r ! The regular meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, N.J., on Monday, March 19, 1990. Mayor Zisa called the meeting to order at 8:00 P. M. and asked everyone to stand for the flag salute. On roll call the following were present: Mayor John F. z isa, Deputy Mayor Sandra A. Robinson, Councilmen Mauro A. Mecca, Mark A. Stein and Roger B. Mattei, City Attorney Richard E. Salkin, City I Manager James s. Lacava and City Clerk Doris L. Dukes. Mayor Zisa asked for approval of the minutes of the February 20th and 27 th c. o. w. and March 5 , 1990 regular meeting. Zisa, Jr.; and WHEREAS, subsequent to the collision, each party filed a complaint against the other for a motor vehicle violation; and WHEREAS, in such circumstances it is the obligation of and the best interest of the . City to provide legal counsel for its police officers; and WHEREAS, such professional services will be rendered or performed by a person authorized by law to practice a recognized profession and whose practice is regulated by law pursuant to N.J.S.A.40A:ll-5 (l) (a) (i) of the Local Public Contracts Law; and I WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the award of contracts for professional services without competitive bids and the contract itself must be available for public inspection; and WHEREAS, it is the desire of the Mayor and Council of the City of Hackensack to retain the services of Edward w. NOW, THEREFORE, BE IT RESOLVED that the City of Hackensack I hereby authorized the Mayor to sign the CP-1 endorsement on behalf of the municipality approving the project. as proposed by the developer. BE IT FURTHER RESOLVED that no construction permits be issued until all permit applications required by any Department or Division of the State of New Jersey have been approved. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa Resolution 1112 WHEREAS, there is a proposal to construct a 4-story office building and two levels of parking at 9 Polifly Road in the City of Hackensack: and WHEREAS, on August 18, 1988, the· State of New Jersey Department of Environmental Protection imposed a sewer connection ban upon any project which would discharge flow into the City's regulator chambers: and WHEREAS, in accordance with the State Department of Environmental Protection regulations, applicants for development are permitted to seek exemptions from said ban: and I WHEREAS, in the opinion of the applicant, the proposed project will not have a significant impact upon the City's sewer system: and WHEREAS, the proposed developmEmt is in conformity with the City's Land Use and Construction Codes. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council hereby endorse this "Application for Exemption from a Sewer Extension Ban", and authorizes that it be forwarded to the Department of Environmental Protection for their consideration.  7S Mayor Zisa asked Mr. Duffy to explain and when he did, the resolution did not correspond with his explanation. Resolution #113 OFFERED BY: ROBINSON SECONDED BY: STEIN WHEREAS, Bernardo Petrocelli is proposing to construct a one-story industrial building with a mezzanine at 146 Division Place I in the City of Hackensack; and WHEREAS, on August 18, 1988, the State of New Jersey Department of Environmental Protection imposed a sewer connection ban upon any project which woulq discharge flow into the City's regulator chambers; and WHEREAS, in accordance with the State Department of Environmental Protection regulations, applicants for development are permitted to seek exemptions from said ban; and WHEREAS, Bernardo Petrocelli has submitted an "Application for Exemption from a Sewer Extension Ban"; and WHEREAS, in the opinion of the applicant, the proposed project will not have a significant impact upon the City's sewer system; and WHEREAS, the proposed development is in conformity with the City's Land Use and Construction Codes. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa Resolution #114 OFFERED BY: STEIN SECONDED BY: MATTEI WHEREAS, there exists a need for the Hackensack Health Department to provide a comprehensive pub! ic health program which includes Childhood Lead Poisoning Control Services; and WHEREAS, such a program includes the provision of screening tests for blood EP (erythrocyte protoporphyrin) levels; and WHEREAS, the City of Paterson's Division of Health Laboratory has the capabilities of analyzing these screening test specimens for EP levels; and WHEREAS, the City of Paterson's Department of Health has agreed to provide analysis of EP specimens for the City of Hackensack through a contract agreement with the City of Hackensack's Department of Health; and WHEREAS, the maximum amount of the contract is $400.00 and funds will be available for this purpose; and I WHEREAS, it has been certified that this meets the statutes and regulations concerning the award of said contract. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack as follows: 1. That the Mayor and City Clerk be and are hereby authorized and directed to execute an agreement with the City of Paterson's Department of Health to provide EP analysis services for the period of April 1, 1990 through December 31, 1990.  2. This contract is awarded without competitive bidding in accordance with N. J.S. A. 40A:ll-5 (2) of the Local Public Contracts Law because the same is an agreement between municipalities and is expressly excluded from competitive bidding and public advertising. 3. I Mayor Zisa asked the Manager, City Attorney and City Council if they wished to speak. They did not.  Mayor Zisa opened the meeting to the public for discussion of City business. Jack Donovan, Willow Avenue, stated there are concerns regarding the quality of education in Hackensack and the school budget. He said there is a group putting together a petition for an elected school board. He asked the Mayor and Council to act on a resolution of endorsement and asked the Mayor to poll the Council for their opinion. Mayor Zisa said he would not ask the Council to make a decision to change fifty-five years of history in one minute. He told Mr. I Donovan that he appreciated him coming forward to discuss the subject. Mr. Donovan said he felt the time has come for a change and would like Council's support. The Mayor replied that he does not know if the Council is prepared to make a commitment. The subject needs to be discussed. Councilman Mattei asked Mr. Donovan, "Don't you think the City Council should weigh the pros and cons involved for an elected board as opposed to an appointed board, a five member board as opposed to a seven member board? You can't expect us to do so tonight." Mayor Zisa advised Mr. Donovan that it would be in his best interest to submit any information he has to the City Council. Deputy Mayor Robinson said she would like an opportunity to have a presentation. Councilman Mecca stated that the subject merits discussion before making a decision. He is concerned about a commitment to excellence that we will have with an elected school board. He shares the concerns of the public and endorsed an elected board. I Dorothy Schwartz, 47 Prospect Avenue, presented comments regarding the rent ordinance as it relates to the fee for filing applications before the board. The Mayor asked the City Attorney to look into the legality of some of the points she raised. Ray Dressler, Ross Avenue, asked Council for a status of his comments at a previous meeting regarding speed bumps and the posting of signs in the area of the Fairmount School during school hours. The Mayor advised him that speed bumps were illegal and the Police Department have had a lot of radar traps on Grand Avenue. Nat Shatzoff, 101 Prospect Avenue, read a communication regarding the rent ordinance as follows: "I have previously addressed you regarding the changes in the Rent Stabilization Ordinance that tenants feel are necessary and fair. "On January 10, 1990, I addressed a letter to our City Attorney, Richard Salkin, at the suggestion of Councilman Mark Stein, regarding yearly rent increases based on the Consumer Price Index (CPI) and the permitted tax surcharge passed along. I explained the tenants' position on these provisions. "At this time I would like to address the Capital Expenditure I provision of the ordinance. The present definition is vague and subject to various interpretations. "Attached is a definition entitled Capital Improvement to replace the term Capital Expenditure used in our ordinance. This definition was drawn up by an attorney and legal advisor to tenants of New Jersey. "A second consideration would be to eliminate the Capital Expenditure provision from the Ordinance. The Fort Lee ordinanc·e no longer provides for Capital Improvements or tax surcharges. "As a representative of tenants in Hackensack I urge you to give serious consideration to these changes in the Rent Stabilization Ordinance as soon as possible.  "Thank you. The Deputy Mayor thanked the City administration for taking care of 240 First Street. It looks great. She then asked Mr. Duffy the status of 245 and 247 James Street. II Mr. Duffy replied that notices have been sent to the property owners and if they don't reply, we will go into court. Relative to the garage, it was recommended that we do what is necessary to clean it up. Mayor Zisa recognized Harry Stosser, a long-time resident and one who was known as the Mayor of Main Street.
