98 The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, N.J., on Monday, April 20, 1992. Mayor Zisa called the meeting to order at 8:00 P. M. and requested everyone stand for the flag salute. The Mayor then asked the City Clerk to call the roll. Present: Mayor John F. Zisa, Deputy Mayor Sandra A. Robinson, Councilmen Mauro A. Mecca, Mark A. Stein and Roger B. Mattei, City Attorney Richard E. Salkin, Acting City Manager Gordon Sieck and City Clerk Doris L. Dukes. Absent: City Manager James S. Lacava Mrs. Dukes: "In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975, adequate notice of this meeting was provided by sending a notice to The Record and posting a copy on the Bulletin Board in City Hall." Mayor Zisa acknowledged Mr. William Dungey, Scoutmaster for Boy Scout Troop #715 of the New Hope Baptist Church. At the request of the Mayor Mr. Dungey introduced the following members of this troop who were in attendance: C. Carroll, D. Powell, J. Davis and A. Richardson. The Mayor called for a motion to approve the minutes for the meetings held April 6th, 13th and 15th, 1992. Dr. Mecca said during the work session held April 6th regarding the C.H.I.P. discussion, he suggested to Mr. Halsch that if they purchase the Warner House property and give title to the City, the City could then lease it for a profit. He requested that statement be included in those minutes. Motion offered by Mecca, seconded by Stein that the minutes be approved wi t h the addition of Dr. Mecca's statement added to this April 6th C.O.W. minutes. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa Resolution #131 OFFERED BY: MATTEI SECONDED BY: ROBINSON WHEREAS, the Mandatory Source Separation and Recycling Act P.L. 1987, c. 102, has established a recycling fund from which tonnage grants may be made to municipalities in order to encourage local source separation and recycling programs: and  /tJ,P WHEREAS, it is the intent and spirit of the Mandatory Source Separation and Recycling Act to use the tonnage grants to develop new municipal recycling programs and to continue and expand existing programs: and WHEREAS, the New Jersey Department of Environmental Protection is promulgating recycling regulations to implement the Mandatory Source Separation and Recycling Act: and WHEREAS, the recycling regulations impose on municipalities certain requirements as a condition for applying for tonnage grants, including, but not limited to, making and keeping accurate, verifiable records of materials collected and claimed by the municipality: and WHEREAS, a resolution authorizing this municipality to apply for such tonnage grants will memorialize the commitment of this municipality to recycling and indicate the assent of the City Council of the City of Hackensack to the efforts undertaken by the municipality and the requirements contained in the Recycling Act and recycling regulations: and WHEREAS, such a resolution should designate the individual authorized to ensure that the application is properly completed and timely filed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that the City of Hackensack hereby endorses the submission of a Municipal Recycling Tonnage Grant Application to the New Jersey Department of Environmental Protection, Office of Recycling and designates Art Koster, Recycling Coordinator, 65 Central Avenue, Hackensack, N.J. 07601, to ensure that said application is properly filed. Roll Call: Ayes - Mecca, Robinson, Stein, Mattei, Zisa Resolution #132 OFFERED BY: MATTEI SECONDED BY: ROBINSON WHEREAS, municipal health departments are mandated by state statute and regulation to provide a minimum of twenty-two different pub! ic health services, the focus of which is to prevent disease, disability and human suffering: and WHEREAS, municipal health departments are continually being challenged by both ongoing and new emerging public health problems such as AIDS, rabies, the resurgence of vaccine preventable childhood diseases and tuberculosis: and WHEREAS, the current year state budget proposes $3,000,000 in Public Health Priority Funds, which is $3,200,000 less than the amount of PHPF in 1989 and amounts to only 3% of the total dollars spent by local health departments: and WHEREAS, local health departments are operating in an economic environment which is causing additional utilization of the public health services which we are mandated and bound to provide. · NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that we hereby urge the state legislature to give serious consideration to the public health benefits of reinstating /tJ-3 PHPF to the 1989 fiscal level of $6, 200, 000, and that the legislature consider municipal cap relief for specific public health services where increased utilization or cost is demonstrated; and BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to Commissioner Francis Dunston, State Department of Health; Senators Robert E. Resolution #135A OFFERED BY: MATTEI SECONDED BY: STEIN WHEREAS, on July 1, 1988, a fire totally destroyed the premises located at 320 River Street, Hackensack, New Jersey (commonly known as the Hackensack Ford site). Subsequently, the owners and operators of the property of the site, R. R. Associates, were permitted to operate their automotive business at the site through the use of a temporary structure (s) placed thereon: and WHEREAS, the use of the temporary structure (s) has been periodically updated and approved by the City of Hackensack upon the request of the property owner: and WHEREAS, on September 3, 1991, the Mayor and Council of the City of Hackensack approved Resolution No. 247 (incorporated herein by reference) whereby permission to operate the aforesaid automotive business through the use of a temporary structure (s) was to terminate on April 4, 1992, absent the commencement of actual construction of permanent structures on the site; and WHEREAS, prior to the April 4, 1992 deadline, the property t owner, R. R. Associates, through its principal Richard Catena and its attorneys, Michael L. Scherby, Esq. and Daniel P. Greenstein, Esq., did advise the Mayor and Council of their inability to comply with the April 4, 1992 deadline: and WHEREAS, the representations of the property owner and its legal counsel made to the Mayor and Council concerning the inability to meet the April 4, 1992 deadline appear to be exclusively based upon internal business decisions and/or problems facing the property owner, as opposed to delays occasioned by any governmental review or approval process: and WHEREAS, beyond noting that internal private business decisions, though informative, are not typically an appropriate consideration of a municipal governing body: and, in this regard, the Mayor and Council decline to make specific findings or offer further comment on the property owner's stated reasons for failing to comply with the April 4, 1992 deadline: and WHEREAS, the property owner has, through its attorney, agreed to enter into a formal binding agreement concerning a timetable for the development of a permanent structure (s) on the site. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City t of Hackensack that the Mayor be and hereby is authorized to execute said agreement on behalf of the City: and BE IT FURTHER RESOLVED that the appropriate City officials be and hereby are authorized to take all reasonable and appropriate actions to ensure the compliance by the property owner with said agreement. Mrs. Dukes advised the Mayor that her Docket was completed. The Mayor thanked her and asked Mr. Sieck, the City Attorney and members of Council if they had anything to report. They did not. Mayor Zisa thanked the Environmental Commission for the program they ran last week. They presented many awards to students. Various art work and sculptures were on display. The Mayor opened the meeting to the public for discussion of City business. Jack Donovan, Willow Avenue, again voiced his opinion regarding the Medical Center having a function for which several hundred people were invited. He suggested the Mayor appoint Mr. Lacava to look into their tax-free status, adding that Massachusetts and Connecticut now require salaries of executives to be made public for non-profit organizations. Mayor Zisa thanked him for his comments. Mr. Mattei told Mr. Donovan that it appeared he was looking  /cJ8 towards him and stated he was not in attendance. Mayor Zisa stated he did attend. He did not consume any alcohol. He said the Creamer family, the Toscano family and the radio company all contributed a vast amount of funds and he was sure some of the funds went towards the celebration. Dr. Mecca said the hospital is a quasi-public entity. It is not an evil empire and we are blessed to have the facility in the community. Mr. Sedwick, 307 Prospect Avenue, requested the City eliminate three parking spaces in front of their building for safety reasons. He is afraid there will be an acciaent due to the lack of visability when exiting the garage. Mayor Zisa requested Mr. Sieck have Mr. Lacava review the matter with the Police Chief and then with the City Council. Dorothy Schwartz, 47 Prospect Avenue, spoke on the tenants' rebates, advising that the landlords were not returning the rebates due tenants as required. Mayor Zisa asked Mr. Salkin to find out from Mrs. Yock how she handles the certificates that have not been returned. Rainer Olster, 144 Union Street, said he was surprised to hear the budget does not call for an increase of taxes in the Municipal Budget. He said a lot remains to be done. The Mayor advised him this is not the time for the d fscussion of the budget. The hearing will be held on May 26th. I Mr. Olster also commented on the tax appeal for the Frontenac. Alexis Palinkas, 235 Prospect Avenue, asked Dr. Mecca if there were physicians who were willing to volunteer their services to the uniformed personnel. Dr. Mecca said he did approach a couple of doctors, but had not received an answer one way or the other. He said perhaps with a formal request they may be willing to take it under consideration. Mayor Zisa said he did not know such a request had been made and said if given a name he would make a formal request pursuant to Dr. Mecca's conversation. Ray Dressler, 127 Poplar Avenue, thanked the DPW for their help in the work release program in Foschini Park. He reminded everyone of opening day on Sunday, April 26th, at 1:00 P. M. The Mayor thanked Mr. Dressler for all the work he has done with Foschini Park. Mr. Dressler asked if the City would be able to recoup some of the expenses that occurred as a result of the fire at Cosmevo regarding the firemen who needed treatment due to the chemicals that were stored on the premises. Mayor Zisa advised that he does not wish to discuss it at this time. Dorothy Schwartz, 47 Prospect Avenue, agreed with the Mayor, adding that she resents how Mr. Donovan approaches the City Council about the hospital. Mayor Zisa acknowledged Mr. Levin, Chairman of the Shade Tree Committee, and thanked him for planting a tree on Arbor Day in memory of Carl Padovano, our former Superintendent of Schools.  Motion offered by Stein, seconded by Mecca that the public hearing be closed and the meeting be adjourned.
