City Council

3 The regular meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, N.J., on Tuesday, February 20, 1990. Mayor Zisa called the meeting to order at 8:00 P. M. and asked everyone to stand for the flag salute. On roll call the following were present: Mayor John F. Zisa, Deputy Mayor Sandra A. Robinson, Councilmen Mauro A. Mecca, Mark A. Stein, City Attorney Richard E. Salkin, City Manager James s. Lacava I and City Clerk Doris L. Dukes. Absent - Councilman Roger B. Mattei Mrs. Dukes: "In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975, adequate notice of this meeting was provided by sending a notice to The Record and posting a copy on the Bulletin Board in City Hall." Mayor Zisa asked for approval of the minutes of the February 5, 8 and 13, 1990 meetings. Motion offered by Mecca, seconded by Stein that the minutes be approved as submitted. Dorothy Schwartz, 47 Prospect Avenue, stated that she was surprised to learn that the previous ordinance had not received State approval and raised several questions as to how this happened. The City Attorney explained that it was discovered during his research into having Clinton Place return to one way. When Ms. Schwartz continued to ask questions relative to this matter, the Manager stated that this happened under a previous administration and therefore he could not answer the questions she was asking. Undertake a remedial action program to effect any and all necessary steps, repairs and/or replacement of the City's combined sewer regulators; and 2. Implement a Sewer Ban Ordinance; and 3. Pay a civil penalty in the amount of $590,000.00 to the State of New Jersey; and WHEREAS, said Administrative Order and Notice of Civil Administrative Penalty arose out of the alleged violations by the City of Hackensack of the terms and conditions of the City's N.J.P.D.E.S. permit on various dates on and between September 15, 1987 and June 8, 1988, to wit: unlawful discharges of sewage into the Hackensack River, and the failure to report same; and WHEREAS, pursuant to the aforementioned Administrative Order, the I City did duly enact the required Sewer Ban Ordinance, and has formally and financially committed to the purchase and installation of state of the art vortex valve type regulators to address the City's decade long quest for a solution to the environmental problems occasioned by the existence of a combined sewer system in the City; and WHEREAS, the City of Hackensack, pursuant to law, did contest the aforementioned Civil Penalty Assessment of $590,000.00 by Appeal to the Office of Administrative Law of the State of New Jersey; and WHEREAS, said Appeal entitled N.J. Department of Environmental Protection vs. City of Hackensack, Docket No. EWR 8313-88, resulted in a plenary hearing being held on December 18, 19 and 20, 1989; and WHEREAS, said hearing is presently in a state of recess, due to the unavailability of a witness for the Department of Environmental Protection; and WHEREAS, said recess has permitted the parties to this ongoing litigation to reassess their respective positions concerning the subject $590,000.00 Civil Penalty Assessment and seek a mutually acceptable settlement of same; and WHEREAS, as a result of ongoing settlement discussions between I the City of Hackensack and the Department of Environmental Protection, a tentative settlement has been reached by and between the parties which, if approved by the Mayor and Council, will reduce the aforementioned $590,000.00 civil penalty to a figure of $172,250.00, payable in two installments one year apart and permit the City to institute a program allowing the issuance of "Construction Only" permits, thereby affording the beginning of relief to the City's tax base which has been devastated by the imposition of the sewer ban; and WHEREAS, in order to effectuate this settlement, it is necessary to authorize Mayor John F. Zisa to execute an Administrative Consent Order by and between the City of Hackensack and the New Jersey Department of Environmental Protection. Mayor Zisa asked the City Attorney if the City could take legal action regarding the shale at 300 Prospect Avenue. He felt we have waited long enough. The City Attorney replied that we could pursue litigation. Certainly Council has been patient in this matter. Councilman Stein also agreed that we should take legal action. A resolution will be prepared for the next Council meeting. Dr. Mecca asked what rule of law applies at this time since we were told the owners were not in violation of any laws. Mr. Salkin said he would research the matter. The Deputy Mayor asked questions of Mr. Salkin relative to such a suit. I Mayor Zisa, relative to a meE�ting held regarding Affordable Housing, said the Housing Authority indicated they would be able to build a number of affordable housin9 units once the moratorium is lifted. He asked that a resolution be prepared asking the Hackensack Housing Authority to pursue that avenue. After much discussion, Mr. Salkin was asked to prepare the resolution for the next Council meeting. Deputy Mayor Robinson raised questions regarding Quail Heights as it relates to the sidewalk along Central Avenue and asked if we could start something on this as well. The Mayor asked Mr. Lacava to update the Council on this issue. The placing of garbage on the curbs on Fridays for a Monday pickup along Summit Avenue was discussed. The Mayor said he went to the doors of the people involved and advised them that this procedure must stop. · Also discussed was the legality of "Open House" signs being posted on City property. Mr. Salkin will look into it. Mr. Stein stated that $590,000. 00 is a lot of money and a lot of trust was placed in our Manager and City Attorney who made the City Council look good when this matter was settled for $172 , 000.00. He I commended Mr. Salkin and Mr. Lacava for the job they did and asked that they relay the same to Mr. Schevon. Mayor Zisa opened the meeting to the public. Dorothy Hackberg, 71 Allen Street, spoke on the subjects of the removal of the shale and the sewer ban. Mayor Zisa responded to her statements. Chambois Roberts, 224 Hamilton Place, said he was pleased to hear that a settlement has been reached with DEP. He also said he would like to see more "WELCOME TO HACKENSACK" signs placed in other entrances of the City.  Eric Martindale, 329 Essex Street, stated his opinions regarding the drainage improvements in Foschini Park and the Mayor's request of the Housing Authority, by way of a resolution, to pursue affordable housing units. He made some derogatory remarks while giving his opinion on affordable housing before the Master Plan is done. The Deputy Mayor took exceptions to Mr. Martindale's derogatory remarks and stated that some of his comments were not true. I Councilman Mecca also stated that he found Mr. Martindale's remarks troubling. Dock Russell, 148 Clay Street, congratulated Mr. Lacava. Ray Dressler, Ross Avenue, spoke at length on the subject of Foschini Park. The Mayor and City Manager responded to Mr. Dressler's comments. Mr. Dressler also asked if something could be done about the high speed of traffic, such as speed bumpers, in the areas of Fairmount School during school hours and early evenings. The City Attorney will check the legality of bumpers. Tom Cohen, 346 Hamilton Place, congratulated those who were responsible for the settlement of the sewer problem and asked the time schedule for the issuance of permits. The City Attorney gave an estimate of a couple of weeks. Mr. Olster, 144 Union Street, also spoke on the shale and workman's compensation insurance. Dorothy Schwartz, 47 Prospect Avenue, congratulated Mr. Lacava on his appointment as Manager. She asked that something be done about I the leaves on Prospect Avenue by the hospital that have been packed down. Mayor Zisa asked the Manager to address the matter.
