The regular meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central A venue, Hackensack, N. J. , on Monday , April 2, 1990 . May or Zisa called the meeting to order at 8 : 0 0 P. M. and asked every one to stand for the flag salute. On roll call the following were present: May or John F. Zisa, Deputy May or Sandra A. Robinson, Councilmen Mauro A. Mecca, Mark A. Stein and Roger B. Mattei, City Attorney Richard E. Salkin, City I Manager James s. Lacava and City Clerk Doris L. Dukes. Mrs. Dukes: "In accordance with the Open Public Meetings Act, Chapter 231, Laws of 197 5, adequate notice of this meeting was provided by sending a notice to The Record and posting a copy on the Bulletin Board in City Hall. " May or Zisa asked for approval of the minutes of the March 5th C. o. w. meeting and March 12, 19 and 27 , 1990 meetings. Motion offered by Mattei, seconded by Stein that the minutes be approved as submitted. Roll Call: Ay es - Mecca, Robinson, Stein, Mattei, Zisa Mrs. Dukes: "In accordance with the advertisement that appeared in The Record on March 19 and 26, 1990 , as per state statute, the City of Hackensack hereby offers for public sale Lots 27B and 28B in Block 432. "The minimum bid is $5, 0 0 0 . 0 0 . Cash or certified check in the amount of 10 % of bid must be submitted tonight. " The May or called for bids three times. I There were no bids submitted. A motion was offered by Stein, seconded by Mattei that the time for call for bids would be closed. Carried. At a later time in the meeting, a gentleman who was interested in purchasing this property entered the meeting. The May or then, upon legal advice, asked for a motion to reopen the bid. A motion was offered by Mecca, seconded by Stein. Carried. The May or called for bids again three times and Fouad Dakka of 5 Pangborn Place offered a bid of $5, 0 0 0 . 0 0 . There being no further bids, a motion was offered by Stein, seconded by Mecca that the time for bids be closed. A motion was offered by Mattei, seconded by Mecca that the bid of Fouad Dakka be accepted. Mr. Dakka then gave the City Clerk $50 0 . 0 0 in cash which represented 10 % of the bid. The ordinance that we are about to consider for introduction will increase the board members from a five The hearing will be held on I member board to a seven member board. Thursday, April 12th. No other iterns will be discussed except this ordinance. Dr. Mecca said this was Holy Thursday and there may be a conflict with the religious groups. Councilman Mattei stated that he felt that Thursday night would be a good evening to hold the public hearing because the next day would be a holiday for most people. The Deputy Mayor stated that we will be observing Passover on Monday and Thursday the 12th is Maundy Thursday and services will be held at various black churches on that night. She stated that we need . to be consistent. The Mayor pointed out that it was his intent to have as many people as possible present at the meeting. The Mayor asked the Clerk to proceed. A. , to analy ze and evaluate the Fair Share Housing Plan previously promulgated by the Council on Affordable Housing for the City of Hackensack, and should same be indicated, undertake an appeal to the Council on Affordable Housing concerning same; and WHEREAS, it is the belief of the May or and Council that such an evaluation and potential appeal process should be undertaken con concurrently with the Planning Board's consideration of the housing plan component of the Master Plan. . - . . ,_ -- NOW, THEREFORE, BE IT RESOLVED by the May or and Council of the City of Hackensack that Malcolm Kasler and Associates, P. Mr. Duffy elaborated further on this subject. Mrs. Dukes advised the May or that her Docket was completed. , ·� • • 1 / The May or thanked her and asked the City Manager if he had any thing to report. The City Manager stated that Ordinance No. 8 -90 which was introduced on first reading tonight will add grass clippings as a new recy clable which will save! the City a significant sum of money . A letter will be sent to all residents in the near future. The May or asked the City AttornE�Y if he---had .any t-hing to report. He did not. He then asked the members of Council if they wished to speak. Deputy May or Robinson thanked those responsible for having the garbage removed from 245- 247 James .Street, however, there was some II more debris and she asked when would that be removed. Mr· Duffy replied that the wood and the trucks are responsibilities of the State and they would need a roll-off container in order to have this material moved from the site. He will give a report to Council tomorrow. Relative to the Deputy May or's questions on Quail Heights, Mr. Duffy replied that they were to start their construction this week. Relative to the situation on the corner of Third and High Streets, Mr. Duffy reported that th·ey have written to the bonding company and he should be hearing from them very soon. Ms. Robin'son ·asked him when would the Master Plan review be coming up and Mr. Duffy reported that the board would be meeting next week and at that time he should have the schedule. The Deputy May or stated there was a resident who was handicapped living at 13 Newman Street who is receiving summonses on a regular basis. There had been previously installed a handicapped sign where she was parking, however, that sign has now been torn down. She asked Mr. Lacava if he could investigate. Dr. Mecca asked Mr. Lacava how much newspaper and cardboard are we collecting and if we are pay ing dumping fees. The City Manager I said he did not know the amount, but we are not pay ing for dumping fees. When Ms. Robinson asked what is happening with reference to the flood on Central and Third Street, Mr. Duffy stated that the problem should be corrected within three to six weeks, but added that as long as there is construction there would be some flooding. The May or reminded all residents to please complete their census form. The document is confidential and is very important to the City . He also stated that there would be one Board of Education position to  be filled and encouraged any one who would be interested to submit a resume. Dorothy Schwartz, 47 Prospect Avenue, again spoke on the various levels of the Rent Ordinance with special reference to landlords 1 applications and denial of tenants 1 applications. She also referred to the Briarwood Commons complex. I James Bentacourt, 228 Johnson Avenue, complained about the activities and the trash that is taking place in a laundromat near his apartment complex. People are urinating and the laundromat is opened on a twenty -four hour basis, and it is his understanding that, pursuant to the law, it should be opened only until ten o'clock at night. He contacted the Health Department as well as the Building Department and has not received any satisfaction. Laura Bentacourt, 228 Johnson Avenue, Alice Boutk, 228 Johnson Avenue, and David Schaff, 228 Johnson Avenue all had the same complaint. The May or said the matter will be looked into. Councilman Stein added that he was at the meeting of the Zoning Board when this particular subject was discussed extensively . Jack Donovan, Willow Avenue, asked the May or if he would open up the meeting for discussion on the 12th of an elected school board. May or Zisa stated that after the last meeting the City Council felt that there should be an open forum and decided it should be by ordinance. The hearing on April 12th is only for the reason stated I and agreed that the April 12th meeting would be the time to speak on this issue. Ms. Robinson reminded Mr. Donovan that the City Council was supposed to receive some material from him on the matter of an elected school board and Mr. Donovan stated that he had not prepared it, but would see that the material is sent. Rainer Olster, 144 Union Street, spoke at length about the street cleaning on Union Street. Sy lvia Hughes, 218 Prospect Avenue, spoke on the hearing for the ordinance being held on April 12th which is Holy Thursday . She felt it was unfair because people in the Protestant faith would not be present. She spoke on the amount of paper and litter that surround the City which she would like to have removed. It appeared that most of these papers were fliers of some ty pe and Dr. Mecca asked if we would be in violation if the people were asked to put the fliers on the doorsteps. The City Attorney said he would check into it. The Deputy May or reported that there were a group of residents who are instituting a suit against Quail Heights and asked if we could I speak with them or if Mr. Salkin could talk with them.
