City Council

The regular meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, N.J., on Monday, August 6, 1990. Mayor Zisa called the meeting to order at 8:15 P. M. and asked everyone to stand for the flag salute. On roll call the following were present: Mayor John F. Zisa, Deputy Mayor Sandra A. Robinson, Councilmen Mauro A. Mecca, Mark A. Stein and Roger B. Mattei, City Attorney Richard E. Salk in, City Manager James s. Lacava and City Clerk Doris L. Dukes. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa Resolution #287 OFFERED BY: MATTEI SECONDED BY: STEIN WHEREAS, on July 16, 1990, the Reverend Isiah McKinnon, Pastor of King of Kings Full Gospel Tabernacle Incorporated, did advise the Mayor and Council of the City of Hackensack that because of a postponement of a closing date of the Church's acquisition of the property known as Lots No. 20, 28 and 28A in Block 318, from a September 1989 date to November 6, 1989, the Church was denied property tax exemption status for 1990; and WHEREAS, Reverend McKinnon did request that the Mayor and Council enact a special Tax Refunding Ordinance pursuant to N.J.S.A. 54:4-3.6c; and WHEREAS, the Mayor and Council did, upon this request, direct the City Attorney to render an opinion regarding this request; and WHEREAS, the City Attorney has advised the Mayor and Council that, in his opinion, under the existing tax laws of the State of New Jersey, the City Council does not have the power to grant the requested relief; and WHEREAS, the Mayor and Council are cognizant of the severe hardship which has, or will be occasioned, by the Church by payment of its significant property tax liability for 1990; and I WHEREAS, it is the consensus of the Mayor and Council of the City of Hackensack that it would likely look favorably upon affording the requested relief to the Church if it possessed the legal authority to refund or forgive these property taxes, and that this intention ought to be memorialized by Resolution and made available to the Church so as to facilitate any legal action the Church might wish to pursue. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that the City Clerk be and hereby is directed to forward a certified copy of this Resolution to Reverend McKinnon and to the members of the State Assembly and State Senate of the 38th District. Dr. Mecca asked the City Attorney if King of Kings Church had submitted a brief and was told no they had not. This resolution was discussed at length among some members of Council and the City Attorney. I Roll Call: Mecca - Nay Robinson - Nay Stein - Aye, Mattei - Aye, Zisa - Aye Resolution #288 OFFERED BY: MATTEI SECONDED BY: STEIN WHEREAS, the Zoning Board of Adjustment of the City of Hackensack did by resolution dated January 17, 1990, approve an application for development entitled In Re The Application of Sebring Associates, Inc., For a Variance and Site Plan Approval, Variance No. 67-89, and Site Plan Approval No. 40-89; and  WHEREAS, subsequent to publication of the aforementioned resolution, a Notice of Appeal of the approval for development was duly and timely filed with the City Clerk; and WHEREAS, a hearing de novo on the matter was held before the Mayor and Council of the City of Hackensack on March 27, 1990; and WHEREAS, Resolution No. 206 was adopted on May 21, 1990 by the Mayor and Council reversing the height variance granted by resolution I of the Zoning Board of Adjustment; and WHEREAS, on June 2, 1990, a complaint bearing Docket No. BER-L-7204-90 and entitled Sebring Associates, Inc., a New Jersey Corporation vs. Mayor and Council of the City of Hackensack and Hackensack Zoning Board of Adjustment, was filed in the Superior Court of the State of New Jersey; and WHEREAS, there have been ongoing discussions between Sebring Associates, Inc. and the City of Hackensack seeking to achieve a fair and amicable resolution and settlement of the matter; and WHEREAS, Sebring Associates, Inc. has agreed to submit new plans to the Zoning Board of Adjustment that will, in pertinent part, reduce the height of the proposed development from 160 feet to 109.6 feet and further provide for additional setbacks along Polifly Road and Essex Street; and WHEREAS, the Mayor and Council are satisfied that such a scaling down of the project will reasonably and adequately address the Council's concerns regarding the potential overdevelopment of the site and the potential deleterious effect upon the adjacent neighborhoods and is, therefore, in the best interest of the people of the City of Hackensack; and I WHEREAS, in order to effectuate this proposed settlement the Mayor and Council must authorize and direct the City Attorney to execute a Stipulation of Settlement on behalf of the City. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack as follows: 1. The City Attorney be and hereby is authorized and directed to execute a Stipulation of Settlement of the pending lawsuit. 2. Upon the execution of the Stipulation of Settlement by all parties, a true copy of same shall be kept on file by the City Clerk. Dr. Mecca asked the purpose of this resolution and the City Attorney responded. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa Resolution #289 OFFERED BY: STEIN SECONDED BY: MATTEI WHEREAS, on November 7, 1983, a Developer's Agreement was entered into by the City of Hackensack and Executive Plaza North concerning, in pertinent part, certain off-site improvements to Clinton Place in the City of Hackensack to be undertaken by the developer, Executive I Plaza North; and WHEREAS, subsequent to the execution of the aforesaid agreement, it was ascertained that additional off-site improvements involving the permanent improvement of the intersection of Clinton Place and Pangborn Place would be necessary to effectuate the intent of the parties expressed in the November 7, 1983 agreement, to wit, the conversion of the easternmost leg of Clinton Place between Pangborn Place and Main Street to a two-way traffic flow; and WHEREAS, the parties to the November 7, 1983 agreement have reached an amicable resolution whereby Executive Plaza North will assume the sole responsibility to construct the permanent improvements to the intersection of Clinton Place and Pangborn Place: and WHEREAS, it is necessary and appropriate for the parties to enter into a formal "Addendum" to the November 7, 1983 agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack, New Jersey, that the Mayor and City Clerk be, and they hereby are authorized to execute the aforedescribed addendum to the November 7, 1983 agreement: and I BE IT FURTHER RESOLVED that the City Clerk shall keep a copy of said addendum on file for public inspection. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa Resolution #291 OFFERED BY: MECCA SECONDED BY: STEIN WHEREAS, during the course of the planning and construction of the Atlantic Street Parking Garage, the City of Hackensack became I aware of the need to acquire a six and one-half ( 6�) foot strip of property consisting of approximately three hundred ninety-eight (398) square feet along the western boundary of the property known as Lot 18, Block 210 on the current tax map of the City of Hackensack, commonly known as 131 Main Street, Hackensack, New Jersey: and WHEREAS, such acquisition was and is necessary to ensure that the parking structure is provided with a sufficient and lawful setback from the property line: and WHEREAS, by virtue of Ordinance 2-89, the City of Hackensack authorized the acquisition of the subject property by agreement with the property owners or by condemnation proceedings: and WHEREAS, the City of Hackensack and the owner of the subject property, 131 Main Street Associates, have engaged in negotiations to amicably and fairly settle the matter: and WHEREAS, pursuant to such discussions and negotiations the parties have reached a resolution of the matter by which the owner of I the subject property will convey same to the City of Hackensack in consideration for the use of twenty-five (25) upper level parking spaces in the parking garage as follows: 1. Commencing the first day of the first month after the effective date of the agreement to be executed - five spaces. 2. Commencing the first day of the fourth month after the effective date of the agreement - five additional spaces. 3. Commencing the first day of the seventh month after the effective date of the agreement and for fifteen months thereafter - fifteen additional spaces.  The total parking rental value of this consideration is twenty-seven thousand three hundred dollars ($27,300.00) . The City shall have the further right, for internal financial purposes, to exchange checks in the amount of twenty-seven thousand three hundred dollars ( $27, 300.00) with the owner at the time of closing of title; and WHEREAS, the Mayor and Council of the City of Hackensack are of the belief that the foregoing consideration to be paid by the City is economically beneficial to the City of Hackensack and therefore in the I best interest of the people of the City of Hackensack. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that the Mayor and City Clerk be and hereby are authorized to execute such documents that are necessary to effectuate the foregoing settlement and that the City Attorney take such further steps as are necessary to consummate the transaction for acquisition of the described property by the City pursuant to N.J.S.A. 40A:l2-3 (b) . Jacobs were the owners of certain known real property known as Block 543, Lot 31, located at 540 Prospect Avenue; and WHEREAS, the taxpayer has filed an appeal to the 1988 real property tax assessment, which matter is presently pending in the Tax Court of New Jersey; and WHEREAS, the 1988 total assessment for the subject premises is $222,000.00; and WHEREAS, upon review of information submitted, a reduction I appears appropriate; and WHEREAS, it is the recommendation of the City Appraiser, Tax Attorney and the Tax Assessor that this matter should be settled; and WHEREAS, said settlement is in the best interests of the City of Hackensack.  NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that the Tax Counsel be and he is hereby authorized and directed to execute any and all documents which may be necessary in order to effectuate a settlement of litigation entitled "Edwin F. & Adeline P. Jacobs vs. City of Hackensack", Docket No. 02-23-2365-89S, presently pending in the Tax Court of New Jersey, so that the total assessment of $222, 000.00 shall be reduced to a total of $210, 000.00; and I BE IT FURTHER RESOLVED that the aforesaid settlement is predicated upon a full waiver of any interest payable to the taxpayer on the refund. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the I City of Hackensack that the Tax Counsel be and he is hereby authorized and directed to execute any and all documents which may be necessary in order to effectuate a settlement of litigation entitled "Joseph Raymond vs. City of Hackensack", Docket No. 02-23-0463-89D, presently pending in the Tax Court of New Jersey, so that the total assessment of $926, 500 shall be reduced to a total of $825, 000; and BE IT FURTHER RESOLVED that the aforesaid settlement is predicated upon a full waiver of any interest payable to the taxpayer on the refund. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa Resolution #295 OFFERED BY: MECCA SECONDED BY: STEIN WHEREAS, Timeplex, Inc., is the owner of certain known real property known as Block 504A, Lot 14J, located at 100 Commerce Way; and I WHEREAS, the taxpayer has filed an appeal to the 1988 real property tax assessment, which matter is presently pending in the Tax Court of New Jersey; and WHEREAS, the 1988 total assessment for the subject premises is $3, 040, 500; and WHEREAS, upon review of information submitted, a reduction appears appropriate; and WHEREAS, it is the recommendation of the City Appraiser, Tax Attorney and the Tax Assessor that this matter should be settled; and  WHEREAS, said settlement is in the best interests of the City of Hackensack. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that the Tax Counsel be and he is hereby authorized and directed to execute any and all documents which may be necessary in order to effectuate a settlement of litigation entitled "Timeplex, Inc. vs. City of Hackensack", Docket No. 02-23-0421-88D, presently pending in the Tax Court of New Jersey, so that the total assessment of $310401500 shall be reduced to a total of $2,900,000; and I BE IT FURTHER RESOLVED that the aforesaid settlement is predicated upon a full waiver of any interest payable to the taxpayer on the refund. The Mayor asked the City Manager, City Attorney and members of Council if they had anything to report. Mr. Mattei asked the Manager for an update regarding the amount spent for washing cars and the possibility of purchasing a machine. Mr. Lacava advised that an employee would have to be on duty which would cost much more than we are now paying. The present cost equates to $5.00 per month per car for an unlimited number of washes. Some of our cars are washed several times a month. Mr. Mattei asked that Mr. D'Amore submit some figures showing how we are saving money by sending our cars out. Mayor Zisa asked that a cost analysis be done. I Ms. Robinson had previously requested Mr. Duffy to be present for the purpose of having him answer some questions regarding the status of the sidewalk on Central Avenue, the wall on Third Street, and the shale and overall conditions of Third Street. Mr. Duffy reported that he has been advised that Swenson's project will be completed in two weeks: however, he will be meeting with Ed Swenson this Wednesday and will get an answer from him at that time. He will then send a memorandum to members of Council on Thursday. A timetable will be included in the memo. The Mayor pointed out that we have been told many times that the sidewalk would be cleared soon and we have gone through an entire school year without results. He said it is important that the developer be made aware that the sidewalk be cleared before Labor Day.  Mayor Zisa asked Mr. Duffy to notify the Mayor and Council of any changes that will take place when Swenson begins reconstruction. Mr. Duffy said he would. The Deputy Mayor asked the City Attorney if there was anything that could be done to get Mr. Swenson to correct these problems. Mr. Salkin said we could get the City Engineer to investigate but he was not aware of any violations. He also gave a status report on 300 Prospect Avenue. When the Deputy Mayor asked if a lien could be placed on the property to get in line, the City Attorney replied that I in his opinion we need an answer from their special counsel. Dr. Mecca asked the Attorney questions about the shale which he answered. Dr. Mecca spoke on the resolution regarding the King of Kings Church and the status of their taxes. The City Attorney reported that he tried to find a way to prevent them from paying the taxes and the reason for the resolution is to memorialize what the City Council wanted done. The matter was discussed at length. It was agreed that the City Attorney would submit a letter of explanation with the background and resolution to be forwarded to the state legislators to make them aware of the situation the Church and the City are in. Mayor Zisa announced that the August 20th City Council meeting would be cancelled. There will be a meeting on August 28, 1990, just to take action on the ordinance regarding the County Funding. He also announced "National Night Out on Crime Prevention" to be held on the steps of the County Courthouse at 7:30 P. M. tomorrow. Mayor Zisa said that in conjunction with a number of discussions regarding the recommendation of appointing liaisons to departments to bring back responses to problem matters, he was making the following I appointments: Fire Department• • • • • • • • • Councilman Mark Stein Police Department • • • • • • • Councilman Roger Mattei Deputy Mayor Robinson stated that she had requested being the liaison to the Police Department. The Mayor opened the meeting to the public for discussion of City business. Rev. McKinnon, 254 Spring Valley Avenue, said he appreciated the good will of the City Council but their good will would not help them. The Mayor pointed out that if there was something that could be done legally it would be done; however, they must abide by the legal opinion of the Attorney. Laura Evans, 477 Sutton Avenue, asked for a sound barrier, stating that the noise from Route 17 does not allow them to sleep. The Mayor said he was aware that the state funded other municipalities and why not Hackensack. He asked if we could investigate if funding is available. A letter will be forwarded to the County and State. Grover Reynolds, 197 Berdan Place, had asked for some information I regarding deposits made in a Connecticut bank which was provided him by the Manager. Rainer Olster, 144 Union Street, asked questions regarding the parking garage and the cost of the fire truck which were answered by the City Manager. At 11:00 P. M., the meeting recessed for ten minutes and reconvened at 11:10 P. M. Alexis Palinkas, 235 Prospect Avenue, asked if ·we could continue the three minute timeframe for speakers. The Mayor apologized for having people wait so long to speak. Ms. Palinkas asked the Deputy Mayor about the property that was  boarded up which she had suggested be turned into a neighborhood project. The Deputy Mayor said she had contacted two people who were interested but other things had to be done first. Salvatore Santora, 126 Green Street, complained about the contractor in back of his property not properly maintaining it, the streets in his area not being swept, and flooding in the area.
