139 The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenu � , Hackensack, New Jersey, on I Monday, August 16, 1993. Mayor Zisa called the meeting toI order at 8:00 P. M. and requested everyone stand for the Flag Salute. The Mayor then asked the City Clerk to call the roll. Present Councilman Roger B. Mattei, Councilman Jesus R. Galvis, Deputy Mayor Juanita Trammell, C buncilman Mark A. Stein, Mayor t John F. Z isa, City Attorney Richard E. Salkin, City Clerk Doris L. Dukes Absent: City Manager James S. Lacava Eugene Duffy was present for Mr. La�ava. I Mrs. Dukes: "In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975, adequate notice of this meeting was provided by sending a notice to The Rec0rd and posting a copy of same I on the Bulletin Board in City Hall." B. C. for the issuing authority to consider renewal of the license for the 1993-1994 license year; and WHEREAS, the licensee petitioned the Director, Division of A. B. C. for an order to permit the renewal of said license for the year 1993-1994; and WHEREAS, the Director has given authorization for the City Council of the City of Hackensack to consider renewal of this license and the City Council has no ob j ection to its renewal. Roll Call: Ayes - Mattei, Galvis, Trammell, Stein, Zisa Resolution #228 OFFERED BY: TRAMMELL SECONDED BY: MATTEI WHEREAS, the governing body of the City of Hackensack has been I advised that an emergency affecting the safety and welfare of the citizens of the City of Hackensack and the general public who operate motor vehicles within the City limits when a traffic signal· located at State and Mercer Streets was accidentally knocked down and rendered inoperable; and WHEREAS, the Chief of Police of the City of Hackensack has furnished to the City Manager a written report setting forth the time, place and circumstances regarding the emergency; and WHEREAS, the City Council is satisfied that an emergency did exist and that immediate action was necessary to restore the aforementioned traffic signal to full operation; and WHEREAS, Traffic Control Equipment Corp. , 242-252 Hudson Street, Hackensack, N. J. , was retained to make the necessary repairs; and WHEREAS, the cost of the repairs totaled $2, 405.00, which is a fair and reasonable quotation; and WHEREAS, the Chief Financial Officer has certified that funds are available in Account 93-318-670 of the General Fund, P. O. 80800; and WHEREAS, it is anticipated that the entire cost of this repair I will be recovered from the insurance carriers. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that Traffic Control Equipment be paid for said repairs, pursuant to N. J. S. A. 40:All-6, which authorizes the award of contracts without public bidding in emergency situations. I Roll Call: Ayes - Mattei, Galvis, Trammell, Stein, Zisa Resolution #230 OFFERED BY: MATTEI I SECONDED BY: STEIN WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions: and t WHEREAS, the Annual Report of Audit for the year 1992 has been filed by a Registered Municipal Accountant with the Municipal Clerk as l per the requirements of N.J.S. 40A:5-6, and a copy has been received by each member of the governing body; and i WHEREAS, the Local Finance Board of the State of New Jersey is authorized to prescribe reports pertaining to the local fiscal affairs as per R.S. 52:27BB-34; and I l WHEREAS, the Local Finance Board has promulgated a regulation requiring that the governing body of each municipality shall by L'f resolution certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the Annual Audit entitled: General Comments and Recommendations: and WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled: General Comments and Recommendations, as evidenced by the group affidavit form of the governing body: and WHEREAS, such resolution of certification shall be adopted by the governing body no later than forty-five days after the receipt of the Annual Audit as per the regulations of the Local Finance Board: and I WHEREAS, all members of the governing body have received and have fami 1iarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit as provided by the Local Finance Board: and WHEREAS, failure to comply with the promulgations of the Local Finance Board of the State of New Jersey may sub j ect the members of the local governing body to the penalty provisions of R.S. 52:27BB-52, to wit: R.S. 52:27BB-52 - "A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the Director of Local Government Service under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand dollars ( $1, 000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office." I NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hackensack hereby states that it has complied with the promulgation of the Local Finance Board of the State of New Jersey dated July 30, 1968, and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance. NOW I THEREFORE I BE IT RESOLVED by the Mayor and Counci 1 of the City of Hackensack that the Tax Counsel be and he is hereby authorized and directed to execute any and all documents which may be necessary in order to effectuate a settlement of litigation entitled "Camelot condominium owners, et al, vs. City of Hackensack", Docket No. 012247-92, presently pending in the Tax Court of New Jersey, so that the assessment of each individual unit be reduced and established as set forth on Schedule "A" for the year 1992: and BE IT FURTHER RESOLVED that the foregoing settlement is predicated upon a full waiver of any interest payable to the taxpayer on the refund. Wilman vs. City of Hackensack", Docket No. 02-23-06573-92, presently pending in the Tax Court of New Jersey, so I that the assessment be reduced to $167, 000 for 1991 and 1992: and BE IT FURTHER RESOLVED that the foregoing settlement is predicated upon a full waiver of any interest payable to the taxpayer on the refund. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that the Tax Counsel be and he is hereby authorized and directed to execute any and all documents which may be necessary in order to effectuate a settlement of litigation entitled "John D. and Veronica Alroy vs. City of Hackensack", Docket Nos. 008421-92 and 012265-92, presently pending in the Tax Court of New Jersey, so that the total assessment as set forth above be reduced to $300, 000 for 1991 and 1992: and BE IT FURTHER RESOLVED that the foregoing settlement is predicated upon a full w�iver of any interest payable to the taxpayer on the refund. NOW I THEREFORE I BE IT RESOLVED by the Mayor and Council of the City of Hackensack that the Tax Counsel be and he is hereby authorized I and directed to execute any and all documents which may be necessary in order to effectuate a settlement of litigation entitled "John Alroy vs. City of Hackensack", Docket Nos. 008423-92 and 012264-92, presently pending in the Tax Court of New Jersey, so that the total assessment as set forth above be reduced to $178, 000 for 1991 and 1992: and BE IT FURTHER RESOLVED that the foregoing settlement is predicated upon a full waiver of any interest payable to the taxpayer on the refund. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that the Tax Counsel be and he is hereby authorized and directed to execute any and all documents which may be necessary in order to effectuate a settlement of litigation entitled "Chateau Associates vs. City of Hackensack", Do·cket No. 006039-92 presently pending in the Tax Court of New Jersey, so that the total assessment as set forth above be reduced to $1, 899, 300 for 1992: and BE IT FURTHER RESOLVED that the foregoing settlement is predicated upon a full waiver of any interest payable to the taxpayer on the refund. Leoce is constructing a laundromat at 265 Sussex Street in the City of Hackensack; and WHEREAS, it is necessary that the developer of this project obtain from the Department of Environmental Protection a Sewer Extension Permit ( CP-1) ; and WHEREAS, pursuant to statute, it is required that the municipality certify that the project is in conformance with the requirements of all municipal ordinances and that the governing body of the municipality approves of the project as proposed by the applicant and that the City does not object to the application of a Sewer Extension Permit. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the City of Hackensack hereby authorizes the Mayor to sign the CP-1 endorsement on behalf of the municipality approving the project as proposed by the developer; and I BE IT FURTHER RESOLVED that no construction permits be issued until all permit applications required by any Department or Division of the State of New Jersey have been approved. Mayor Zisa asked Mr. Duffy, City Attorney Salkin and members of Council if they had anything to report. They did not. Mayor Zisa reported there will be an article featuring Hackensack in The Record this Sunday. The Mayor opened the meeting to the public for discussion of City business. I Jack Donovan, Willow Avenue, asked the Mayor who would be writing the article. Mayor Zisa said he thinks Tom Topousis is involved. Dorothy Schwartz, 47 Prospect Avenue, continued her series on rent increases and tax surcharges relating to the increases. Roy E. Brown III reported a problem involving an unidentified Police Officer and received four ( 4) tickets. He felt the tickets were issued unfairly and requested direction regarding same. Mr. Brown was advised by the City Attorney that he could address the Mayor and Council on any matter, but if he was indicating that the Police Officer acted unlawfully, this is not the proper forum. He should go before Judge Dinice. If he discusses the matter in public, he may prejudice the case. Councilman Mattei stated he had a copy of the officer's side of the story. Mayor Zisa advised that the Council could not take any action on the matter. Eric Martindale, 322 Park Street, addressed the newspaper article that appeared in The Record stating Fairleigh Dickinson University I would be building a dormitory with 300 units in Hackensack. He wanted to know where the building would be located and was advised that no one had approached the City as of yet. Mr. Martindale gave an overview of college life in a dormitory and urged Council to oppose the project. Mayor Zisa said he would not make comments based on a newspaper article and if Fairleigh is going to construct a facility, the Planning Board must review the plans. Alphonso E. Brown & Rae Brown, Union Street, the owners of the Funeral Home, stated they are new to Hackensack and have been encountering some problems with parking in front of the Home and are looking for a solution to the problem. They said the signs in front of the funeral home were put up by Mr. Gentile, the former owner, and are not enforceable. They felt there would be "No Parking" signs erected. The Mayor explained that if there are "No Parking" signs, it would be enforced for everyone, including the Browns. They felt that they would not be ticketed if there was a funeral going on. Before the Brown's proceeded with their problem, Mayor Zisa welcomed them to the City of Hackensack. The Mayor suggested they speak with the Traffic Division to see if the situation could be resolved. Mr. Donovan again stated that "the Hackensack Medical Center is the biggest takers of tax dollars". I /.F3 Mayor Zisa said they have owned the property they are expanding on since the 1930's.
