1¥7 The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Monday, August 1, 1994. Mayor Zisa called the meeting to order at 8:06 p.m and asked everyone to stand for the flag salute. The Mayor then asked the Deputy City Clerk to call the roll. Present - Councilmen Roger B. Mattei, Mark A. Stein, Mayor John F. Zisa, City Manager James S. Lacava, City Attorney Richard E. Salkin and Deputy City Clerk Anna LaMarche I Absent Councilman Jesus R. Trammell and City Clerk Doris L. Dukes Galvis, Mrs. LaMarche: "In accordance with the Open Public Meetings Act, Deputy Mayor Juanita Chapter 231, Laws of 1975, adequate notice of this meeting was provided by sending a notice to The Record and posting a copy of same on the Bulletin Board {n City Hall." Mayor Zisa called for a motion to approve the minutes of the meeting held July 18, 1994. Motion offered by Mattei, seconded by Stein that the minutes be approved as submitted. Carried FINAL ADOPTION OF ORDINANCE NO. 2S-94 ENTITLED: "AN ORDINANCE FIXING AND DETERMINING MUNICIPAL CLASS POSITION TITLES AND SALARY RANGES FOR CERTAIN NON-CONTRACTUAL OFFICERS AND EMPLOYEES OF THE CITY OF HACKENSACK". Mayor Zisa: "This Ordinance has been advertised pursuant to law and now calls for a public hearing. Will someone so move?" Roll Call: Ayes - Mattei, Stein, Zisa Absent - Galvis, Trammell Resolution #250 OFFERED BY: MATTEI SECONDED BY: STEIN WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions: and I WHEREAS, the Annual Report of Audit for the year 1993 has been filed by a registered Municipal Accountant with the Municipal Clerk as per the requirements of N.J.S. 40A:5-6, and a copy has been received by each member of the governing body: and WHEREAS, the Local Finance Board of the State of New Jersey is authorized to prescribe reports pertaining to the local fiscal affairs, as per R.S. 52:27BB-34: and WHEREAS, the Local Finance Board has promulgated a regulation  requiring that the governing body of each municipality shall, by resolution, certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled: General Comments and Recommendations; and WHEREAS, the members of the governing body have personally reviewed, as a minimum, the Annual Report of Audit and specifically the sections of the Annual Audit entitled: General Comments and Recommendations as evidenced by the group affidavit form of the I governing body; and WHEREAS, such resolution of certification shall be adopted by the governing body no later than forty-five days after the receipt of the annual audit as per the regulations of the Local Finance Board; and WHEREAS, all members of the governing body have received and have familiarized themselves with at least the minimum requirements of the Local Finance Board of the State of New Jersey as stated aforesaid and have subscribed to the affidavit as provided by the Local Finance Board: and WHEREAS, failure to comply with the promulgations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R. S. 52:27BB-52 - to wit: R. S. 52:27BB-52 - "A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the Director of Local Government Service under the provisions of this article, shall be guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office. " I NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hackensack hereby states that it has complied with the promulgation of the Local Finance Board of the State of New Jersey dated July 30, 1968, and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance. Absent - Galvis, Trammell 15"0 Mrs. LaMarche advised the Mayor that the Docket was completed. Mayor z isa thanked her and asked the City Manager and the City Attorney if they had anything to report. They did not. Mayor Zisa stated that Council members were present at the Price Club opening which was very successful. Property owners and merchants feel very positive about the addition of the Club to Hackensack. The Mayor asked the members of Council if they had anything to I report. Councilman Stein noted that the second of our City Summer Park Concerts will be held on Thursday night, August 4th, at 7:00 p.m. featuring Phil Costa and the Something Special Orchestra. The first concert, Country Western Night, was very exciting. The Mayor then opened the meeting to the public for discussion of City business. Dorothy Schwartz, 47 Prospect Avenue, spoke on the rent ordinance. She noted that she was in error when stating that the Mayor said "that waiting for the Ft. Lee case to be settled was in the best interests of the Hackensack tenants". She urged that the rent ordinance be amended despite the Fort Lee case and suggested that 3 percent was more realistic. Nabil Mitri, 316 Prospect Avenue, stated that his taxes on a two-bedroom condo have increased from $ 2500 in 1991 to $ 3600 in 1994. After some discussion, Mayor Zisa recommended that he contact Mr. Lacava and the Tax Assessor as he felt that something was not right. He explained that for the last two years the taxes should not have increased, but in 1994 the tax bill was greater than any bill in the last four years. He hoped his letter which was sent to the residents was self-explanatory. Councilman Stein added that the 1994 tax increase was in part due to the loss of State funding. Joseph Sickler, 307 Prospect Avenue, questioned the "Coming Soon I New Building" signs that appear at the Hackensack Ford tent on River Street for the past six years. Mayor Zisa explained that the original agreement with Hackensack Ford was for the tent to remain for 24 months. We were made privy to some information, i.e., they were in the process of selling one of the two dealerships on the property. The automobile manufacturer did not permit the actual transfer to go through. There have been two plans before the City and they are coming forward with a final plan for construction. Pressure has been put on them and the owner and representatives will come before the Council. If it is found that they are being unfair, they will be shut down. If legitimate, we will try to work with them. We will know their plans within the next 30 days and action will then be taken one way or another. Mr. Sickler also spoke about the taxes. He has heard that one of the reasons for the increase is that the City failed to apply for State funds. I Mayor zisa explained the reasons Hackensack did not apply for the funds. We could have put together the paperwork, but we knew from past practices, the qualifying requirements and directly from the State Department of Community Affairs that we would not qualify for State funding. Teaneck went through the process, but to no avail. Out of the 38 municipalities that made application, only 14 were granted funds.  !SI Frank Campbell, 111 Catalpa Avenue, spoke on the following items: 1. There is a settlement in the pavement around a catch basin on State and Myer Streets. 2. Manhole covers on Main Street from Essex Street to Sears are above street level since the resurfacing has been completed. 3. Euclid and Summit Avenues - During rain storms, dirt drains I down to Prospect Avenue from construction site and the street is covered with dirt. Councilman Mattei stated he has seen that a tremendous attempt has been made by using plastic at the site, but all you need is a heavy rain that results in this situation. As far as he knows, no complaints have been received from the residents on Euclid Avenue. Mr. Campbell remarked that "if no one has complained, "I am amazed". Councilman Stein agreed with Councilman Mattei's statement that this condition exists only after heavy torrential downpours, which we have had during the past few weeks. The methods that the developer is using is for normal rainfalls. Mayor Zisa added that .the property owner and excavator have complied with all the requirements under the code. Shortly after Mr. Campbell's comments at the last few meetings, he went up and saw the soil marks on the street.
