II. Moment of Silence Committee Chair Cleary asked everyone to join him in a moment of silence. III. Pledge of Allegiance Chad Grashel led the Pledge of Allegiance. IV. Madison Township Fire - Interim Chief Fasone Madison Township Fire, Interim Chief Fasone cited statistics from a report he handed out to Council and staff. He looks forward to the opiod conference on April 24th. The Easter Egg Hunt finally went off despite some challenges with Mother Nature. In the next couple of months the new fire station will be in service. Hopefully, once it is up and running, it will take some of the pressure off the fire station in Groveport. Gregory Tilson - Noise Disturbance Gregory Tilson, 273 Madison Street, addressed Council with his concerns with living right next door to the post office. Mr. Tilson was looking for some guidelines or information that would help him to better understand how the City works, primarily what his rights are as a taxpayer to have peaceful and nice living conditions. He bought the house two years ago and he has been waiting for that period when the normal City noises fade into the background. That period has never happened because he believes the noises coming from the post offices are too inconsistent, happening anywhere from 2:00 a.m. to 6:00 a.m. The post office is no longer a post office where mail is dropped off and the semi-trucks go on their way. It has become a hub for package delivery service, much like FedEx and UPS. He talked to the building manager, who relayed the staff's desire to get out of the building because of the situation with Amazon and all the package delivery services in today's world. He looked to Council for help and to find out what the City could do to help him with this situation. Mr. Tilson worked with the City's building department in getting a fence installed, with the costs coming out of his own pocket. The problem is the semi-trucks at all hours of the night. The trucks idle 25' to 30' from his house causing vibrations to be felt in his home. Law Director, Kevin Shannon, advised that typically a City's enacted noise ordinance would cover this type of situation. There is a lot involved in monitoring decimal levels within a particular area over a significant amount of time. Then, there has to be an agreement as to what that decimal level is when it approaches a nuisance level. Then, the City has to pass legislation as it relates to the decimal level approaching nuisance levels. And, that legislation has to take place after a study has been completed. Mr. Shannon explained Mr. Tilson's problem lies in the fact that he is dealing with an agency of the Federal government. The City of Groveport is greatly limited in its ability to regulate said agency in any shape, fashion or form. They basically invoke the supremacy clause of the United States Constitution and say as a federal agency they are not subject to local laws and regulations. Mr. Tilson and City staff could meet with the City of Groveport Page 2 Committee of the Whole Meeting Minutes April 16, 2018 Postmaster to discuss his concerns. Therefore, making some sort of an attempt to see if they could do anything to help his circumstances. Groveport does not have a noise ordinance. Even if the City did have such an ordinance, it couldn't be enforced. This concerns the actual operations of the post office on property that they own. Mr. Tilson indicated he wanted to start this quest by speaking with the Groveport Postmaster. If that avenue hits a brick wall, he will go to our State Representatives, state and federal agencies and/or Congressmen. He will go to anyone for a resolution but he asked that the City of Groveport help him approach the aforementioned. Mr. Shannon offered to assist Mr. Tilson in any manner he can. VII. Ordinances and Resolutions A. 3rd Readings ORD. 18-015 AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO PARTICIPATE IN THE STATE OF OHIO COOPERATIVE PURCHASE PLAN THEREBY WAIVING COMPETITIVE BIDDING PURSUANT TO GROVEPORT CITY CHARTER SECTION 9.02(B) Sponsors: Hutson This Ordinance pertains to the City obtaining road salt for snow and ice season. The motion carried by the following vote: Yes: 6- Cleary,Dildine,Hilbert,Hutson,Lockett, and Grashel ORD. 18-016 AN ORDINANCE REMOVING ONE OF THE PROGRAM COORDINATOR POSITIONS AND CREATING THE POSITION OF ACTIVITIES ASSISTANT II IN THE COMMUNITY AFFAIRS DEPARTMENT, ACCEPTING THE POSITION DESCRIPTION AND PAY GRADE THEREFORE City of Groveport Page 3 Committee of the Whole Meeting Minutes April 16, 2018 Sponsors: Dildine Attachments: Activities Assistant II.pdf Under the current organizational chart there are two Program Coordinators. One of those positions is now vacant and Community Affairs Director, Patty Storts, would like to fulfill the position with a full-time Activities Assistant. The motion carried by the following vote: Yes: 6- Cleary,Dildine,Hilbert,Hutson,Lockett, and Grashel B. 2nd Readings ORD. 18-018 AN ORDINANCE EXTENDING THE MORATORIUM ESTABLISHED IN ORDINANCE NUMBER 17-017 (PASSED 5-24-2017), FOR ONE (1) YEAR ON THE ISSUANCE AND PROCESSING OF ANY PERMITS ALLOWING RETAIL DISPENSARIES, CULTIVATORS, OR PROCESSORS OF MEDICAL MARIJUANA WITHIN THE CITY OF GROVEPORT AND THE DECLARATION OF AN EMERGENCY Sponsors: Cleary The State has most of the program adopted but there are a lot of issues. City staff wants to wait to change Groveport's Zoning Code until the State finalizes the adoption of its rules and regulations on the matter, which will be sometime in July. Groveport may see the need to make changes to those rules and regulations in its zoning code, such as wanting this type of business more than 1000' from a daycare or school, instead of the state's regulated 500'. If this moratorium is not in place, and someone would come in to apply for a permit, without a zoning code in effect dealing with this particular item, the City could find itself in a lawsuit if it refuses to consider applications. At the bare minimum, the City would follow the State law requirements as it relates City of Groveport Page 4 Committee of the Whole Meeting Minutes April 16, 2018 to this matter. But the ability of City Council as the local government to plan out where they want certain businesses to be located would be precluded. No motion was made to recommend approval. ORD. 18-020 AN ORDINANCE APPROVING THE RECODIFICATION, EDITING, AND INCLUSION OF CERTAIN ORDINANCES AS PARTS OF THE VARIOUS COMPONENT CODES OF THE CODIFIED ORDINANCES OF GROVEPORT, OHIO AND THE DECLARATION OF AN EMERGENCY Sponsors: Hilbert Law Director Shannon explained to Council that this Ordinance is the yearly updating of the City's codified ordinances. Financial Report The income tax numbers seem a little low because the City hasn’t received any of the big corporation income tax returns as of yet. Mayor - Lance Westcamp Mayor Lance Westcamp reported that the 4th of July Committee will be meeting on Thursday and Marvin Stevens, who wants to be active in the community, is now on the 4th of July Committee. The Mayor and Council Member Lockett had the honor of attending Turnpoint Church for an open house for Pastor Joe Arata who had served for ten years at the church. The event was well attended. Captain Kurt Blevins reported the Chief went through his surgery well and he was resting comfortably. Captain Blevins reported that on April 3rd the department responded to a stabbing on Hendron Road. Officer Ernie Bell did a great job making the arrest of the suspect, who walked out with the knife in his hand. Officers Kristin Welter, Tiffany Roe and Javier Herrera administered first aid to the victim. The attending doctor stated that due to these officers' actions, they saved the young man's life. This occurred under the command of Sgt. Casey Adams. They all did a great job and the department is very proud of the officers' work. #087-2018 PD Council Report Attachments: PD Council Report.pdf F. Chief Building Official - Stephen Moore Chief Building Official, Stephen Moore, reported City staff, the contractor and the Fire Marshall did a walkthrough of the new high school. The company will turn the school over to the district sometime in May. The plan is to have the seniors staged in the new high school before they come out onto the field. The building department has been working with everyone to make sure there is an occupancy permit and that the building is safe to stage the seniors. The demolition of the old building is due to commence in June or July. After the building is down the contractor will start on the parking lot and ball diamonds. City Engineer - Steve Farst City Engineer, Steve Farst, reported the kickoff meeting for the Hanstein water main is scheduled for tomorrow. The contractor is to commence work in May and the water line project in the Hanstein addition should be completed in July. Council Members - Jean Ann Hilbert, Ed Dildine, Shawn Cleary, Becky Hutson, Scott Lockett and Chad Grashel Council Member, Jean Ann Hilbert, apologized to the community because last week she was upset when she made her vote on the Blacklick Trail. She would never vote against anything recreational for the community and she apologizes. She does not know if she can rescind her vote at this time but she is definitely in favor of the Blacklick City of Groveport Page 8 Committee of the Whole Meeting Minutes April 16, 2018 Trail. She thinks this Council supports recreation for our community members, especially when those in the community come forward. Council should always consider them first. She apologizes again to the community for that vote. Council Member, Chad Grashel, expressed how excited he was to be representing the community. XIII.
