City Council

The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, N.J., on Monday, April 15, 1991. The Mayor called the meeting to order at 8:00 P. M. and requested everyone stand for the flag salute. The Mayor then asked the City Clerk to call the roll. Present: Mayor John F. Zisa, Deputy Mayor Sandra A. Robinson, Councilman Mark A. Stein, City Attorney Richard E. Salkin, City t Manager James s. Lacava and City Clerk Doris L. Dukes. Absent: Councilmen Mauro Mecca and Roger Mattei Mrs. Dukes: "In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975, adequate notice of this meeting was provided by sending a notice to The Record and posting a copy on the Bulletin Board in City Hall." Mayor Zisa asked for approval of the minutes of April 1st and 8th, 1991 meetings. Motion offered by Robinson, seconded by Stein that the minutes be approved as submitted. Carried. Mayor Zisa announced there would be a presentation to the Red Cross by the Hackensack Recreation Department and asked Joe Klunk to come forward. Joe Klunk, Recreation Program Specialist, said a volleyball marathon was held on Saturday, April 6th with James Parks, who is active in the Recreation volleyball league. They raised $1, 743.91. All of these funds will go to the Central Bergen Red Cross for the benefit of the families of those who served in Desert Storm. t Mr. Parks came forward and accepted the check. Mayor Zisa thanked the Recreation Department and commended Mr. Klunk for making this all possible. Dorothy Schwartz, 47 Prospect Avenue, thanked the Mayor and Council for introducing the ordinance and said she hopes The Record publicizes it and that Council will advertise it at the beginning of each year. Roll Call: Ayes - Robinson, Stein, Zisa Absent - Mecca, Mattei Resolution #131 OFFERED BY: STEIN SECONDED BY: ROBINSON WHEREAS, there exists a need for services to analyze costs incurred by the City of Hackensack (hereinafter referred to as the "City") with regard to its utility costs: and  WHEREAS, no funds will be required to be expended by the City and a contract is proposed with Utility Analysis, Inc., 111 South Avenue East, Cranford, New Jersey 07016, whereby they will be entitled to 50% of refunds or credits to the City under the terms and provisions contained therein; and WHEREAS, such services meet the definition of a professional service as set forth in N.J.S.A. 40:All-5 (m) as a service which is not required to be bid; and WHEREAS, the Local Public Contracts Law (N.J.S.A. 40:11-1 et I seq.} requires that the resolution authorizing the award of contracts for "extraordinary, unspecifiable services" without competitive bidding, and the contract itself must be available for public inspection and the resolution must be publicly advertised. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Hackensack as follows: 1. That the Mayor and the City Clerk be and are hereby authorized to execute an agreement with Utility Analysis, Inc., to provide a one (1) year utility cost review. 2. That this contract is awarded without competitive bidding as an "extraordinary, unspecifiable service" in accordance with N.J.S.A. 40A:ll-5 (l} (a} of the Local Public Contracts Law because same is expressly excluded from competitive bidding and without public advertising for bids as an authorized exception. I 1987, c.102, has established a recycling refund from which tonnage grants may be made to municipalities in order to encourage local source separation and recycling programs; and WHEREAS, it is the intent and spirit of the Mandatory Source Separation and Recycling Act to use the tonnage grants to develop new municipal recycling programs and to continue and expand programs; and WHEREAS, the New Jersey Department of Environmental Protection is promulgating recycling regulations to implement the Mandatory Source Separation and Recycling Act; and WHEREAS, the recycling regulations impose on municipalities certain requirements as a condition for applying for tonnage grants, including, but not limited to, making and keeping accurate, verifiable records of materials collected and claimed by the municipality; and WHEREAS, a resolution authorizing this municipality to apply for such tonnage grants will memorialize the commitment of this municipality to recycling and indicate the assent of the City Council of Hackensack to the efforts undertaken by the municipality and the requirements contained in the Recycling Act and recycling regulations; and WHEREAS, such a resolution should designate the individual I authorized to ensure that the application is properly completed and timely filed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that Hackensack hereby endorses the submission of a Municipal Recycling Tonnage Grant Application to the New Jersey Department of Environmental Protection, Office of Recycling and designates George DiMassino, Sr. to ensure that the said application is properly filed.  The City Attorney recommended an amendment to this resolution to include a paragraph that would authorize the Mayor to sign applications and/or agreements when required for this grant. Roll Call: Ayes - Robinson, Stein, Zisa Absent - Mecca, Mattei Resolution #137 The introduction of the 1991 Municipal Budget, offered by Robinson, seconded by Stein, and unanimously carried, is on file in the office of the City Clerk as a permanent record. Mrs. Dukes advised the Mayor that her Docket was completed. I The Mayor thanked her and commended Mr. Lacava and his staff for a tax decrease in the budget. He also commended the City Council for understanding the burden on our taxpayers and the Department of Public works for understanding we cannot fund all of their requests. He advised Mrs. Dukes that she could now hang his picture. This is his first full year and his first full budget. The Mayor asked the City Manager if he wished to speak. Mr. Lacava said although there were those who felt the petitions that were sent to the Governor would not help, they did have some effect on the legislative procedures. The Mayor asked the City Attorney and members of Council if they wished to speak. The City Attorney reported that the Berkshire Garden suit filed by Mr. Koval has been withdrawn and dismissed, and the Sebring Associates suit is in the process of being dropped. Mr. Stein said we were successful in petitioning the Governor regarding the taxes, and 1.1 million dollars of the increase in our budget was the result of the Bergen County Utility Authority for the I sewers. It's time we and other municipalitites who use BCUA put pressure on them for their accountability. The Mayor opened the meeting to the public for discussion of City business. Rev. Taki, on behalf of H.O.P.E. for Ex-Offenders, thanked the Mayor and Council for the resolution. He had several people in the audience who were being helped through this program.  Rainer Olster, 144 Union Street, said Mr. Lacava did a great job with the budget. He asked questions regarding public assistance which were answered by Mr. Lacava. Motion offered by Robinson, seconded by Stein that the public hearing be closed and the meeting be adjourned.
