City Council

The regular meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, N.J., on Monday, April 16, 1990. Mayor Zisa called the meeting to order at 8:00 P. M. and asked everyone to stand for the flag salute. On roll call the following were present: Mayor John F. Zisa, Deputy Mayor Sandra A. Robinson, Councilmen Mauro A. Mecca, Mark A. Stein, City Attorney Richard E. Salkin, City Manager James s. Lacava I and City Clerk Doris L. Dukes. Absent - Councilman Roger B. Mattei Mrs. Dukes: "In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975, adequate notice of this meeting was provided by sending a notice to The Record and posting a copy on the Bulletin Board in City Hall." FINAL ADOPTION OF ORDINANCE NO. 5-90 ENTITLED: "AN ORDINANCE FIXING AND DETERMINING MUNICIPAL CLASS POSITION TITLES AND SALARY RANGES FOR CERTAIN CONTRACTUAL OFFICERS AND EMPLOYEES OF THE CITY OF HACKENSACK". Mayor Zisa: "This Ordinance has been advertised pursuant to law and now calls for a public hearing. Will someone so move?" Motion offered by Mecca, seconded by Stein that there be a public hearing. Carried. Mayor Zisa asked if anyone present wished to be heard on this Ordinance. Dock Russell, 148 Clay Street, asked for clarification of the Ordinance which was provided him by Mr. Lacava. Motion offered by Stein, seconded by Mecca that the public hearing be closed. Carried. Resolution 1155 OFFERED BY STEIN SECONDED BY: ROBINSON BE IT RESOLVED by the City Council of the City of Hackensack, County of Bergen and State of New Jersey, that Ordinance No. 5-90 entitled: "AN ORDINANCE FIXING AND DETERMINING MUNICIPAL CLASS POSITION TITLES AND SALARY RANGES FOR CERTAIN CONTRACTUAL OFFICERS AND EMPLOYEES OF THE CITY OF HACKENSACK", pass its second and final reading and is hereby adopted. Dr. Mecca asked questions regarding the percentage of the contract and if this will confirm the 30-hour work week for the employees. The City Manager said yes. The Mayor asked if there was anyone who would second the resolution several times. There was no second. A motion was then offered by Stein, seconded by Mecca that the resolution be tabled until the next meeting. Carried. Roll Call: Ayes - Mecca, Robinson, Stein, Zisa I Absent - Mattei Resolution #162 OFFERED BY: STEIN SECONDED BY: ROBINSON WHEREAS, the governing body of the City of Hackensack has been advised that an emergency affecting the safety and welfare of the citizens of the City of Hackensack and the General Public who operate motor vehicles within the City limits of the City of Hackensack, when a traffic signal located at Essex and Summit was accidentally knocked down and rendered inoperable; and WHEREAS, the Chief of Police of the City of Hackensack has furnished to the City Manager a written report setting forth the time, place and circumstances regarding the emergency; and WHEREAS, the governing body is satisfied that an emergency did exist and that immediate action was necessary to restore the aforementioned traffic signal to full operation: and WHEREAS, the cost of the repairs totaled $2, 902.50 which was a fair and reasonable quotation: and I WHEREAS, the Chief Financial Officer has certified that funds are available in Account il0-318-450, Purchase Order 165004. WHEREAS, it is anticipated that the entire cost of this repair may be recovered from the insurance carriers. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that pursuant to N.J.S.A. 40:A:ll-6 which authorizes the governing body to award contracts without benefit of public bidding in emergency situations, and that the vendor Traffic Control Equipment Corp., 242-252 Hudson Street, Hackensack, N. J. 07601, be paid therefor. Roll Call: Ayes - Mecca, Robinson, Stein, Zisa Absent - Mattei Resolution f 163 OFFERED BY: MECCA SECONDED BY: ROBINSON WHEREAS, on January 3, 1989, tlhe City Council of the City of Hackensack did by Resolution #17 award a contract for a Computerized Summons System for the Municipal Court: and WHEREAS, the award was made tc1 Commercial Computer Services, Inc., 4 Sperry Road, Fairfield, New Jersey 07006, as a result of I competitive bidding: and WHEREAS, there now exists a backlog of approximately seventy thousand (70, 000) unpaid summonses which represents a projected revenue of $ 2.2 million dollars for the City: and WHEREAS, Commercial Computer Services has offered a proposal dated March 29, 1990, to amend the existing contract to provide the necessary hardware and software to the Municipal Court and the Police Department using the software system already in place to make this collection processing possible. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that the contract agreement dated January 24, 1989, be amended as follows: 1. Backlog processing for a cost of .66 per summons. 2. Deposits on processing applies only to lapsed summonses processed by CDP for a cost of .65 per summons. 3. Pickup and delivery of backlog work to the Municipal Court, the bank of the City's choosing for a cost of $12.00 per day. BE IT FURTHER RESOLVED that the Chief Financial Officer has I certified that funds are available through the Parking Offense Adjudication Act of 1985, Account 109-999-286. BE IT FURTHER RESOLVED that the Mayor and City Clerk be and they are hereby authorized and directed to amend the existing contract and are directed to retain a copy for public inspection and to publish notice of this action once in The Record. The City Clerk advised the Mayor that she does not have the authorization to amend a contract. The City Attorney then asked for a motion to amend the resolution to re·ad "execute an amendment to the existing contract". A motion was offered by Mecca, seconded by Stein to amend the resolution. Carried.  Resolution 1164 OFFERED BY: STEIN SECONDED BY: MECCA WHEREAS, the City of Hackensack is presently involved in the process ·of designing, constructing, and implementing major improvements to its combined sewer regulatory system: and WHEREAS, this project is now at the point whereby it is necessary· to obtain the requisite engineering services for the construction phase of this project: and WHEREAS, the engineering firm of Clinton Bogert Associates of 270 · I Sylvan Avenue, Englewood Cliffs, New Jersey, has been primarily involved in this project since its initial undertaking in 1988; and WHEREAS, it is the desire of the Mayor and Council of the City of Hackensack to retain the services of Clinton Bogert Associates of 270 . Sylvan Avenue, Englewood Cliffs, New Jersey, during the construction phase to perform engineering services including, but not limited to, supervising construction operations, field observation services, and home office support services: and WHEREAS, such professional services will be rendered or performed by a person authorized by law to practice a recognized profession and, whose practice is regulated by law pursuant to N.J.S.A. · 40A:ll-5 (l) (a) (i) of the Local Public Contracts Law: and WHEREAS, the Local Public Contracts Law requires that the Resolution authorizing the award of contracts for professional services without competitive bids and the contract itself must be available for inspection: and WHEREAS, a certificate establishing that funds will be available for this contract from a designated appropriation from the 1990 budget and shall be provided in subsequent budgets, has been issued by the· Chief Financial Officer in accordance with N.J.A.C. 5:30-14.5 of the I Rules and Regulations of the New Jersey Department of Community Affairs, Local Finance Board. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack, as follows: 1. That the Mayor and City Clerk be and they are hereby authorized to execute a contract with Clinton Bogert Associates of 270 Sylvan Avenue, Englewood Cliffs, New Jersey, for performance of the aforesaid services. 2. That such contract executed by the Mayor and City Clerk, contain sufficient provisions to limit the consideration to be paid to Clinton Bogert Associates for said services to the sum of $240, 000.00. 3. That this contract is awarded without competitive bidding as a professional service in accordance with N.J.S.A. 40A:ll-5 (1) (a) of the Local Public Contracts Law because said services are to be rendered or performed by a person authorized by law to practice a recognized profession and whose profession is regulated by law, in accordance with the provisions of said statute. BE IT FURTHER RESOLVED that the City Clerk be and is hereby directed to retain a copy of the contract for public inspection and to I publish notice of this action once in The Record. Roll Call: Ayes - Mecca, Robinson, Stein, Zisa Absent - Mattei Resolution 4165 OFFERED BY: ROBINSON SECONDED BY: MECCA WHEREAS, by virtue of a contract dated June 19, 1989, and executed January 20, 1990, between the City of Hackensack and Clinton Bogert Associates, the engineering services of Clinton Bogert Associates were retained pertaining to the Anderson Street sewer regulator improvements and said contract pertains to a portion of the City's ongoing project to rebuild its combined sewer regulators: and  WHEREAS, said contract contained a provision commonly known as an "upset figure" or a "not to exceed limit" of $96, 648.00: and WHEREAS, due largely to additicmal requirements imposed by the New Jersey Department of Environmental Protection, Clinton Bogert was and is required to expend significant, additional services for the appropriate engineering designs and permit process on the aforementioned Anderson Street sewer regulator improvements, and has enumerated and justified same to the satisfaction of the Mayor and Council: and WHEREAS, such additional engin1eering services as justified by Clinton Bogert Associates require the amendment of the previously executed contract, which amendment shall increase the "upset" or "not to exceed limit" to $194, 648.00: and I WHEREAS, such professional services will be rendered or performed by a person authorized by law to practice a recognized profession and whose practice is regulated by law pursuant to N.J.S.A. 40A:ll-5 (l) (a) (i) of the Local Public Contracts Law: and WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the award of contracts for professional services without competitive bids and the contract itself must be available for inspection: and WHEREAS, it is the desire of the Mayor and Council of the City of Hackensack to continue to retain the services of Clinton Bogert Associates of 270 Sylvan Avenue, Englewood Cliffs, New Jersey, for the sewer regulating system improvements needed by the City: and WHEREAS, a certificate establishing that funds will be available for this contract from a designated appropriation from the 1990 budget and shall be provided in subsequent budgets, has been issued by the I! Roll Call: Ayes - Mecca, Robinson, Stein, Zisa Absent - Mattei Resolution #170 OFFERED BY: ROBINSON SECONDED BY MECCA WHEREAS, there exists in the City of Hackensack a need for the services of a risk management and safety consultant to provide specialized training for City employees as required by state regulations and to assist the Safety Program; and WHEREAS, such a risk management and safety consultant will provide services that are specialized and qualitative in nature and require expertise, extensive training and proven reputation in the I field of endeavor, rendering such services extraordinary, unspecifiable services pursuant to N.J.S.A. 40A:ll-5{l) {a) {ii) ; and WHEREAS, it is the desire of the Mayor and Council of the City of Hackensack to retain the services of Pryme Safety Services, Carlstadt, New Jersey, as risk management and safety consultant for the City of Hackensack: and WHEREAS, Pryme Safety Services has agreed to provide the afore-described services to the City c)f Hackensack for a period of one (1) year on an hourly basis for an amount not to exceed $15, 150.00; and WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the award of contracts for extraordinary unspecified services without competitive bids and the contract itself must be available for inspection; and WHEREAS, a certificate establishing that funds will be available for this contract from a designated appropriation from the 1990 budget and shall be provided in subsequent budgets, has been issued by the Chief Financial Officer in accordanc«� with N.J.A.C. 5:30-14.5 of the Rules and Regulations of the New Jersey Department of Community Affairs, Local Finance Board. That the Mayor and City Clerk be and they are hereby authorized to execute a contract with Pryme Safety Services of 338 Hackensack Street, Carlstadt, New Jersey, for performance of the aforesaid services. 2. That this contract is awarded without competitive bidding as an extraordinary unspecifiable service in accordance with N.J.S.A. 40A:ll-5{l) {a) (ii) of the Local Public Contracts Law because the services to be provided by the risk management and safety consultant are sufficiently specialized and qualitative in nature, require expertise and extensive training, and a proven reputation in the field of endeavor, and are therefore incapable of reasonable description by written specification. BE IT FURTHER RESOLVED that the City Clerk be and hereby is directed to retain a copy of the contract for public inspection and to publish notice of this action once in The Record. Roll Call: Ayes - Mecca, Robinson, Stein, Zisa Absent - Mattei II\ The City Attorney reported that the resolution to memorialize the decision of the City Council in the matter of the Sebring Associates' hearing was ready for Council's action tonight: however, the attorney for the applicant requested that the matter not be voted on tonight and asked for an extension. He read the following letter.  "April 16, 1990 "Dear Mr. Salkin, In accordance with our telephone conversation of this date, we have been authorized by our client to consent on their behalf pursuant to N.J.S.A. 40:55D-17{C ) to an extension of time to conclude your review until the session of the Mayor and Council to be held on May 21, 1990. You are authorized to place this consent on the record of your I meeting to be held this evening. In reliance thereon, neither our · client nor ourselves will be attending the meeting scheduled for tonight. If you have any questions concerning the forgoing, please do not hesitate to communicate with us. " He advised Council that he would forward the letter to the City Clerk for the record and that there would be no problem in granting the extension. The Mayor asked the City Manager if he had anything to report. Mr. Lacava commended the Hackensack Police Department for their work with Teaneck last week. The Mayor asked the City Attorney if he had anything to report. He said no. Mayor Zisa extended thanks to the Deputy Mayor who devoted a lot of time to the situation in Teaneck. Ms. Robinson said that she met with Mr. and Mrs. Pannell and also attended the services for the deceased. She advised that several' t meetings had been set up which she will be attending. They are , working toward efforts to reduce the tension. � - Dr. Mecca stated that the :D�puty Mayor should be proud of what' � she has done in the pas � � ev�ral days. The Mayor opened the meeting to the public for the discussion of City business. Dorothy Schwartz, 47 Prospect Avenue, spoke on areas of the Rent Control Ordinance as it relates to Suburban Terrace. She asked again that the tax surcharge be eliminated. The Mayor asked the City Attorney to speak with the Rent Board attorney on this matter. Elsie Hopson, 133 Atlantic Street, complained about the various problems she is having in the apartment dwelling at 133. The tenants have complaints of termites, roof leaking, the landlord is charging surcharge taxes, the rain comes through the windows and they are not receiving security interest. This matter was discussed at length with the members of Council and Mr. Lacava. The Mayor asked the Manager to take a careful look at I the apartments and to also investigate the way the calculation of surcharge is being handled and to follow up on the complaints. Ms. Robinson recommended that we take the concerns under our wings and asked that an amended list of the present conditions that have not been rectified be submitted to members of Council. Mrs. Hopson was advised, however, that some or all of the items may not be under the City's code. Dock Russell, 148 Clay Street, said that he attended a drug seminar in Atlantic City and did not see anyone from Hackensack present that he recognized. He felt that there should have been representation.  Mary Watson, 267 High Street, spoke again about the red clay from Third Street.
