The Regular Meeting of the City Council of the City of Hackensack
was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on
Monday, December 6, 1993.
Mayor Zisa called the meeting to order at 8:00 P. M. and
requested everyone stand for the Flag Salute.
The Mayor then asked the City Clerk to call the roll.

on the Bulletin Board in City Hall."
The Mayor asked for approval of the minutes for the �eej;;ing . held
November 15, 1993.
Motion offered by Stein, seconded Trammell that tile minutes be
approved as submitted. Carried.
FINAL ADOPTION OF ORDINANCE NO. 15-93 ENTITirED: "AN ORDINANCE
FIXING AND DETERMINING MUNICIPAL CLASS POSITION AND SALARY RANGES FOR
CERTAIN EMPLOYEES OF THE FIRE DEPARTMENT OF THE CITY OF HACKENSACK".
Mayor Zisa: "This Ordinance has been advertised pursuant to law
and now calls for a public hearing. Will someone so move?"

WHEREAS, George A. Dalie, Construction Official, has expressed
an interest in retiring with the Early Retirement Incentive Program
offered by the State of New Jersey, Division of Pensions, PERS; and
WHEREAS, George A. Dalie has requested to remain employed by the
City of Hackensack for one (1) additional month with consent of the
Mayor and Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Hackensack that the one (1) month extension of employment is
hereby approved for George Dalie, Construction Official, for a
retirement date of May 1, 1994; and
BE IT FURTHER RESOLVED that a certified copy of this Resolution

WHEREAS, there continues to exist a need for the Health
Department of the City of Hackensack to provide professional physician
services; and
WHEREAS, Jane v. Sokol!, M.D. of 762 Ridgewood Avenue, Oradell,
N. J., is a physician who is licensed by the New Jersey State
Department of Health to practice medicine in the State of New Jersey;
and
I WHEREAS, the City Council pursuant to the power delegated to it
by N.J.S.A. 40: 81-9, did appoint the professional to perform services
for the Health Department of the City of Hackensack; and
WHEREAS, it has become necessary to amend the terms of the
appointing agreement with Jane v. Sokol!, M.D.; and
WHEREAS, the maximum 1994 allocation for these physician services
is $5,544.00 and funds are available for this purpose; and
WHEREAS, the Local Pub! ic Contracts Law ( N. J.S. a. 40A: 11-1 et
seq. ) requires that the resolution authorizing the award of contracts
for "Professional Services" without competitive bidding and the
contract itself must be available for public inspection.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of
the City of Hackensack as follows:
1. That the Mayor and City Clerk be and are hereby authorized and
directed to execute an agreement with Jane V. Sokoll, M. D. of 762
Ridgewood Avenue, Oradell, New Jersey, for physician services.
2. This contract is awarded without competitive bidding as a
"professional service" in accordance with the Local Public Contracts
Law (N.J.S.A. 40A: ll-l et seq.) because the same is expressly excluded

from competitive bidding.
3. That a notice of this resolution be published once in The Record.
4. That this resolution shall be effective as of January 1, 1994;
and
BE IT FURTHER RESOLVED that the Chief Financial Officer has
certified in accordance with N.J.S.A. 52: 27B-10 and 40A: 4-57 that

certified to perform Public Health Nursing Services according to the
"Recognized Public Health Activities and Minimum Standards of
Performance for Local Boards of Health in New Jersey" (New Jersey
Administrative Code, Title 8 - Chapter 52) and has agreed to provide

said services for the calendar year 1994; and
WHEREAS, the maximum amount of the contract for these services is
$27,908.00 and funds are available for this purpose; and
WHEREAS, the Local Public Contracts Law ( N. J. S.A. 40A: 11-1 et
seq.) requires that the resolution authorizing the award of contracts
for "Professional Services" without competitive bidding and the
contract itself must be available for public inspection.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of
the City of Hackensack as follows:
1. That the Mayor and City Clerk be and are hereby authorized and
directed to execute an agreement with the Home Health Agency of
Hackensack Medical Center to perform services for the period January
1, 1994 through December 31, 1994.
2. This contract is awarded without competitive bidding as a
"professional service" in accordance with the Local Public Contracts
Law, N.J. S.A. 40A: ll-5 (1) (a) , because the same is expressly excluded
from competitive bidding and without public advertising for bids as an
authorized exception.

3. That a notice of this resolution be published once in The Record.
4. That this resolution shal1 be effective as of January 1, 1994;

BE IT FURTHER RESOLVED that the Chief Financial Officer has
certified in accordance with N.J.S.A. 52:27B-10 and 40A: 4-57 that

WHEREAS, there exists a need for the Health Department of the
City of Hackensack to provide a dental health program to the indigent
children of the school system of the City of Hackensack� and
WHEREAS, the Outpatient Department of Hackensack Medical Center
can provide the professional services necessary to render a dental
health program; and
WHEREAS, the City Council pursuant to the power delegated to it

by N.J.S.A. 40:81-9 may appoint professionals to perform said services
for the City of Hackensack; and
WHEREAS, the Outpatient Department of Hackensack Medical Center
has agreed to provide said services for the City of Hackensack for the
calendar year 1994; and
WHEREAS, the maximum amount of the contract for these services is
$32,518.00 and funds are available for this purpose; and
WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A:ll-l et
seq.} requires that the resolution authorizing the award of contracts
for "Professional Services" without competitive bidding and the
contract itself must be available for public inspection.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of
the City of Hackensack as follows:
1. That the Mayor and City Clerk be and are hereby authorized and
directed to execute an agreement with the Outpatient Department of
Hackensack Medical Center to perform services for the period January
1, 1994 through December 31, 1994.
2. This contract is awarded without competitive bidding as a

"professional service" in accordance with the Local Public Contracts
Law, N.J.S.A. 40A:ll-5 ( 1), because the same is expressly excluded
from competitive bidding and without public advertising for bids as an
authorized exception.
3. That a notice of this resolution be published once in The Record.
4. That this resolution shall be effective as of January 1, 1994;
and
BE IT FURTHER RESOLVED that the Chief Financial Officer has
certified in accordance with N.J.S.A. 52:27B-10 and 40A:4-57 that
monies are available from the General Funds in Account Number
94-610-560 in the amount of $3 2,518.00 to be charged on Purchase Order
Number 82027.

WHEREAS, there exists a need for the Health Department of the
City of Hackensack to provide animal control services as required in
N.J.A.C. 8:52-4.3 et seq.; and
WHEREAS, the County of Bergen is presently operating the Bergen

County Animal Shelter at 100 United Way, Teterboro, New Jersey, which
has facilities and duly qualified personnel to carry out said animal
control services: and
WHEREAS, the County of Bergen has agreed to provide animal
control services through a contract agreement with the City of
Hackensack's Department of Health for the calendar year 1994: and
WHEREAS, the maximum amount of the contract is $35, 900.00 and
funds will be available for this purpose: and
WHEREAS, it has been certified that this meets the statutes and
regulations concerning the award of said contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of

the City of Hackensack as follows:
1. That the Mayor and City Clerk be and are hereby authorized and
directed to execute an agreement with the County of Bergen to perform
animal control services for the period January 1, 1994 through
December 31, 1994.
2. This contract is awarded without competitive bidding in
accordance with the Local Public Contracts Law, N.J.S.A. 40A: ll-5 (2) ,

because the same is an agreement between a county and a municipality
and is expressly excluded from competitive bidding and public
advertising.
3. That this resolution shall be effective as of January 1, 1994,
and
BE IT FURTHER RESOLVED that the Chief Financial Officer has
certified in accordance with N.J.S.A. 52: 27B-10 and 40A: 4-57 that
monies will be available from Account Number 94-615-211 of the 1994
Current Fund in an amount not to exceed $35,900.00 Purchase Order
Number 82028.

WHEREAS, there exists a need for the Health Department of the
City of Hackensack to provide health education services of a technical
and professional nature; and
WHEREAS, the Bergen County Department of Health Services has
agreed to provide duly qualified personnel to carry out the health
education activities; and
WHEREAS, the Bergen County Department of Health Services has
agreed to provide health education services through a contract
agreement with the City of Hackensack's Department of Health for the
calendar year 1994; and

WHEREAS, the maximum amount of the contract is $6,340.00 and
funds will be available for this purpose; and
WHEREAS, it has been certified that this meets the statutes and
regulations concerning the award of said contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of
the City of Hackensack as follows:
1. That the Mayor and City Clerk be and are hereby authorized and
directed to execute an agreement with the Bergen County Department of
Health Services to perform health education services for the period
January 1, 1994 through December 31, 1994.
2. This contract is awarded without competitive bidding in
accordance with the Local Public Contracts Law, N.J.S.A. 40A: ll-5 (2) ,
because the same is an agreement between a county and a municipality
and is expressly excluded from competitive bidding and public

3. That this resolution shall be effective as of January 1, 1994;
and
BE IT FURTHER RESOLVED that the Chief Financial Officer has
certified in accordance with N.J.S.A. 52: 27B-10 and 40A: 4-57 that

Bloomfield Avenue, West Caldwell, New Jersey, can provide the
necessary clinical laboratory services which are necessary for

WHEREAS; the City Council pursuant to the power delegated to it
by N.J.S.A. 4 0: 81-9 may appoint professionals to perform said services
for the Cityiof Hackensack: and
WHEREAS, Kaulson Laboratories, Incorporated has agreed to perform
said services for the City of Hackensack for the period January 1,
1994 through December 31, 1994: and

Mayor Zisa thanked her and asked the City Manager, City Attorney
and members of Council if they had anything to report. They did not.

Mayor z isa thanked the PBA for bringing back the Turkey Shoot;
the 300th Celebration Committee for their final event, the New Jersey
Nets game at which, during half time, Mike Fratella was honored; and
the Recreation and DPW Departments for the tree lighting on Main
Street.
Councilman Stein congratulated the Hackensack football team who,
on this past Saturday, again won the State Championship.
The Mayor opened the meeting to the public for discussion of City
business.
Eric Martindale, 33 Essex Street, said the City needs to take
corrective measures regarding land use violations and cited the
following things the City should do: create an Advisory Board to seek
out violations with directions from Mr. Duffy and Mr. Manning and an
Urban Renewa1l Advisory Board to identify loopholes. He referred to a
report issued by Teaneck and said Hackensack needs more Boards.

Mayor z,isa said he had a copy of Teaneck's report on file and is
seeking infdrmation on the costs involved. He said he likes what they
have done.

Dorothy, Schwartz, 47 Prospect Avenue, said an article appeared in
The Record regarding the lawsuit filed against the Borough of Fort Lee
regarding the Rent Control Ordinance. She spoke on the issues
involved and: stated she had a conversation with City Attorney Salkin.
I
Mr. Salkin
1 said Ms. Schwartz accurately described his opinion as
given to the Mayor and Council and still stands by the opinion that we
should wait.'
Mayor Zisa explained that Mr. Salkin, about eight months ago, saw
this coming and predicted accurately what would happen in Fort Lee.
He said he feels we are acting in the best interest of the tenants.
Ms. Schwartz said she disagrees 100 percent.
Kevin Schneider addressed the Mayor and Council regarding an
appointment as a Hackensack Police Officer. He said his name had been
removed from the eligibility list because someone was misinformed that
he was not a Hackensack resident. He said he was in Florida for
approximately six months assisting his father who was ill and had
financial problems. He stated he has continued to pay rent at his
Pleasantview Avenue apartment since 1988. He requested a letter, per
the State, to be placed back on the list.
The City Attorney advised Council that he had been contacted by
an attorney :on Mr. Schneider's behalf and recommended that they or the
City Manager not respond. He said there is an appeal procedure
through the Merit Board if Mr. Schneider disagrees.

Mayor iisa advised Mr. Schneider that it may be wise to forward
the information he presented tonight to members of Council for their
review.
I
Nat Shatzoff, 101 Prospect Avenue, also spoke on the lawsuit
filed in Fo�t Lee regarding their Rent Control Ordinance. He said the
5 percent increase that tenants have to pay in Hackensack is totally
unfair. 1
Jack Donovan, Willow Avenue, addressed the issue of composting
and offered I'some recommendations for 1994. He gave the City Manager a
document on �he subJect.
