/or security gates such that the vehicle queuing line extends into the Rohr Road right-of-way, and if the City Administrator declares in writing to the owner and tenant that site traffic conditions City of Groveport Page 8 City Council Meeting Minutes March 27, 2017 represent a public safety hazard, controlled access to the security fenced area shall be discontinued within 24-hours of receiving said notice. In this circumstance, the City will notify the owner and/or their tenant, who will then have 30-days to present and implement an alternative plan for City approval that eliminates the unsafe condition. b. Any future site modification involving the guard house(s), security gates, or similar structures that may affect site traffic circulation is subject to engineering review and approval by the City of Groveport Engineering Department." Business of Guests David Ingram addressed Council on behalf of candidate Glenn Willer for Judge of the Franklin County Municipal Court. Mr. Willer previously served as a special prosecutor for the Village of Groveport, is an army veteran and served on the City of Upper Arlington police force for over 28 years. Mr. Willer is seeking City Council's support and looks forward to serving Groveport again; this time from the bench. Mr. Ingram has worked with Mr. Shannon as prosecutor. He currently works as a Counselor for the State of Ohio Board of Pharmacy. Mr. Shannon added Glenn Willer was a prosecutor intern for Groveport in 1998, a sergeant in the Upper Arlington police force for 30 years and a part-time Prosecutor for Reynoldsburg. Currently, he is a full-time Prosecutor for the City of Columbus. City of Groveport Page 9 City Council Meeting Minutes March 27, 2017 XVI.
