A Special Meeting of the City Council of the City of Hackensack, was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Monday, November 30, 1992. The Mayor called the meeting to order at 7:18 P. M. and ask�d the City Clerk to call the roll. Present - Mayor John F. Zisa, Councilmen Mark A. Stein, Mauro A. Mecca and Roger B. Mattei, City Attorney Richard E. Salkin, City City Clerk Doris L. Dukes and Chief Financial Officer Raymond I Carnevale Absent - Deputy Mayor Sandra A. Robinson and City Manager James s. Lacava Mrs. Dukes: _ _ "In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975, adequate notice of this meeting was provided by sending a notice to The Record and post:ing a copy of same on the Bulletin Board in City Hall". RESOLUTON NO. 344 OFFERED BY: STEIN SECONDED BY: MECCA INTRODUCTION OF ORDINANCE NO. 18-92 ENTITLED: "AN ORDINANCE AUTHORIZING THE EXCHANGE OF CERTAIN MUNICIPAL LANDS BEING (PART OF) BLOCK 61, LOT lA, FOR PRIVATELY OWNED LANDS BEING (PART OF) BLOCK 61, LOT 1, LOCATED IN THE CITY OF HACKENSACK, NEW JERSEY". BE IT RESOLVED that the above ordinance, being Ordinance No. 18-92, as introduced, does now pass on first reading and that said ordinance shall be considered for final passage at a meeting to be held on Tuesday, January 19, 1993, at 8:00 P.M., or as soon thereafter as the matter can be reached at the regular meeting place of the City Council and at such time and place all persons interested be given an opportunity to be heard concerning said ordinance and that the City Clerk be and she is hereby authorized I and directed to publish said ordinance accor ingd to law with a notice of its introduction and passage on first_ reading and of the time and place when and where said ordinance will be further considered for final passage. Roll Call: Ayes - Mecca, Stein, Mattei, Zisa Absent - Robinson The City Attorney filed, with the City Clerk, a Certification of the Tax Assessor, dated November 12, 1992, certifying that the appraised value of this transaction exceeds the value for which it was previously acquired. (A copy of the certification is attached to the original of these minutes and made a part hereof. RESOLUTION No. 345 OFFERED BY: MATTEI SECONDED BY: STEIN WHEREAS, N.J.S.A. 40A:l2-16 provides that Municipalities may, by Ordinance, exchange publicly owned lands, rights, or interests therein for privately owned lands, rights or interests therein when said exchange is deemed to be in the public interest and when the acquisition of the privately owned land is more advantageous to the Municipality: and I WHEREAS, the Z.J.R. Partnership, a partnership of the State of New Jersey located at 24 Pink Street, Hackensack, New Jersey, the owner of certain property known as Block 61 Lot 1 on the Tax Map of the City of Hackensack has proposed to convey a portion of said lot of approximately four (4) acres to the City of Hackensack in exchange for a portion of the City owned property known as Block 61 Lot lA, <:>ri the Tax Map of the City of Hackensack of approximately 4.5 acres: and WHEREAS, the Tax Assessor of the City of Hackensack has confirmed that the land and other consideration to be received by the City from the Z.J.R. Partnership, are of at Jeast, equivalent value to the full and fair value of the City lands to be conveyed to the Z.J.R. Partnership: and WHEREAS, it is the perception, belief, and finding of the M ... ........ ,,.,...,.::i ,.. ,;.., ,, ,...,.. ; 1 nr t-hP Ci tvof Hackensack, that the exchanqe of f the lands as aforementioned will confer added benefit to the people of the City of Hackensack as follows: 1. The present Municipal Public Works facility located at River Street and East Kansas Street is in an extremely deteriorated condition and has been for some time. It is in need of replacement. 2. The present Public Works facility is located on land which is, without question, better suited to private I development than it is suited to the location of a Municipal Public Works operation from both a fiscal and an aesthetic perspective. 3. The construction of a needed new Public Works faci 1ity in a less conspicuous site is, in and of itself, a substantial benefit to the people of the City of Hackensack. That the exchange authorized hereby will additionally cause the City to receive a substantial amount of cash from the z .J.R. Partnership which will significantly offset the cost of construction of a new Public Works facility to the City, a further positive benefit; and WHEREAS, the Mayor and Council of the City of Hackensack have on this date introduced Ordinance No. 18-92 entitled: "AN ORDINANCE AUTHORIZING THE EXCHANGE OF CERTAIN MUNICIPAL LANDS BEING (PART OF) BLOC� 61, LOT lA, FOR PRIVATELY OWNED LANDS BEING (PART OF) BLOCK 61, LQT 1, LOCATED IN THE CITY OF HACKENSACK, NEW JERSEY", pursuant to N.J.S.A. 40A:l2-16 to authorize this exchange; and WHEREAS, in order to consummate this transaction it is both necessary and appropriate to enter into a written Agreement with the Z.J.R. Partnership to firmly establish each of the parties' I rights, duties, obligations, responsibilities, and liabilities pertaining to this exchange; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack, as follows: 1. The Mayor and City Clerk be, and hereby are authorized, to execute an Agreement with the Z.J.R. Partnership to effectuate the aforementioned exchange of property. 2. Upon execution of the Agreement by both parties, the City Clerk shall keep a copy of said Contract on file and available for public inspection. JOHNSON, Tax Assessor for the City of Hackensack, 65 Central Avenue, Hackensack, New Jersey, hereby certify that: 1. I am the Tax Assessor for the City of Hackensack , and have been since July, 1973. 'I ·am· certified pursuant to N.J.S.A. 54:1-35.25. -·- ) .. 2. In this capacity, I am responsible for the maintenance and update of the property record cards of each and every parcel of real property located within the City of Hackensack. I am also responsible for annually determining the assessed value of such property. 3. I have been asked to make certain determinations re­ garding two such parcels located in the City of Hackensack. Spec­ ifically these parcels are Lot lA in Block 61, owned by the City of Hackensack, and Lot 1 in Block 61, owned by the Z. J. R. Partner­ ship, of 24 Pink Street, Hackensack, New Jersey. 4. With respect to Lot 1 A in Block 61 (the City land), I am advised that the property has been appraised by James W. Mason, M. A. I. , at a value of $380,000. 00 per acre. I am further advised that this per a cre value has been employed to determine the value of the City property in a proposed exchange of property between the foregoing parties for portions of their respective properties. 5. Assuming the foregoing to be accurate and correct, I can, and do, hereby certify that the value ascribed to the City property is at a level greater than the amount for which it was acquired, pursuant to N. J.S. A. 40A:l2-16. 6. With respect to Lot 1 in Block 61 (the Z.J. R. Prop­ erty), the tax assessment records of the City of Hackensack reveal that the land value of this twelve (12) acre parcel is $1,814,300. 00 for the current tax year. I certify that the within foregoing statements made by me Page 2 are true. I understand that if any of the within foregoing statements made by me are willfully false, I am subject to punish­ ment.
