City Council

A Special Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Monday, April 3� 1990. The Mayor called the meeting to order at 8:15 P. M. and asked. City Clerk to call the roll. ' Present: Mayor John F. Zisa, Deputy Mayor Sandra A. Robinson, Councilmen Mauro Mecca, Mark A. Stein and Roger B. Mattei, City Attorney Richard E. Salkin and City Clerk Doris L. Dukes. Mrs. Dukes: "In accordance with the Open Public Meetings Act, Chapter 231 , Laws of 1975, adequate notice to this meeting was I provided by sending a notice to the Record and by posting a copy of same on the Bulletin Board in City Hall". Heather Murphy, Court Stenographer from Attorneys Court Reporting Services was present to record the proceedings of the hearing. Jospeh Mecca, City Prosecutor was present for the City and read the following charges: Ariyoshi Corporation, holder of Plenary Retail Consumption License No. 0223-33-075-003. 110n January 13, 1990, you violated the provisions of 49:10 of the Code of the City of Hackensack, in that you allowed and/or permitted the consumption of alcoholic beverages after closing hours". Seymour Chase, Esq. , from the firm of Chase and Chase was present with Hisae Arita, one of the owners of the Corporation. Mr. Chase asked that the plea of "not guilty" be withdrawn and , entered a plea of "guilty", with the understanding of reaching a , settlement. t The Prosecutor recommended a four (4) day suspension effective , July 5, 6, 7, 8, 1990, stating that there was one prior offense in 1987 in which the license was suspended for three days. At that time they filed an appeal and paid a fine in lieu of suspension. Mr. Mecca said he had no objections to a fine in lieu of a suspension. Mr. Chase stated for the benefit of the record that the patrons had drinks in front of them, however the checks had already been given to them. Their clocks are also set fifteen (15) minutes ahead. The Mayor asked the City Attorney if this is an appropriate fine, this being a second offense. Mr. Salkin replied that it is certainly reasonable and would have no hesitation in making this recommendation. Hisae Arita was asked if she fully understood and if she agreed with the recommendation. She said "yes" and Mr. Chase also affirmed that his client fully understood the proceedings. She has been involved in the business for five years. The following resolution was read: I RESOLUTION NO. 172 OFFERED BY: MATTEI SECONDED BY: MECCA IN THE MATTER OF DISCIPL INARY PROCEED INGS AGA INST Ariyoshi Corporation 402 State Street Hackensack, N. J. 07601 the holder of Plenary Retail Consumption License No. 0223-33-075-003  WHEREAS, charges have been heretofore duly served upon the above named licensee, charging that "on January 13, 1990, you violated the provisions of 49:10 of the Code of the City of Hackensack, in that you allowed and/or permitted the consumption of alcoholic beverages after closing hours", and at a hearing duly held thereon, the testimony having established the truth of said charges and the licensee having pleaded "guilty"; IT IS THEREFORE, on this 30th day of April, 1990, on motion duly made and seconded: ,,tI. RESOLVED AND ORDERED that Plenary Retail Consumption License No. 0223-33-075-003, heretofore issued by the City Council of the City of Hackensack to Ariyoshi Corporation, for premises located at 402 State Street, Hackensack, New Jersey be suspended for four (4) days effective July S, 1990, at 2:00 A. M. through July a, 1990; and BE IT FURTHER RESOLVED that the City Council of the City of Hackensack has no objections to a fine in lieu of suspension, providing licensee files within ten {10) days of today's date.
