City Council

The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Monday, March 7, 1994. The Mayor called the meeting to order at 8:00 p. m. and requested everyone stand for the flag salute. The Mayor then asked the City Clerk to call the roll. Present - Councilman Roger B. Mattei, Councilman Jesus R. Galvis, I Deputy Mayor Juanita Trammell, Councilman Mark A. Stein, Mayor John F. Zisa, City Clerk Doris L. Dukes, City Attorney Richard E. Salkin and City Manager James S. Lacava Mrs. Dukes: "In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975 , adequate notice of this meeting was provided by sending a notice to The Record and posting a copy of same on the Bulletin Board in City Hall. " Mayor Zisa called for a motion to approve the minutes of the February 14th Work Session and the February 22nd, 1994 meeting. Motion offered by Stein, seconded by Trammell that the minutes be approved as submitted. The City of Hackensack agrees to contribute $20 , 000 .00 toward the aforedescribed settlement: and 2. Payment shall be made by the Chief Financial Officer upon receipt by the City of appropriate releases, stipulations and other appropriate documents. Mayor Zisa thanked her and asked the City Manager, City Attorney and members of Council if they had anything to report. Councilman Stein stated that he had attended the competition for the OM, Odyssey of the Mind, and reported that of the eight teams, all eight placed in the finals. Councilman Mattei reported that from time to time our Police receives a Certificate of Meritorious Service for their work and read I the following citation: "On January 31 , 1994 , Police Officer Dennis Parente and Police Officer Craig Morrissey attempted to apprehend the operator of a stolen motor vehicle. The sub ject attempted to run down Police Officer Parente during the course of the investigation. Through the investigative efforts of Sgt. William Osinski, Sgt. Frank Lomia, Police Officer Thomas Foschini, Police Officer Thomas Padilla and Police Officer Craig Morrissey, the actor and two others were apprehended and thousands of dollars of stolen property was recovered."  I On behalf of the Mayor and Council he congratulated the efforts of these officers. Mayor Zisa opened the meeting to the public for discussion of City business. Sandra Bell, 274 High Street, spoke on behalf of Mr. & Mrs. Charles Randolph requesting that their handicapped parking sign be changed. Ms. Bell reported that both are handicapped and needed the change for easier accessibility. Mayor Zisa advised that the matter would be referred to the Traffic Division. Deputy Mayor Trammell stated that she knows the Randolphs. They are in fact both handicapped and requested the City Manager investigate their request right away. Sandy Williams, 267 Clay Street, said �P�Y are . '' opposing a variance in this area and perhaps things sho.uld not mo ve too quickly as it relates to moving the handicapped parking si�n. Mrs. Randolph would like to have the handicapped ,parking s pace. on the northwest I ' • corner of Central Avenue. Mr. Williams also reported that when the snow was being plowed at 240 Prospect Avenue, it was being dumped over the wall onto the sidewalks of Third Street. He presented Council with pictures to that effect. He also presented pictures showing the pipes through the wall when water is "gushing" out on the sidewalks. It is a very dangerous situation and advised Council that he is going to contact the Department of Environmental Protection to request that they come down. He requested the City Manager and members of Council to come down and take a walk through the area to see for themselves what is taking place. Mr. Williams presented other pictures of water, snow, etc. affecting the homeowners in the area as a result of the building on Prospect Avenue. I Mayor Zisa advised the City Manager to investigate the situation with water coming out of the pipes right away because it is a very dangerous situation. Mary Watson, 267 High Street, stated that she has been coming before Council on Quail Heights since 1989 . She reported that the workers are standing on the balcony of the :building and throwing the garbage at the bottom. This garbage that they are throwing over the balcony is being buried. In addition, because of the water that runs down Central Avenue during a heavy rain, she requested a storm sewer be installed at the corner of Central and Third Street. Mayor z isa pointed out that we have plans for Third Street and the problems will be dealt with. Josephine Oates, Central Avenue, also reiterated what Mrs�. Watson_ stated. John Serivol a, 211 Johnson Avenue, complained of an abandoned I vehicle parked in front of 211 Johnson Avenue for well over thirty days. He stated that two different cars have the same license plate numbers. One of the cars has no plate on the front. The cars have not been ticketed and, in his opinion, it is due to having a PBA sticker on the window. He reported that he had called the Police Department because his wife had observed a man pulling a woman out of a car in the parking lot. The woman appeared to be crying and it also looked as if she did not want to go. It took the Police Department fifteen minutes to arrive and by the time they got there, the couple had already gone.  Murray Cohen, 185 Prospect Avenue, commented on the story regarding the City's Refunding Bond Ordinance to pay tax appeals. He commended the present Assessor, Mr. Arthur Carlson. Dorothy Schwartz, 47 Prospect Avenue, commented on the stickers mailed to the residents by the Hackensack Police Department. Frank Campbell, 111 Catalpa Avenue, complained about the number of trucks with snowplows attached to them in residential neighborhoods. They are cleaning the streets and pushing the snow in front of other property owners' property. He also complained about I the catch basins not being cleared during snow removal and gutters not being cleared to allow drainage. : .. , ... � . ' .- Mr. Campbell also commented on the flashing light at the corner of First and Beech Street. Mr. Sambers, Second "Street, also spoke about the 300 Prospect Avenue matter. She reported a huge dump truck as well 'a·s· a trailer parked at the corner of Second Street �whfc'h •·blocks· the view of anyone making a left-hand turn from Stanley Place. She has called the Police and has spoken to the people involved. The trucks will disappear for about a month or ' so and then they are returned again. Mayor Zisa said we have discussed the problem of commercial vehicles parking in residential areas on many occasions. He requested the City Manager look into this matter. ' ·., Louise Porter, 290 Third Street, reported 'that she watched,_ the City trucks plow out the Whitehall parking lot and dump the snow in front of her driveway up to four feet high. She also asked about the I 300 Prospect Avenue building and asked if the dirt is still there. City Attorney Salkin reported that he had met with the prospective purchasers of 300 Prospect Avenue regarding the removal of the dirt. After they take title, shortly thereafter the dirt should be removed. He pointed out, however, that it will take some time. Mayor Zisa reported that the City was asked by the County to offer them projects that would qualify for a new Quick Start Program. We submitted two proposals - the Third Street curbing and the sewers. The County refused. Then he added that Hackensack was the only municipality that was turned down. He advised the residents that if anyone wished to convey their thoughts to the County, to please do so. Mary Watson, 267 High Street, asked if Third Street would be open for the trucks and cars from 300 Prospect Avenue while they are building on the other end. She said she is concerned because the first building was supposed to be seven stories and is now ten. There was not supposed to be an opening on Third Street and now there is an opening. When they start to move the dirt, they were going to be faced with more problems. City Attorney Salkin indicated that there had been some correspondence wherein the City Engineer stated that the most likely access for buildings II and III would be from the Third Street side. I He said he would be happy to show her the correspondence. Councilman Stein reiterated what the Mayor had said regarding the Quick Start fund. He indicated that Mr. Duffy is looking into Community Development Block Grant funds to see if there are any left over to do the project. Motion offered by Stein, seconded by Galvis that the public hearing be closed. Carried  Mayor Zisa said he understands the frustration of the residents but we have tried to deal with the problem. We have had State Health Inspectors in and the Environmental people in to look at the situation. We have tried many ways to clear it. Deputy Mayor Trammell said she wants the citizens to realize her concerns that they had inherited the problem. She offered her full support.
