The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, N.J., on Monday, September 16, 1991. The Mayor called the meeting to order at 8:10 P. M. and requested everyone stand for the flag salute. The Mayor then asked the City Clerk to call the roll. Present: Mayor John F. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa  Resolution #258 OFFERED BY: ROBINSON SECONDED BY: MECCA WHEREAS, Executive House Association, et al are the owners of certain individual real property condominium units known as Block 237, Lot 2B located at 301 Beech Street: and WHEREAS, the taxpayers have filed an appeal to their 1990 real property tax assessments, which matters are presently pending in the Tax Court of New Jersey: and WHEREAS, the total yearly assessment for each individual I co_ndominium unit is as set forth in Schedule A attached hereto and made a part hereof; and WHEREAS, upon review of information submitted, a reduction appears appropriate; and WHEREAS, it is the recommendation of the City Appraiser, Tax Attorney and the Tax Assessor that this matter should be settled; and WHEREAS, said settlement is in the best interests of the City of Hackensack. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that the Tax Counsel be and he is hereby authorized and directed to execute any and all documents which may be necessary in order to effectuate a settlement of litigation entitled "Executive House Association, et al vs. City of Hackensack", Docket Nos. 02-23-3411-91S to 02-23-3439-91S presently pending in the Tax Court of New Jersey, so that the assessment of each individual condominium unit be reduced and established as set forth on Schedule "A" for the year 1990; and BE IT FURTHER RESOLVED that the foregoing settlement is predicated upon a full waiver of any interest payable to the taxpayer I on the refund. Resolution #259 OFFERED BY: STEIN SECONDED BY: MATTEI WHEREAS, the City of Hackensack has for some time participated in the "State-Local Cooperative Housing Inspection Program" administered by the Bureau of Housing Inspections of the Department of Community Affairs of the State of New Jersey; and WHEREAS, the City has been requested to again participate in the program for the period of July 1, 1991 through June 30, 1992; and WHEREAS, funding by the State in the amount of Six Thousand Dollars ($6,000.00) for the period of July 1, 1991 through December 31, 1991, has been reserved to compensate the City for their inspections. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that the Mayor be and hereby is authorized to execute I an agreement, and any extension or renewal thereof, between the City of Hackensack and the Department of Community Affairs of the State of New Jersey for the performance of such housing inspections. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa Resolution #260 OFFERED BY: MATTEI SECONDED BY: STEIN WHEREAS, the County of Bergen has proposed to implement a County-wide program of standardized computerization of tax assessment records; and WHEREAS, the City of Hackensack has, as have all other Bergen 7 County Municipalities, been requested by the County to formally indicate whether or not it desires to participate in this program: and WHEREAS, the proposed program envisions a cost-sharing approach between the municipality and the county to implement such computerization; and WHEREAS, such a computerized system, if operated properly, may I result in more frequent and more accurate assessments of real property located in the City of Hackensack; and WHEREAS, with more frequent and more accurate assessments of real property, the frequency of costly and disruptive City-wide re-valuation should be reduced. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that the Mayor be and hereby is authorized to execute a document entitled "Agreement Contract" prepared by the County of Bergen to indicate the desire of the City of Hackensack to participate in the County-wide computerization process. Resolution #261 OFFERED BY: ROBINSON SECONDED BY: STEIN WHEREAS, on July 12, 1991, the Planning Board of the City of Hackensack did, by Resolution, approve site plan application 6-91 and variance application 40-91, submitted by the Hackensack Medical Center, a non-profit corporation of the State of New Jersey; and WHEREAS, as part of the aforesaid approvals, the Hackensack I Medical Center agreed to enter into a Developers Agreement with the City of Hackensack with respect to the installation of a sanitary sewer main extension line along Second Street to Beech Street in the City of Hackensack for the purpose of serving the project; and WHEREAS, said Developers Agreement comprehensively, fairly and equitably dea1s with the installation, ownership, use, cost of maintenance, standards of construction and performance guarantees related to the construction of this improvement and is in the best interest of the people of the City of Hackensack. NOW, THEREFORE, BE IT RESOLVED by the Ci�y Council of the City of Hackensack that the Mayor and City Clerk be and they hereby are authorized to execute a Developers Agreement between the City of Hackensack, the Planning Board and the City of Hackensack and the Hackensack Medical Center related to the subject sanitary sewer main. Contillo, Esq. of 275 Forest Avenue, Paramus, New Jersey, to represent the City of I Hackensack and Larry Manning ·in an appeal presently pending in the Appellate Division of the Superior Court of New Jersey entitled Salvatore Cannici, et al vs. R. L. Investors, City of Hackensack and . Larry Manning, bearing Docket No. A-6195-90, appealing the entry of a Summary Judgment entered July 17, 1991, in favor of the City of Hackensack and Larry. Manning; and  WHEREAS, such professional services will be rendered or performed by a,_. person authorized by law to practice a recognized profession and whose practice is regulated by law pursuant to N.J.S.A. 40A:ll-5{l) {a) {i) of the Local Public Contracts Law: and WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the award of contracts for professional services without competitive bids and the contract itself, must be I available for public inspection: and WHEREAS, a certificate establishing that funds are available for this contract from a designated appropriation from the 1991 budget and shall be provided in subsequent budgets has been issued by the Chief Financial Officer in accordance with N.J.A.C. 5:30-14.5 of the Rules and Regulations of the New Jersey Department of Community Affairs, Local Finance Board. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack, as follows: 1. That the Mayor and the City Clerk be and they hereby are authorized to execute a contract with Robert B. Contillo, Esq. of 275 Forest Avenue, Paramus, New Jersey, to serve as attorney for the City of Hackensack and Larry Manning in this matter. 2. That this contract is awarded without competitive bidding as a professional service in accordance with N.J.S.A. 40A:ll-5{l) {a) of the Local Public Contracts Law because said services are to be rendered or performed by a person authorized by law to practice a recognized profession and whose profession is regulated by law in accordance with the provision of said statute. BE IT FURTHER RESOLVED that the City Clerk be and is hereby I directed to retain a copy of the contract for public inspection and to publish notice of this action once in The Record. Dr. Mecca asked the City Manager what paragraph 3 of the resolution means. The Manager advised that certain contracts, such as professional services do not have to go out for bids. Dr. Mecca then asked how do we know we are getting the best attorney. City Attorney Salkin explained the case for which the attorney was being retained, adding that he originally represented the City, but since a City employee is a plaintiff, he felt someone else should take the case. Dr. Mecca asked for information on the process by which attorneys are chosen to avoid the appearance of improprieties. It was explained that there is a list from which the attorneys are selected. The Mayor and Council give the final approval. The City Attorney advised that M�. Contillo is not an attorney \ connected with the 1989 election. Mayor Zisa: "Dr. Mecca, you ask the City Attorney to give an expert opinion and then you ask if he had researched the capabilities of the attorneys-" I An extensive discussion was held on the process by which the attorneys are chosen to represent the City �nd its employees. Jaskot, Esq. of 385 Prospect Avenue, Hackensack, New Jersey, to represent Police Officer Thomas Williams in connection with Cross-Complaints involving allegations of disorderly persons offenses concerning one Leslie Bailey, now pending in Hackensack Court, regarding an incident alleged to have occurred on August 1, 1991, in the City of Hackensack; and WHEREAS, such professional services will be rendered or performed by a person authorized by law to practice a recognized profession and whose practice is regulated by law pursuant to I N.J.S.A. 40A:ll-5 (l) (a) (i) of the Local Public Contracts Law; and WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the award of contracts for professional services without competitive bids and the contract itself, must be available for public inspection; and WHEREAS, a certificate establishing that funds are available for this contract from a designated appropriation from the 1991 budget and shall be provided in subsequent budgets has been issued by the Chief Financial Officer in accordance with N.J.A.C. 5:30-14.5 of the Rules and Regulations of the New Jersey Department of Community Affairs, Local Finance Board. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack, as follows: 1. That the Mayor and the City Clerk be and they hereby are authorized to execute a contract with Lawrence J. Jaskot, Esq. of 385 Prospect Avenue, Hackensack, New Jersey, to represent Police officer Thomas Williams in this matter. 2. That this contract is awarded without competitive bidding as a professional service in accordance with N.J.S.A. 40A:ll-5 (l) (a) I of the Local Public Contracts Law because said services are to be rendered or performed by a person authorized by law to practice a recognized profession and whose profession is regulated by law in accordance with the provision of said statute. BE IT FURTHER RESOLVED that the City Clerk be and is hereby directed to retain a copy. of the contract for public inspection and to publish notice of this action once in The Record. Guez, Esq. of 125 State Street, Hackensack, New Jersey 07601, to represent the Mayor and Council of the City of Hackensack, as a party named in a lawsuit filed by one Anthony Capricusso appealing the denial of a development application by the Zoning Board of Adjustment on or about June 5, 1991, bearing Superior Court Docket No. BER-L-10003-91; and WHEREAS, such professional services will be rendered or performed by a person authorized by law to practice a recognized profession and whose practice is regulated by law pursuant to I N.J.S.A. 40A:ll-5 (l) (a) (i) of the Local Public Contracts Law; and WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the award of contracts for professional services without competitive bids and the contract itself, must be available for public inspection; and WHEREAS, a certificate establishing that funds are.available for  190 this contract from a designated appropriation from the 1991 budget and shall be provided in subsequent budgets has been issued by the Chief Financial Officer in accordance with N.J.A.C. 5:30-14.5 of the Rules and Regulations of the New Jersey Department of Community Affairs, Local Finance Board. That this contract is awarded without competitive bidding as a professional service in accordance with N.J.S.A. 40A:ll-5 (l) (a) of the Local Public Contracts Law because said services are to be rendered or performed by a person authorized by law to practice a recognized profession and whose profession is regulated by law in accordance with the provision of said statute. BE IT FURTHER RESOLVED that the City Clerk be and is hereby directed to retain a copy of the contract for public inspection and to publish notice of this action once in The Record. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei Abstain - Zisa Resolution #265 OFFERED BY: STEIN SECONDED BY: ROBINSON The governing body of the City of Hackensack desires to further the public interest through an application to the Department of Environmental Protection, State of New Jersey for a grant in the amount of $128,261.00 for the planning of improvements to two sewer I overflow points (Court Street and Anderson Street) to reduce discharge of solids/floatables into the Hackensack River. NOW, THEREFORE, the governing body hereby authorizes John F. Zisa, Mayor, to make application for, and if accepted, to execute a grant agreement with the State in an amount up to that requested for the proposed project. The Mayor and City Council authorizes and hereby agrees to provide matching funds in the total sum of $14,251.00, in compliance with the matching fund requirements of the grant. The availability of the funds for such purposes are hereby certified at 0%. The Contractor agrees to comply with all applicable federal, state and municipal laws, rules and regulations in the performance of this contract. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa Resolution #266 OFFERED BY: STEIN SECONDED BY: MECCA WHEREAS, the City of Hackensack has received approval of a grant by the Department of Environmental Protection of the State of New Jersey in the amount of $128,261.00 representing ninety percent (90%) of the projected cost of a project to planning improvements necessary I to reduce the discharge of solids and floatables from the discharge points of the combined sewer overflows system owned and operated by the City of Hackensack: and WHEREAS, it is the desire of the Mayor and Council of the City of Hackensack to engag·e the engineering services of Clinton Bogert Associates, 279 Sylvan Avenue, Englewood Cliffs, New Jersey 07632, to undertake this planning project on behalf of the City of Hackensack: and WHEREAS, such professional services will be rendered or performed by a person authorized by law to practice a recognized I profession and whose practice is regulated by law pursuant to N.J.S.A. 40A: ll-5 (l) (a) (i) of the Local Public Contracts Law; and WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the award of contracts for professional services without competitive bids and the contract itself must be available for public inspection; and WHEREAS, pursuant to the regulations of the Grant Program, a certification has been issued by the Chief Financial Officer of the I City of Hackensack to the effect that the projected costs of the aforesaid planning project totalling $142,512. 00 are available from Bond Ordinance No. 11-85. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack, as follows: 1. That the Mayor and the City Clerk be and they hereby are authorized to execute a contract with Clinton Bogert Associates, 279 Sylvan Avenue, Englewood Cliffs, New Jersey 07832, for an amount not to exceed $141,200.00 to perform the above-described planning project for the City of Hackensack. 2. I Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa Resolution #267 OFFERED BY: STEIN SECONDED BY: MATTEI WHEREAS, Assembly Bill A-5046 and Senate Bill S-3595 were introduced before the New Jersey Legislature; and WHEREAS, this legislation is known as "an act concerning the taxation of certain business personal property"; and WHEREAS, the stated intent of this legislation is to create a broad exclusion from ' local taxation of machinery, apparatus and equipment used or held for use in research and development or the manufacture, assembly or processing of property or in the sale of services or goods; and WHEREAS, this legislation will materially alter the definition of locally taxable real property and due to the broadly defined intent produce a large number of property tax appeals in commercial and industrial property; and WHEREAS, such increase of property tax appeals caused by this legislation will create additional legal expenses for municipalities at a time when such costs are becoming an increasingly fiscal burden I on local taxpayers; and WHEREAS, the tax appeals broug ht about by this legislation could lead to substantially reduced property tax assessments for commercial and industrial properties which will cause a shift of the real property tax burden in the State to homeowners and renters; and WHEREAS, this legislation will lead to a complete reversal of the avowed intent of the Governor and the legislature to reduce the local property tax burden of the homeowner and residents of the State. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hackensack oppose this legislation and advocates defeat of Assembly Bill A-5046 and Senate Bill S-3595; and  forwarded to Senators Matthew Feldman and Paul Contillo, Assemblymen Byron M. The Mayor thanked her and asked the City Manager, City Attorney I and members of Council if they had anything to report. They did not. Mayor z isa appointed Donald Fleming, 198 Fairmount Avenue, to serve as a Commissioner of the Hackensack Housing Authority for a five-year term. The Mayor then opened the meeting to the public for discussion of City business. Josephine DiStasi, 456 Colonial Terrace, complained about problems in the area of Pulaski Place and Lafayette Street. Children are gathering, using profanity, loud music and are double parking. To get the police to come down requires two or three phone calls. She said her son was threatened with a knife, his windows were broken and broken bottles are being thrown. This has been going on for some time and usually happens about 4:30 in the morning. A lot of the cars are out of town and when the residents are driving down the street, they are harrassed. Mayor Zisa said he had not heard this before and appreciated her bringing this matter to their attention. He asked Mr. Lacava to I investigate and get a full report from the Police Chief and let the Council know what's been going on. Mr. DiLaone, 197 Washington Avenue, said he called the Police on September 10th at 10:00 P. M. with no response, waited twenty minutes and called a third time and was told "do not call again". He asked what was he supposed to do. Mayor Zisa advised him that he is doing the appropriate thing by coming before this body. Grover Reynolds, 197 Berdan Place, asked Councilman Mattei, as the Police Liaison, why he was not aware of what was happening in the area of Pulaski Place. Mr. Mattei said this is the first time the matter has come before this body. Mr. Reynolds asked questions relating to the opening of the Civic Center for the Homeowners meeting last week, an out-of-state bank the City uses for insurance purposes, who purchases City bonds and at what percent. Mr. Lacava responded. Joseph Lascala, 401 Simons Avenue, said he was surprised to hear about the complaints in the area of Pulaski Place and Lafayette Street. He then said kids are gathering in the Arena parking lot with loud radios in vans. He said perhaps the overall situation should be looked into. Patrick of 226 Jackson Avenue spoke on disturbances in the area of Riley Court. Since the condos have been built there has been a lot of double parking and loud music. He asked if something could be done. Mr. Lacava was asked to investigate. I Rainer Olster, 144 Union Street, commented on the Bond Ordinance that was introduced tonight on first reading and the reduction in assessments by the condo owners due to tax appeals. Jack Donovan, Willow Avenue, commented on the growth of the Hackensack Medical Center and the services the City provides them. He said they should be asked to give something back to the City and suggested providing supplies to the Volunteer Ambulance Corps as one means. Mayor Zisa stated he had contacted the Mayors of those municipalities that house hospitals about user fees as a form of income. Dr. Mecca said he was stunned about what he's heard tonight relative to the disturbances and asked the citizens if they do not get a resolution to the problem in a short time to come back to the Council. Dorothy Schwartz, 47 Prospect Avenue, continued with her dilemma I with the Police Department regarding her Pistol Permit. Joseph Consentino asked questions regarding the amount on the bill list for the towing of abandoned vehicles, adding that it seems to be a lot. A very lengthy discussion pursued regarding the contract for the towing of abandoned vehicles, the fact that it is very difficult to get people to bid on the project, and whether the owners of the abandoned vehicles should be the responsible parties.  Mr. Consentino also said there is a smell of gas around the track at the High School Athletic field. At 10:45 P. M. Dr. Mecca left the chambers. Motion offered by Stein, seconded by Mattei, that the public hearing be closed and the meeting be adjourned. (11:00 P. M.)
